Good morning, it’s Wednesday, March 14, 2007 and this is your first early morning briefing.

The other shoe dropped yesterday as Viacom has filed a lawsuit against YouTube and Google in the U.S. District Court for the Southern District of New York, seeking more than $1 billion in damages. Viacom cited “massive intentional copyright infringement of Viacom’s entertainment properties” and further contends YouTube has profited from selling advertising on its video-sharing site because consumers are drawn to Viacom’s content. Just last month, Viacom demanded YouTube delete more than 100,000 unauthorized video clips from its site after distribution talks failed between the two companies. However, that number apparently has risen as Viacom speculates that there are currently around 160,000 unauthorized Viacom entertainment clips on YouTube that have been viewed 1.5 billion times. The lawsuit also charges YouTube with limiting its search results to 1,000 clips which hinders copyright owners from uncovering possible infringement.

FCC Chairman Kevin Martin submitted a new 30% limit cap to his colleagues Monday night that would prohibit a cable operator from serving more than 30% of pay television subscribers. The largest cable company in the U.S., Comcast, opposes this idea and wants ownership limits to be removed. Additionally, according to Kagan Research, Comcast currently serves 26.2 million subscribers or 27% of the total 96.8 million pay TV subscribers nationwide, and under this proposed new rule, the company would soon have to turn away new customers. It is not expected the FCC will vote on this cable-ownership ruling at the next public meeting on March 22. In 2001, a panel of the U.S. Court of Appeals for the D.C. Circuit voided a 30% subscriber limit, citing it as inconsistent with cable’s First Amendment protections. The court then told the FCC to come up with a new set of rules, and Martin is hoping to gain support from his fellow commissioners and re-energize the issue with this new proposal.
 
CBS Corporation
and its Board of Directors have revised the compensation package for Sumner Redstone, Executive Chairman which is similar to his recently-revamped compensation agreement with Viacom, Inc. where he also serves as Executive Chairman. In the new CBS deal, Sumner’s overall compensation will pivot on the performance of CBS Corporation’s stock and shareholder returns and less on cash salary and bonuses. Starting this year, Sumner’s salary will be decreased from $1.75 million per year to $1 million and the deferred compensation portion, currently $1.3 million per year, has been abolished. His cash bonus, under CBS’ short-term incentive plan, will decrease from $6.1 million to $3.5 million annually. Furthermore, Sumner will receive stock options with a grant-date value of $3 million in addition to annual performance share units with a target value of $3 million.  
 
Joining the ABC schedule as of May 18 at 9p for a total of six one-hour episodes is a new primetime game – National Bingo Night, created and executive produced by Andrew Glassman, and with host Ed Flanders.  With viewer interactivity being the big buzzword these days, at home players can print out the bingo card from parallel site at ABC.com (a different card than the in-studio contestant), and win prizes, which are redeemed online as well.  Each episode will play thru three bingo cards.

For the week of March 5-9, ABC’s World News Tonight with Charles Gibson ranked #1 among A25-54, the key news-watching demo. This marks the fifth week out of six ABC has bested the competition in demo ratings. ABC’s evening news had a 2.3/9 A25-54 and 8.9 million total viewers, while NBC’s Nightly News with Brian Williams had a 2.1/9 among A25-54, tho NBC led in the total viewer race with and 9.0 million viewers; and CBS’ Evening News with Katie Couric had a 1.8/7 A25-54 and 7.0 million total viewers.
 
Riches kicked off on FX Monday night with 3.8 million viewers in tow and averaging a 2.5 A18-49 rating at 10p, according to Nielsen Media Research.  That total viewership number was more than twice the delivery of FX’s best Monday night 10-11p ever.  The repeat premiere at 11:10p delivered 1.4 million viewers, with 800,000 in the demo range.   If you missed it, FX plans to rerun the premiere this weekend – check your local listings.

BET unites fashion design with hip-hop and R&B music in its series Rip the Runway premiering tonight at 10p. Hosted by Chris Brown and Ciara, the hour-long show is back for a third season directed by hip-hop and R&B video producer Chris Robinson, along with new backstage fashion correspondent June Ambrose.
 
