After announcing Monday afternoon that the 5p deadline to come to an agreement over retransmission fees would be extended until 8p, the extensions continued until midnight, with CBS and Time Warner Cable still not coming to terms. At around 12:30, after a brief blackout, TWC announced that “at the request of CBS, we have halted going dark on their channels,” and a new deadline was set for Friday, August 2 at 5p. TWC calls CBS’s demands for rate hikes “out of line and unfair,” while CBS accuses the cable company of using “voodoo mathematics.” It’s a confusing game of chicken, BTIG analyst Richard Greenfield tells Cynopsis: “The question is, who blinked, and why. Time Warner’s leverage goes down as the days tick closer to football season, so why give in, unless CBS never expected to go dark and changed their demands? It’s not clear yet what happened.”
NBC has finished its upfront with an increase in ad commitments, reports Variety, selling about 80% of its inventory, up from last year, and securing CPM increases of between 7% and 8%. Of particular interest to advertisers, says the mag’s source, were new Thursday sitcom The Michael J. Fox Show, and Monday drama The Blacklist.
After pleading guilty last week for his part in a high-stakes gambling business, Ray Donovan exec producer Bryan Zuriff is taking a break from the Showtime drama. “Out of respect for my colleagues at the network and everyone involved with the show,” Zuriff said in a statement, “I’m voluntarily taking a leave of absence so that the resolution of my personal legal matters won’t distract from the audience’s great response to the program.”
The Soup goes live: To celebrate its 500th episode and nearly a decade of pop culture commentator Joel McHale, E! will air live shows on Wednesday, August 21 at 10p ET and 10p PT. Eps will also stream on Eonline and TheSoupTV.com.
With numerous Academy Awards shows and Super Bowl Halftime performances under his belt, veteran live awards show producer Don Mischer is heading to China to revamp the vote-based Huading Awards honoring Chinese talent in sports and entertainment. “Most television has become kind of bottom-line business,” Mischer told the Wall Street Journal. “Now I have an opportunity to work on a project I can take real pride in.”
Viacom isn’t giving up the fight. Seven years into its expensive court battle with YouTube over alleged copyright infringement, the company is asking for a third chance for its day in court – and a new judge. The case has been dismissed twice on summary judgment, the last time in April when District Judge Louis Stanton said Viacom lacked proof that YouTube had awareness of infringement. In its papers, Viacom says, “This court should exercise its discretion to remand the case to a different judge ‘to preserve the appearance of justice.'”
Discovery Communications (owner of cablers Discovery Network, TLC and Investigation Discovery) may have missed analysts’ predictions on its earnings report, but CEO David Zaslav had good news in a conference call with investors. Ad revenue is coming in better than expected ($426 million for the quarter, beating analysts’ projections), Animal Planet‘s ratings have improved, and struggling OWN: The Oprah Winfrey Network, in which Discovery is partnered with Harpo Productions, has turned a corner and “is now cash-flow positive,” said the exec. “There’s very positive momentum and we’re looking forward to second half numbers.” Discovery claimed a second-quarter profit of $300 million on revenue of almost $1.5 billion, a 30% increase compared to the same period a year ago.
Catching Fire: A&E‘s apps for its History and Lifetime nets are closer to being everywhere, now that they’re available on Kindle Fire HD. The apps let users sample episodes and movies, with access to more content if they sign into TV or satellite providers. “We’re extremely proud to be one of the first network groups to launch TV Everywhere apps for the Kindle Fire HD,” Dan Suratt, evp digital media and business development for A&E Networks, tells Cynopsis. “Even more fans will be exposed to our great content, while at the same time attracting increased viewers on the linear side.”
The National Cable and Telecommunications Assn. and the Motion Picture Assn. say they will be part of the conversation regarding the Senate Commerce Committee’s violence research bill, but point out they’re already committed to parental control tools. “In recent months, we have launched new tools that provide guidance for families on TV and film ratings,” said the groups in a joint statement. “We’re also using new public service announcements airing nationwide.” The bill calls for a study on the impact of violent video games and violent video programming on children.
President Obama’s nominee to chair the FCC, Tom Wheeler, was approved by the Senate Commerce Committee on Tuesday. If confirmed, Wheeler would replace acting chair Mignon Clyburn.
CW president Mark Pedowitz told reporters at the TCA that there will some changes in the new season of Beauty and the Beast and they won’t be pretty. “We’ve re-crafted what the beast looks like,” teased Pedowitz of the doctor who turns into a monster when he’s enraged. Season two premieres Monday, October 7 at 9p.
MTV2 is getting an early start to the VMAs with five eps of Charlamagne and Friends leading up the music video awards show. Guy Code‘s Charlamagne the God will offer “unfiltered opinions on the biggest music and pop culture moments of the week,” promises the net. Show debuts Tuesday, August 20 at midnight, and runs every night through Saturday, August 24. VMAs air August 25 at 9p.
Just 7% of TV homes in the U.S. rely only on over-the-air signals for programming, according to the results of a Consumer Electronics Association survey of 1009 adults – a number down 1% from a 2010 study.

