Good morning, it’s Wednesday, May 5, 2010, and this is your first early morning digital briefing.

Rep. Rick Boucher (D., Va.), Chairman of the Subcommittee on Communications, Technology, and the Internet, and Rep. Cliff Stearns (R., Fla.) released a draft of a new bill to lay down privacy guidelines governing how companies collect and utilize users’ personal information. The measure, more than a year in the making, would require full disclosure of privacy practices, outlaw the sharing of info to third parties without expressed permission and establish mechanisms within the FTC to implement and enforce the new rules. The bill stops short of requiring ad targeting systems to seek consent for basic tracking and targeting practices through the use of cookies, although “sensitive” information including medical records, financial records, government-issued data and geographic location information would require opt-in consent. 

~ MULTIPLATFORM CONTENT NEWS ~

 
Google plans to begin selling e-books early this summer to compete with Amazon, Apple and Barnes & Noble, reports the WSJ, covering a panel at an event held at Random House’s NY offices. The company says Google Editions will be viewable on any web-connected device with a catalog of 500,000 or so titles at launch. The books can be accessed through Google’s books search service or via independents retailers’ websites. Publishers will retain 63% of the revenue from the sale with Google keeping 37%. 
 
To help celebrate Mother’s Day, Hallmark Channel has set up a VWall on the “Meet My Mom” tab of its Facebook page featuring multimedia user-generated content along with content submitted by the network. Both military and civilian users are encouraged to share tributes, photos and videos of their moms. The effort is in support of the Hallmark Channel Original Movie “Meet My Mom” starring Lori Loughlin, which premieres Saturday, May 8.
 
ABC’s daytime show The View introduced a new online video interface dubbed The VIEWer’s Choice that allows users to search for clips of the show by topic. The system utilizes Gotuit‘s Video Metadata Management System to tag segments of full episodes with topics or celebrities that were discussed or to label funny moments.
 
New York City’s own NYC Media has partnered with several networks (including History, A&E, WNBC-TV and V-me), independent producers and production companies to put together a new prime-time line up for NYC life (Channel 25), premiering May 10. Each of the shows will be available on the NYC Media’s video on demand player at nyc.gov the day after they air.
 

~ INNOVATORS & START-UPS ~

 
Film critic Roger Ebert, who made digital news earlier this year when he embraced text-to-voice synthesizing technology after a bout with thyroid cancer, was named the “Webby Person of the Year” in the unveiling of the International Academy of Digital Arts and Sciences‘ 14th Annual Webby Awards. OK Go, whose treadmill video for “Here It Goes Again” has been viewed more than 50 million times, won Film & Video Artist of the Year. Best Actress went to Amy Poehler for On Network’s Smart Girls at the Party. Several artists won both Webby and People’s Voice awards, including: Jim Carrey for best celebrity site, David Lynch’s Interview Project for best documentary series and The Onion.com for best humor site. College Humor and The New York Times racked up the most awards with 5 each. This year’s winners will accept their awards June 14 at a ceremony in New York hosted by B.J. Novak from NBC’s The Office.
 
Subscription-based comedic online video card company JibJab struck a deal with Lucasfilm to include clips from the first three Star Wars films in a new UGC “Starring You” section on JibJab.com. Upload a picture yourself or your friends to place their faces within the bodies of Luke, Han Solo or Princess Leia.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
Craigslist
was issued a subpoena on Monday by Connecticut’s Attorney General to investigate whether or not the online classified ad service is doing enough to fight prostitution on its site and whether it may be profiting from it. Blumenthal, co-leading a coalition of 39 states, has monitored the site and said that he found that prostitution ads persist on craigslist’s “adult” section and elsewhere. Craigslist CEO Jim Buckmaster responded in a blog post that Blumenthal was “once again indulging in self-serving publicity” in the matter.
 
Google unveiled a plan to invest in clean and sustainable energy in the form of two wind farms. The company will put $38.3 million into two NextEra Energy Resources wind farms in the North Dakota plains.
 

~ TRENDS, RESEARCH, ETC.  ~
 

Not exactly the news the cable industry want to hear ending into The Cable Show: roughly one in eight Americans will cutback or cut the cord altogether to their cable subscriptions next year, according to a new Yankee Group study. Dubbing the new group “coax-cutters,” a new wave of consumers mostly in the 18-34 year-old range are learning to do without cable by downloading content through broadband-connected gaming consoles or Blu-ray players. But a broader group of folks are cutting back because of economic reasons.
 