National Geographic Channel has resumed its series The Final Report delving into recent headline news stories that resulted in a lot of media and public attention. The series actually began this week on Tuesday night, but will return again on March 27 at 10p with a look at the Bombing over Lockerbie, Scotland. Three more episodes follow on April 3 and 10 and on May 1. The Final Report is produced by Towers Productions, Inc.
 
Univision will debut Nuestra Belleza Latina (Our Latin Beauty) on March 27 at 10p as its newest reality show and beauty contest. Univision personality Giselle Blondet hosts and is joined by a panel of judges including Venezuela’s Alicia Machado (former Miss Universe) and Latin America’s Osmel Sosa (beauty coach).  The contestants are competing for the title, a contract as one of Univision’s on-air personalities, and a chance to win more than $200,000 in cash and prizes.
 
Beginning this week, HGTV viewers will see a new branding campaign that introduces a new network tagline “Make Life _________. Start at Home.” The spots will feature many of HGTV’s stars, such as Clive Pearse to Eric Stromer and the blank will be filled in with various HGTV lifestyle focus words like Make Life Colorful or Stylish. The campaign was conceptualized and executed by Crossroads Television and Headlight Design and the spots were filmed at Silvercup Studios East in Long Island City, NY.

TBS announces its new primetime and late-night comedy originals slate for the 2007-2008 season:
Primetime comedy series in production:

  • The Bill Engvall Show – half-hour scripted series set to premiere this summer starring Bill Engvall as a family counselor who should concentrate on his own family’s problems. Nancy Travis also stars as his wife Susan. Produced by TBS with Welladay, Inc. and Parallel Entertainment.

Primetime comedy series in development:

  • Uncommon Sense – half-hour scripted series with stand-up comedian/actor Larry Miller as a dad, husband and newspaper columnist. Produced by Sony Pictures Television.
  • Big Shot – half-hour scripted series about a teen living at home with his parents who also happens to be an NBA rookie. Jamie Foxx and Kenny Smith, along with Adrienne Lopez and Marcus King are all executive producers.
  • Untitled Dave Caplan Project – half-hour scripted series centers on a woman, who despite having numerous challenging events happen in her life, maintains a great sense of humor. From Sony Pictures Television and Original Films.

Late-Night comedy series in development:

  • Bob Newhart: In Search of Comedy – half-hour series anthology with Bob Newhart as host and executive producer.
  • Untitled Jenny Hunter Project – associate producer of The Daily Show and executive producer of the series Man Bites Dog will develop and write this new sketch comedy.

TBS will also return to its schedule My Boys this summer, in addition to the late-night originals 10 Items or Less and The Frank Show.
 
TNT has also unveiled its original drama programming line-up for the upcoming season:
Drama series in production:

  • Heartland – one-hour series premieres in June starring Treat Williams and Kari Matchett as a recently divorced couple who both work in the organ donor world – she as a organ-recovery coordinator and he as an organ-transplant surgeon. From Warner Bros. Television.
  • Saving Grace – one-hour series set to premiere this July features Holly Hunter as a hard-edged police detective living in Oklahoma City. She meets up with an angel who helps her find the right path. Produced by Fox Television Studios.
  • The Company – a limited one-hour, six-part series debuting in August with Chris O’Donnell, Alfred Molina and Michael Keaton that looks at the CIA’s activities during the Cold War, based on The New York Times bestselling novel by Robert Littell.

Drama series in development:

  • The Talisman – six-hour limited series scheduled for summer 2008; a new project from DreamWorks Television and executive producer Steven Spielberg, based on the Stephen King and Peter Straub novel of the same title.
  • Untitled Steven Bochco Project – one-hour series centering on young lawyers who have been friends and now find themselves opposing each other in the courtroom. Bochco will executive produce this series from ABC TV Studios and Stephen Bochco Productions.
  • Mrs. America – one hour series about a woman trying to manage family and career. From the executive producing team on The Closer and from Warner Horizon Television.
  • Leverage – one hour series about modern-day Robin Hoods who protect the innocent from the underworld, international corporations and even government officials. Produced by Electric Entertainment.
  • The Saint – one hour series based on the 1960s classic character – international thief Simon Templar (AKA The Saint). From executive producer William J. McDonald and producer Jorge Zamacona.
  • A.D. (wt) – one hour family drama series developed by filmmakers Angelo Pizzo and David Anspaugh.

