Good morning. It’s Wednesday, October 25, 2006, and this is your first early morning briefing.

NBC Universal announced that its cable networks will “opt out” of the initial data on commercial ratings provided by Nielsen Media Research, and will not be included in the initial information that will be provided starting in December. Those networks include Bravo, MSNBC, Sci Fi Channel and USA Network. And the NBC cable networks aren’t alone – also ditching the commercial ratings (at least for now) are MTV Networks, ESPN, Discovery Networks, TBS/TNT, Cartoon, Court TV, CNN and CNN Headline News.  The reason given by these networks is errors in the methodology and Nielsen’s inability to differentiate between the local and national cable commercial spots.  In a letter to Nielsen, Jack Wakshlag, Turner’s Chief Research Officer, said they found errors in the reporting of commercial data and that they don’t believe the service is ready to be released until the errors are corrected.  The Cabletelevision Advertising Bureau is also says now is not the time for its members to participate in this service because of the flawed data, but rather to work with Nielsen in correcting the issues.  The purpose of the data is to show how many viewers are watching the commercials, particularly when a program has been Tivo’s or DVR’d.  One camp – largely those paying for their commercials to air – suggest viewers fast forward past the ads. The other camp – those taking money for commercials – says the research will show people will still watch the spots.

* MORE GOOD STUFF *

 
Bravo has renewed the docu-drama series Work Out for a second season, with production on the six episodes beginning in Los Angeles next month. The series looks at Jackie Warner, the owner of Sky Sport and Spa, as it chronicles her business and personal life, and the trainers at her gym. Work Out is produced for Bravo by Mentorn.
 
Fox’s Prison Break is under fire from two brothers who claim the story was originally their real life story.  The Hughes brothers were fugitives in the 1960’s.  The younger brother, at the time 16, was wrongfully accused, an accusation that was later recanted but the state decided to keep the boy in custody until his 21st birthday.  Then his brother managed to break out his younger sibling, and for the next four years the brothers were on the run from the law. Eventually in 1968, the brothers were exonerated.  In 2001 the brother agent sent a copy of their story to Fox, which was rejected by the network.  The brothers contend Prison Break is exactly their story, and have filed a copyright infringement case against the network in US District Court in Missouri, where the brothers live. The network has told the AP the network had not seen the lawsuit and therefore would not comment; the Fox studio said it does not comment on pending litigation.
 

* BROADBAND & DIGITAL *

CMT Loaded, the broadband channel of CMT, will debut a 10-week made-for-broadband series called MUZIKMAFIA TV, which will air Tuesdays on CMT.com. The series goes on the road with the MuzikMafia that consists of Big & Rich and Gretchen Wilson, plus other band members, and each short-form episode takes viewers behind the scenes from the set-up to the finale of each concert. Special guest appearances will include those by John Anderson, Willie Nelson and more.

Sundance Channel has acquired the U.S. rights to The Art of Seduction, a series of ten two-minute films about seduction from ten Canadian filmmakers. Each week the shorts will premiere on the channel as well as sundancechannel .com and on mobile via Helio. The series was purchased from marblemedia of Toronto.
 

* PRODUCTION & DEVELOPMENT *

Sundance Channel has hired Scout Productions to create and produce a 13-episode series that will feature prominently on GREEN, the channel’s weekly primetime destination that focuses on environmental topics which will debut early 2007. Change Agents (wt) will showcase designers, products and processes that are leading the green revolution, and offer tips on how people can live a greener life. In addition, Sundance has acquired the U.S. television rights to It’s Not Easy Being Green, an eight-episode half-hour documentary series from BBC Worldwide Americas. The series tracks a British family as they leave the trappings of modern life to live a totally green and self-sufficient lifestyle in a dilapidated farmhouse in the country.
 
NBC has a new project in development called Business Class, from Dutch Oven Prods with NBC Universal TV Studios, says Variety. The action revolves around two businessmen, both on a sales trip that never seems to end, living out of hotels, eating in restaurants and flying from one market to the next.

* EXECUTIVE MOVES *

Steve Koonin is the new President, Turner Entertainment Networks, where he will now oversee Turner Classic Movies (TCM) and Court TV, in addition to TBS and TNT. Steve is based in Atlanta and reports to Mark Lazarus, President, Turner Entertainment Group. Steve is charged with increasing the brands of TCM and Court TV and expanding their reach into digital, broadband and wireless.