There are nearly 5,000 apps available for the iPad at the Apple App Store, according to mobile research firm Distimo, with the total increasing by 32.7% during the past two weeks. The largest application category on the iPad is Games with 1,577 titles (32%), followed by Entertainment and Books with 455 and 396 titles, respectively. Of the 186,414 applications in the Apple App Store for iPhone, 73% are paid, while 80% of the 4,870 applications in the Apple App Store for iPad are paid. The ave. paid app on the iPhone costs $3.82 while the average paid iPad app is up to $4.67.

ABC has revamped its popular ABC Player iPad app (400k downloads and counting) adding improved navigation and functionality, including 3G streaming support for the newly released 3G iPad models and improved rewind and FF. The app is the first to bring full episode TV shows to the 10″ inch screen iPad and it’s a pleasure to navigate, allowing you to swipe the top-of-page viewer from side to side to scroll through the latest episodes or view thumbnails by most popular, most recent or “staff picks.” Up to 5 ad-supported episodes are available per show.
 
Nickelodeon unveiled two new apps for the iPhone and iPod touch: “SpongeBob’s Krusty Komics” is offered for free or bundled with digital comics ranging from $2.99 to $19.99 and “ParentsConnect FunOnTheRun” is a free informational app providing the best kids resources in 52 major U.S. cities.
 
Marvel Entertainment and Seattle-based Zumobi have launched an immersive iPhone app around “Iron Man 2.” Iron Man Central features the trailer, multiple clips, downloadable wallpapers and links to buy tickets or other Marvel gear.
 
Netflix disclosed that nearly 1 million Nintendo Wii users have streamed Netflix movies to their TVs using the console so far. Netflix has offered an incentive of 10% off their monthly bill to users to activate their Nintendo streaming discs.
 

~ EXECUTIVE MOVES ~

 
Tribute Broadcasting upped SVP/Programming and Entertainment Sean Compton to President of Programming, effectively immediately. He will continue to oversee programming decisions for WGN America and the company’s 23 broadcast television stations.
 
Current Media named former MTV executive Courtney Menzel as EVP/Distribution. Courtney is charged with overseeing the network’s affiliate sales and marketing as well as expanding Current’s reach. She will be based in Current’s New York office, reporting to COO report to Joanna Drake Earl.
 
Simulmedia tapped John Piccone for the newly-created position of VP/Sales. He will be based in Simulmedia’s Manhattan headquarters and report to Chief Revenue Officer Jon Werther.
 
Josh Abrams has been named VP/Sales at the online sports publisher Bleacher Report. Josh will supervise Bleacher Report’s advertising sales from the company’s newly-opened New York City offices.
 
Online real estate company Move, Inc. hired Dan Mohler as VP/Advertising Sales. He will be based out of Move’s Westlake Village, CA offices and report to Tricia Smith, VP/Consumer Media.
 
BUZZMEDIA
named a quartet of new Ad executives: Aisling McDonagh joins as Senior Sales Director; Todd Dufour comes onboard as Head of Influencer Marketing & Talent Relations and Judith Heimowitz and Mary Michael Marlo both join as Directors of Integrated Marketing.  Aisling and Judith are based out of BUZZMEDIA’s New York offices while Mary and Todd are located at the company’s Los Angeles’ headquarters.

Cloud-based iTV solutions provider ActiveVideo Networks has acquired TAG Networks, operator of the interactive TAG-TV platform that allows cable subscribers to play casual games through a standard digital remote. (Click on “Web Games” at the top of screen to try out some of the games on the platform – many, but not all, require Internet Explorer on a PC.) The deal extends ActiveVideo’s CloudTV development platform to the fast growing gaming vertical, one of the most successful in early deployments in terms of user engagement. Sourcing TNS set-top data, TAG says that Time Warner Cable Oceanic subs in Hawaii averaged 116.5 minutes/day with the channel in 2009. And gaming is the killer app when it comes to attracting non-geeks to interactive television. For instance, more women play games than men on just about every platform besides the Xbox 360 and the PlayStation, according to a recent casual gaming study conducted by Lifetime.
