Based on what he saw during April 22 oral arguments in the Supreme Court case of broadcasters versus Aereo, BTIG media analyst Richard Greenfield says in his blog that The Supreme Court could very well side with Aereo. Greenfield tells Cynopsis, "I think the broadcasters walked in very confident and had to walk out less confident. While Aereo could certainly lose, anybody listening and seeing the Justices ask questions would say that Aereo has a real shot at winning."

IN THE NEWS

Charter will get almost 4 million new subscribers in a post-merger arrangement expected to make Comcast‘s acquisition of Time Warner Cable more palatable to regulators. On Monday, Comcast announced it’s creating and spinning off a new publicly traded company that will hold 2.5 million Comcast subscribers, plus 1.4 million acquired by Charter from TWC for $7.3 billion. Comcast Chairman/CEO Brian Roberts cited operational efficiencies as a benefit of the deal; greater scale and growth opportunities for Charter were noted by that company’s president and CEO, Tom Rutledge.

Craig Ferguson is leaving The Late Late Show when his contract is up in December. "CBS and I are not getting divorced," he said in a statement, "we are ‘consciously uncoupling.’" Ferguson, who has hosted the late-nighter since 2005, scored a multi-million dollar payout when CBS decided to replace The Late Show‘s David Letterman with Stephen Colbert. Ferguson had already made plans to move on to syndicated Celebrity Name Game in fall 2014, and produce I F***ing Love Science for Science Channel.

Hallmark Channel is launching a new TV Everywhere app. Hallmark Channel Everywhere will make available the network’s series, as well as a rotation of its original movies. Developed by Bottle Rocket, the app will also feature social and email sharing capabilities and a customizable watch list. "The app, part of our active strategy to build our digital footprint, will not only benefit viewers but also enable our affiliate partners to bring greater value to their subscribers, while providing advertisers new opportunities to reach consumers," said Bill Abbott, president and CEO of Crown Media Family Networks.

Using worldwide activity on peer-to-peer hub Bittorrent as the gauge, content infringement fighter CEG TEK named CBS the most-pirated network last week, followed by ABC, HBO, CW and Fox. The top five most pirated shows: Game of Thrones, The Big Bang Theory, The Walking Dead, Arrow and How I Met Your Mother.  

The Daily Show with Jon Stewart is strengthening its bench with stand-up comedian and Saturday Night Live writer Michael Che as a correspondent. Che’s first special is coming up, on Comedy Central Monday, June 9.

History will have a seat at the White House Correspondents’ Association Dinner, partnering with the WHCA for a video commemorating the centennial of the organization that will be screened at the Saturday, May 3 event. "We’ve worked together to tell the story of the Association, including its regrettable chapters and its proud principles," said WHCA president Steven Thomma. "The video will be a very special part of the dinner."

USA‘s Graceland is getting a taste of the big screen: A cinema spot for the summer series is airing in about 20,000 movie theaters as part of NCM Media Networks‘ FirstLook pre-show program. Season two of the drama returns Wednesday, June 11 at 10p.

Bravo announced five new unscripted shows in development (all working titles): Crowd Control (from LOUD TV) has someone’s personal choices dictated by directions from the audience; Fempire (Watercooler Casting), explores the world of female CEOs; The Fit Club (All3Media America and Lime Pictures), focuses on the friendships and feuds of trainers; relationship reality show Last Chance (Wilshire Studios and Iron Ocean) and Why Not, Minot? (Leftfield Entertainment) about a modern-day gold rush.

Arts net Ovation gave the green light to Young Marvels, a docu-series that profiles young prodigies. A Young Doctor’s Notebook (starring Jon Hamm and Daniel Radcliffe) and The Fashion Fund (with Anna Wintour and Diane von Furstenberg) got goaheads for season twos.

Trifecta Entertainment has commenced production on syndicated court show Judge Faith. The half-hour strip, premiering in fall 2014, features former NYC prosecutor Faith Jenkins.

COMING UP

CBS announced season finale storylines for shows wrapping up in May. Some highlights: Gretchen has a big surprise for Two and a Half Men‘s Alan on their wedding day (Thursday, May 8 at 9p; Brad Paisley guests); Mark Harmon goes home after the death of his father, who had been played by Ralph Waite (the episode, on Tuesday, May 13 at 8p, is a tribute to the late actor); Sheldon considers a big move on The Big Bang Theory (Thursday, May 15 at 8p); the final teams dash through Las Vegas on The Amazing Race (Sunday, May 18 at 8p), and the winner is crowned on Survivor (Wednesday, May 21 at 8p).

Fox is planning a live, three-hour production of Grease (wt: Grease Live), with Paramount TV, for 2015. "Its iconic characters and addictive songs make it the perfect fit for Fox," said Shana C. Waterman, SVP of event series for Fox. "We’re going to give it the kind of star power and production quality to make every Sandy, Danny, Rizzo and Kenickie out there want to get up and sing along."

Rebels, Icons & Leaders: CNBC First 25, a list of 25 people who made the biggest impact on business and finance in the last quarter century, airs on the business news net tonight at 7p.