In addition, TNT will debut the third season of The Closer in June with the premiere episode sponsored by Toyota and presented commercial free.
 
Turner Entertainment Networks rounded out its programming announcements with new programming highlights from Court TV. First, and probably it’s biggest news, Court TV will be rebranded with a new name, look and logo on January 1, 2008.  Marc Juris, presenting Court TV’s upfront, gave no specific hints as to the new name.  Here’s what we do know –
New series in production:

  • Beach Patrol: Hawaii – set to premiere this summer; Court TV brings back the Beach Patrol franchise this time centering on the Honolulu Ocean Safety and Lifeguard Services team.
  • Bounty Girls – scheduled to debut in 2007 about the squad of female bounty hunters who use their smarts and good looks to track down criminals.
  • The Real Hustle – featuring three expert scam artists who take on unsuspecting New Yorkers.
  • Most Daring – relates edge-of-the-seat stories of daring rescue missions.
  • Tiger Team – follows elite security pros who consult with top corporations and governments.
  • The Room – allows viewers to witness real-life cops interrogate real suspects.

Court TV will also have a new daytime programming block that begins at 9a with courtroom coverage then moves into a two-hour block that includes Nancy Grace: Closing Arguments at 3p and the recently announced new series with Star Jones Reynolds.

~ PRODUCTION & DEVELOPMENT ~

Casting Call: Producers of ABC’s American Inventor are on a nationwide hunt to find the next great inventor during open casting calls in multiple cities. Individuals or teams can show up at the auditions and you need only a sketch or prototype of your invention. However, the invention should be something that can be mass produced and sold in a retail outlet. Critiqued by a panel of judges and selected through viewer call-ins, the grand prize winner will receive $50,000 in seed money to further develop the product for the semifinal round. The casting calls will be held in LA, San Francisco, Chicago, NY and Orlando. For times and locations and everything else you need to know, go to www.AmericanInventor.tv. The second season of American Inventor will debut June 6 at 9p with six episodes on ABC.

~ BROADBAND & DIGITAL ~

On Monday, March 19, 2007, Cynopsis will launch a new daily edition – Cyn opsis: Digital .  The edition will focus on the business of digital and broadband as it relates to the television industry and beyond.  It’s for anyone interested in how digital is rapidly becoming a major force in our industry – and even for those who believe digital is something of a phase and will never fully materialize to compete with linear television.  Any items you’ve become accustomed to seeing in this section of Cynopsis, will now be in Cyn Digital, as well as plenty of other news from the digital arena.  This new daily will be written by Wayne Karrfalt, Editor of Cyn opsis: Digital , who can be reached at [email protected] .    In the meantime, here’s a small bit of the Broadband & Digital news for today ….

Bravo made its first online acquisition, acquiring televisionwithoutpity.com to go with its stable of TV related sites, such as BravoTV.com, BrilliantButCancelled.com, Outzone.com and GetTRIO.com. The site is famous for snarky criticism of shows and a love/hate relationship with the medium, which Bravo executives promise not to impede. With one million unique users and 30 million total page views, the site will double Bravo’s aggregate online traffic. Co-founders Tara Ariano and Sarah Bunting will stay on as editors.

Walt Disney Internet Group is planning to launch a new site www.family.com later this week geared as a resource for Moms. Disney surveyed some 30,000 moms last year to find out what they wanted from an online Disney-branded destination and worked to deliver:

  • opinion pieces from an advisory board of “mommy bloggers”
  • community tools to help form groups around shared interests
  • a group of screened, family-friendly links called “the Family 1,000”

The blogs and threads on the site will monitored closely to watch for foul language and inappropriate remarks. The site will remain in beta through the summer and is part of a comprehensive redesign of Disney.com.
 