Jamie Caring has been bumped to SVP/Talent and Music for MTV Networks International. Based in London, Jamie is responsible for the development of MTVNI’s music strategy across all brands and platforms in Africa, Asia-Pacific, Canada, Europe, Latin America, the Middle East and Russia.
 
BET announced the departure of two senior executives, Nina Henderson Moore, Head of BET News and BET Pictures as EVP/News and Public Affairs, and Michael Lewellen, SVP/Corporate Communications.  Nina, a 7-year BET veteran, has supervised a strategic restructuring of the BET News division in the last year, including BET News Briefs, BET.com Internet portal and wireless platforms, two new weekly news programs.  Michael has been with BET since 1999, joining BET from Fox Sports Net.

qubo, the new multi-platform TV network for children, has named Rick Rodriguez as President/GM and Kerry J. Hughes as SVP/Advertising Sales and Sponsorships. Both appointments are effective immediately. For now, Rick, who is responsible for managing the daily operations of the network, will be based in Los Angeles. Kerry will be based at the network’s offices in New York.

Comcast Spotlight has made some organizational changes including combining its ad sales Comcast Cable Comm division with its Northwest and Southwest division, thereby creating a new division – West. Overseeing the new division will be Rick Stanley, VP/GM of Comcast Spotlight/San Francisco. 

  • The Northeast division will be renamed North Central and will include the Houston market after the transaction with Time Warner Cable is complete.  Overseeing North Central will be John Bordeleau, who previously was VP of the southern New England area. 
  • The Mid-Atlantic division will not include the NY/NJ markets and be renamed Eastern, and will continue to be overseen by Dave Kelly.
  •  Both the Midwest and the Southeast divisions (the latter retitled as Southern) will continue to be directed by its currently leadership – Roland Trombley and Jon Ozor, respectively.

 
AOL has upped Mike Rich to VP/GM of AOL Music (aolmusic.com), AOL Radio (aolradio.com), Moviefone.com (moviefone.com) and AOL Television (aol.com/television), starting this week. Mike will supervise the programming, products and business strategies for these four entertainment websites. He will continue to be based in New York and will report to Bill Wilson, SVP/Programming.
 
Amy Introcaso-Davis has been elevated to SVP/Development and Production at Bravo. She will continue to manage programming development on both the East and West Coasts, and is currently developing a new series for the network called Better Half.
 
Sony Pictures Television International (SPTI) has promoted Kim Hatamiya to EVP/Marketing, to oversee marketing for Sony Pictures Entertainment, the division that manages all television and on-demand businesses outside the U.S. Based at the company’s headquarters in Culver City, CA, Kim reports to Michael Grindon, President, SPTI.
 
MTV Networks (MTVN) has tapped Marva Smalls to be the company’s first EVP/Global Inclusion Strategy, to spearhead MTVN’s continuous efforts to have a diverse, multicultural and inclusive workforce, and to help develop the next generation of leaders for all its brands worldwide. Marva reports to Judy McGrath, Chairman/CEO, MTVN, and will become a member of the senior strategy team. In addition, she will remain in her current position as EVP/Public Affairs and Chief of Staff for Nickelodeon/MTVN Kids & Family Group, where she reports to Cyma Zarghami, President, Nickelodeon/MTVN Kids & Family Group.

Monday – A18-49 Analysis:  NBC stayed in first place Monday night with a 4.6/12 A18-49, according to fast affiliate ratings from Nielsen Media Research. CBS came in second overall at 4.5/11, and then ABC 2.9/7, FOX 2.6/7, UNIV 1.6/4, CW 1.2/3 and TELE 0.5/1. NBC had the win at 8p with Deal or No Deal at 4.4/12; the CBS comedies How I Met Your Mother/The Class averaged a 3.3/9 in second place. At 9p, NBC led with Heroes at 6.2/15, ahead of the CBS sitcoms Two and a Half Men/Old Christine at 4.3/10. CBS secured a win at 10p with CSI: Miami at 5.9/15, and this time NBC was #2 at 3.2/8 for Studio 60 on the Sunset Strip.