A family shunning society to live in bitter-cold wilderness is the focus of Alaskan Bush People, premiering on Discovery Tuesday, May 6 at 10p.

Nickelodeon celebrates Mother’s Day with a special episode of Instant Mom featuring four memorable TV mothers. Marion Ross (Happy Days), Florence Henderson (The Brady Bunch), Meredith Baxter (Family Ties) and Jackee (Sister, Sister) appear Thursday, May 8 at 8p to dole out advice.

ION Media announced 11 new shows in the hopper for lifestyle net ION Life, including Chef at Home, Design Rivals, Diva on a Dime and canine counseling series In the Dog House.

Not only is Showtime offering the first episode of upcoming new drama Penny Dreadful early across multiple platforms, the series’ second ep will be available to subscribers on Showtime Anytime immediately following its proper premiere on Sunday, May 11 at 10p.

EPIX will premiere documentary Altman, about acclaimed director Robert Altman (M*A*S*H, Nashville) on Wednesday, August 6 at 8p.

Actor/comedian/Daily Show correspondent Al Madrigal will host a one-hour primetime special for Fusion on the booming Latino community in America, to air this fall in advance of the 2014 midterms.

RETURNING SHOWS

Season five of Fox‘s Masterchef debuts Monday, May 26 at 8p. The cooking competition will feature a diverse crew of 30, including an ad exec, a high school student and a church music director.

Life with La Toya is back for a sophomore run on Saturday, June 7 at 10p, with two back-to-back eps on OWN.

E! offers tours of four luxe homes on the market in a new A-List Listings. Half-hour special, featuring houses owned by celebs including Queen Latifah and Oliver Stone, airs Thursday, May 8 at 8p.

Season two of ASPiRE‘s Exhale returns Wednesday, May 7 at 8p, for more candid discussions about topics relevant to the lives of African-American women.

SundanceTV is bringing back original scripted series The Red Road for a second season. Six fresh eps launch in 2015.

CASTING

Sarah Silverman will recur on season two of Showtime drama Masters of Sex. Production is underway for a Sunday, July 13 premiere.

Jake Weber (Medium) has joined AMC‘s Hell on Wheels as a series regular. Drama returns this summer for season four.

BRANDS & ADVERTISING

Sister nets CBS and The CW are getting closer. CW, a joint venture from CBS and Warner Bros., and CBS will "coordinate and share resources" in ad sales, with CW EVP of sales Rob Tuck still reporting to CW president Mark Pedowitz, but getting "added direction" from CBS president of network sales Jo Ann Ross. "The CW is part of the CBS family, so we can seamlessly collaborate and coordinate to maximize value for its clients," said Ross.

Band-Aid, Campbell’s Soup and AT&T produced 15-second ads that, combined, send a message about the importance of early diagnosis for autism. The PSA aired Monday, during CNN‘s New Day, followed by a direct to autismspeaks.org. "With April being Autism Awareness month, we were looking for a way to dramatically tell this story," Greg Hahn, chief creative officer at BBDO New York, told AdWeek. "We found it through a partnership with our brilliant clients who eagerly embraced the convention-breaking, innovative spirit of the idea."

Offensive racist remarks attributed to LA Clippers owner Donald Sperling are costing the NBA team big sponsors, even as advertisers express support for players and fans. So far, State Farm, Red Bull, automotive sponsor Kia Motors, Sprint, Lumber Liquidators and AquaHydrate have suspended marketing activity; CarMax and Virgin America ended sponsorships. Presenting sponsor Chumash Casino dropped out Monday, saying that though "We remain supportive of members of the team… we cannot ignore any statement that causes harm or hurts any group." The NBA and the Clippers are investigating the matter.

INTERNATIONAL HAPPENINGS

Crime + Investigation is now available in Mozambique and Angola via the platform DStv. The channel, in Portuguese, features content from A+E Networks‘ crime/justice catalogue, including The First 48, I Killed My BFF, Cajun Justice, Beyond Scared Straight and Evil Up Close

ABC freshman drama Resurrection is jetting to Asia. The hit show premieres on Lifetime Monday, May 12, following promotional meet-and-greets by cast members in Malaysia, Singapore and The Philippines, sponsored by LG Home Appliances.

Peru’s America TV commissioned a version of Banijay International‘s Mentor, for broadcast later this year. The deal was brokered by Sony Pictures Television.

Blue Ant International announced its first distribution output deal with non-fiction producer Our House Media.

RATINGS

CBS swept Sunday night in viewers (9.2 mllion) for the eighth straight week, according to Nielsen preliminary numbers. ABC won the night in the A18-49 demo with 1.7/5; CBS and Fox shared second with 1.5/4.

John Oliver‘s Last Week Tonight got off to a solid start, delivering 1.1 million viewers to HBO on Sunday, and 1.4 million counting a second showing – a 51 percent lift over the timeslot average. But the big news was the net’s Game of Thrones, averaging a series-high 6.9 million viewers at 9p.

Over its first three weeks, ION original series The Listener is averaging over 1 million viewers, 376,000 among A18-49 and 451,000 among A25-54. ION also announced it’s ranking among the top 10 cable networks in cable in A25-54 in primetime, led by Criminal Minds.