As part of the Turner Entertainment Networks Upfront presentations yesterday, Turner is promising extensive broadband content to complement new series, movies and specials. As part of a major branding initiative Court TV will utilize its site www.smokinggun.com to brand a series of quarterly specials about criminals caught in the act. The first special The Smoking Gun Presents: The Dumbest Criminals in the World will count down the 20 dumbest criminals along with their dumbest crimes. Turner also promoted its ad supported broadband comedy network superdeluxe .com, which attracted more than one million unique users during its first month of operation.
 
Online video technology provider vMix Media launched a new NBC channel featuring promo clips of Heroes and 30 Rock. Vmix.com, whose tagline is “creative is sexy,” posts content and offers tools for media companies that encourages users to send messages and leave comments about the clips. It has also signed deals with Tribune’s interactive division to offer tools to 50 of its newspaper and local station sites. Twentieth Century Fox Home Entertainment is also a partner.

~ EXECUTIVE MOVES ~

The Salt Lake City agencies, W Communications, that focused on advertising and marketing and Struck Design, the digital and design firm have merged to form STRUCK, a creative marketing shop. As a result of the merger, the new executive team will consist of Jason Bangerter as President/CEO; Steve Driggs has been tapped from Fallon Worldwide in Minneapolis to be Executive Creative Director; and Ryan Goodwin as Executive Design Director.

Peter Gassiraro has joined the worldwide brand strategy and design agency, Enterprise IG as Group Account Director, reporting to Carol Parish, Managing Director/Brand Strategy and Engagement. Peter will spearhead strategy and interactive projects for the firm’s clients that include Hewlett-Packard and American Express.

Starting March 19, Sean Hennessey will be a new General Assignment Reporter at WCBS/New York. Previously, Sean was a general assignment reporter at WHDH/Boston since 1996.

E! Networks has advanced Julie Nemeth to VP/Production Services, E! and Style. In addition to her current studio and field operations and post production duties, Julie will now supervise production services for G4 when the network moves its production to the Comcast Entertainment Group headquarters. Furthermore, E! Networks has upped Joanne Bornstein to VP/Production Management, E! and Style. Along with her production management role for E! Studios, Joanne will handle production management for all internal productions on behalf of G4.

Donna Ebbs has been elevated in her position to VP/Movies and Specials at ABC Family. She will now develop and produce specials and other alternative programming for the network and will report to Kate Juergens, SVP/Original Series Programming and Development. Donna most recently supervised production on ABC Family’s holiday movie Santa Baby which debuted last December.

Tennis Channel has made several key moves within its senior management team:

  • Victoria Quoss has been appointed EVP/Programming and Network Strategy to manage all programming and network strategy across all platforms. She comes to the network from Versus where she was VP/International and Strategic Planning.  Atta girl, Victoria!
  • Robyn Miller has been hired as SVP/Marketing to head all consumer branding, creative services and affiliate and advertising sales marketing. She joins the network from the Walt Disney Company. Both Victoria and Robyn will report to Ken Solomon, Chairman/CEO.
  • Bill Simon will continue in his role as CFO and will add EVP/Business Operations to his title. With this expanded role, Bill will develop corporate strategy as well as provide oversight to all finance, accounting, human resources, technical operations, information technology, facilities, administration and business and legal affairs.
  • Larry Meyers has been upgraded to SVP/Production and Executive Producer and is in charge of all original programming for the Tennis Channel. Both Bill and Larry will continue to report to Ken Solomon.

MONDAY – A18-49 Analysis: FOX and NBC went head-to-head Monday night with each claiming #1 at 4.0/11 A18-49, according to fast affiliate ratings from Nielsen Media Research. CBS was second at 3.7/10, and next was ABC 2.6/7, UNIV 1.7/5, CW 0.8/2 and TELE 0.5/1. NBC socked a one-two punch with a two-hour Deal or No Deal that came in first at 8p with 4.3/13 and again at 9p with 5.1/13. FOX was second both hours with a House rerun delivering a 3.5/10 at 8p and 24 bringing in a 4.5/11 during 9p. CBS then zipped past both networks to win at 10p with an encore of CSI: Miami at 4.2/11.
