Good morning. It’s Wednesday, October 13, 2004, and this is your first early morning briefing.
CBS led the charge on Monday night on the strength of its 2-hour sitcom block, topped off by CSI Miami. For the 8-11p primetime average, CBS delivered a 5.7/14 A18-49 rating according to Nielsen Media Research. ABC was a close #2 with a 5.3/14, followed by NBC 4.3/11, Fox 2.6/7, WB 2.0/5, UPN 1.7/4. At 8pm NBC’s Fear Factor was in front with a 4.9/13. ABC preempted The Benefactor with a special 20/20 focused on the life and recent death of Christopher Reeve. That late announced special drew a 2.0/6. CBS’ newest sitcom Listen Up at 830p was #2 in the time period earning a 9 share, basically on par with last week. WB’s 7th Heaven dominated among female teens with a 5.4/17 and tied with NBC among T12-17 with a 3.0/10. UPN’s One on One/Half & Half hour scored its series best with a 1.7/5 A18-34 and 1.7/5 A18-49. At 9pm ABC’s game ran from 9p-12:18am and earned a 6.6/18 A18-49. CBS at 9pm averaged a 6.5/14 for the hour, with Raymond’s 15 share at 9p and 2-1/2 Men dipping by a share point to 14 at 930p. NBC’s Las Vegas earned a 4.8/11. WB and UPN tied at a 4 share A18-49, though WB’s Everwood pulled ahead among Teens (2.6/8 vs. 1.5/5), but they were tied again among W18-34 with a 7 share each. UPN’s newest series Second Time Around saw its season high among A18-34 (1.5/4). At 10p CBS’ CSI Miami was in front with a 7.7/19, followed by football with a 16 share, and NBC’s LAX earned a 3.1/8, but 7% vs. last week.
The story yesterday that the FCC was considering a fine of $1 million against News Corp’s Fox Broadcasting as a result of a complaints filed by the Parents Television Council as well as 158 others, about an episode of Married by America was incorrect. The fine is actually going to be higher — $1.18 million. The FCC says the April 2003 episode was offensive and indecent, and created to “pander to and titillate the audience.” The commissioners voted unanimously to fine all of the 169 Fox affiliates that aired the program $7000, which adds up to $1,183,000. Fox has 30 days to appeal.
Casting / Development / Production:
Jerry Bruckheimer, known for his drama series (Cold Case, CSI, Without a Trace) is getting into the comedy business with a sitcom deal for CBS. The pilot thus far is untitled, but it’s about adult kids and their newly single father who is a little on the eccentric side. The pilot will be written by Marsh McCall.
ABC has ordered a script for a courtroom drama based on Houston ADA Kelly Siegler, who according to Variety, was featured on CBS’ 48 Hours for her out of the ordinary courtroom style. The project comes from 20th Television and Roundtable Ent. and will be written by Gary Glasberg (Crossing Jordan).
TNT has a pilot from Spelling Television and Jorge Zamacona, and starring Gary Cole. The drama project features Cole as the head of an elite crime fighting unit based in southern California.
ABC Family recently launched two new off-net series, Gilmore Girls and Smallville, both delivering increases in the time period vs. last year’s time period averages for their first week. Gilmore Girls has averaged an 0.4 rtg among A18-34, up 300% weeknights at 5pm, increasing or holding its lead-in across the key demos. Smallville airs at 7pm with 7th Heaven as its lead-in. It has managed to hold its full lead-in in its first week, averaging a 0.5 A18-34, and increasing the male demos by triple digits. Smallville is also up 67% a year ago.

CMT OUTLAWS concert and countdown specials premiere Friday, Oct. 29. Marketing this launch, CMT will debut a highly targeted marketing campaign (in conjunction with GREAT!, Atlanta based promotion agency), perhaps one of the most targeted media campaigns ever developed, seeking to attract men to the series. CMT will use a device called the Interactive Urinal Communicator (from Wizmark), a deodorizing urinal drain filter cover which is motion-activated. When a man steps up, the communicator lights start flashing, pre-recorded female-voiced audio plays and alternating pictures are seen. The device is designed to last for 10,000 flushes.
IDT Entertainment announced that it will continue to move forward with plans to release its animated feature Yankee Irving in 2006, which was being directed by actor/director Christopher Reeve, who passed away over the weekend. Announced in December 2003, the movie is set in the 1930s and follows the story of a boy that must overcome tremendous personal obstacles.
EW Scripps has acquired the country music cable network Great American Country for $140 million in cash from Jones Media Networks Ltd. GAC is a 24/7 cable net, launched in 1996, and is available to 27 million subscribers via cable and satellite.
FCC Commissioner Michael Copps thoughts on Sinclair Broadcasting‘s plans to air an anti-John Kerry film on 62 of its stations: “This is an abuse of the public trust. And it is proof positive of media consolidation run amok when one owner can use the public airwaves to blanket the country with its political ideology — whether liberal or conservative…. This is the same corporation that refused to air Nightline’s reading of our war dead in Iraq. It is the same corporation that short-shrifts local communities and local jobs by distance-casting news and weather from hundreds of miles away…. Sinclair, and the FCC, are taking us down a dangerous road.“