Characters for a spin-off of CW drama Supernatural will be introduced in an episode of the show’s season nine next spring. The ep will serve as a pilot for the new show, about hunters and monsters in Chicago. CW president Mark Pedowitz also revealed at the TCA that the net is developing Flash, based on the DC comics character, to be introduced via superhero drama Arrow. “We do want to expand upon the DC universe,” said Pedowitz. “We think they’re rich characters we can use, and this is an organic way of doing it.”
Dexter may be hurtling toward the end of its eighth and final season on Showtime, but showrunner Scott Buck isn’t going anywhere. The pay cabler announced at the TCA that Buck has signed a deal to develop new projects, “to keep him in the family,” said Showtime entertainment president David Nevins.
In a deal with AMC, Southland vet Jonathan Lisco will showrun the net’s upcoming Halt & Catch Fire, and develop original projects. Lisco “has a unique perspective on characters that is really in line with ours,” said Susie Fitzgerald, senior vp of scripted development.
Justin Long will be crushing on Anna Faris on new CBS sitcom Mom this fall. Faris plays Christy, a recovering alcoholic single mom. Octavia Spencer and Allison Janney also star; show debuts Monday, September 23 at 9p.

Jennifer Jason Leigh and former Fringe star Anna Torv have been cast in HBO pilot Open, a Fox 21 project from Ryan Murphy about sex and relationships.
Starz and Twentieth Century Fox Television Distribution have entered into a multi-year licensing agreement for hundreds of Fox movies to air on Starz and Encore and their authenticated online offerings. “This agreement with Fox will fortify our pipeline of popular theatrical library content through the end of the decade,” said Michael Thornton, exec vp, acquisitions, business and legal affairs, “and is a great complement to our exclusive originals, first-run movies and other popular movie fare.”
Scripps Networks Interactive will serve up food and lifestyle content from Food Network and Travel Channel to the U.K., in a deal with Amazon streaming service LoveFilm. Shows will include the likes of Barefoot Contessa, House Hunters International and Restaurant: Impossible.

Heartbreak and tears for The Bachelorette must have led to big smiles over at ABC. Desiree was left sobbing on a dock in Antigua on Monday’s episode after suitor Brooks admitted he just wasn’t feeling it for her, and part 1 of the dating competition’s finale pulled in 7.8 million total viewers, the season high and up 20% week to week. The cliffhanger ending (Will Brooks return? Will Des give up on love, or pick another eager contestant?) bodes well for the finale of the finale.
Hallmark emerged as the top cable network on prime time on Saturday, July 27, thanks to strong performances from new series Cedar Cove and original movie Second Chances. Cove averaged 2.4 million total viewers, while Chance’s debut delivered 2.8 million total viewers.
Sharknado is the gift that keeps on giving for Syfy. In its third airing on Saturday, July 27, it attracted 2.1 million total viewers, making it the most-watched original movie encore in the net’s history. “Sharknado is a classic example of incredible buzz feeding growing viewer interest,” Syfy’s Thomas Vitale, exec vp of programming and original movies, tells Cynopsis. Was the net surprised by the viewer response? “We knew it would be a fun, outrageous movie that a broad audience would like,” Vitale says, “but nobody could’ve predicted it would be a worldwide juggernaut.”
ABC ended NBC‘s 243-week winning streak when World News with Diane Sawyer beat NBC Nightly News With Brian Williams in A25-54 during the week of July 22. “We’re just getting started,” said exec producer Michael Corn.

At 7p, CBS’s 60 Minutes led with 1.0/4, followed by ABC’s America’s Funniest Home videos with .8/3. At 8p the 2.3/7 Big Brother scored for CBS slipped past the first hour’s 2.0/6 for Univision’s Amores Verdaderos, but the Uni soap’s second hour came out on top at 9p, with a 2.2/6 against a pair of eps of FOX’s Family Guy (1.6/5). Actress Eileen Brennan passed away on Sunday, July 28 of bladder cancer. Brennan’s portrayal of drill captain Doreen Lewis in Private Benjamin earned her an Academy Award nomination in 1981; she won an Emmy and a Golden Globe for the TV adaptation. The respected actress with a gift for comedy also won acclaim for roles in films including 1971’s The Last Picture Show, 1974’s The Sting and 1985’s Clue. Brennan was 80.
