NCC Media and DISH have inked a landmark agreement that expands on the cable industry’s I+ initiative, which links cable, satellite and telco companies’ ad inventory to make it easier for media planners to reach more homes on local media. The arrangement brings DISH to the local ad market for the first time; its newly-developed targeted ad system “will be integrated with existing local market cable advertising platforms, greatly increasing an ad campaign’s coverage,” said the companies in a statement. “By gaining access to the country’s third-largest pay-TV provider’s customers, local and national spot TV advertisers can now speak with millions of consumers who were simply not accessible before,” said Warren Schlichting, Senior VP, Ad Sales at DISH.

~ MORE GOOD STUFF ~

Music producer Dr. Luke (aka Lukasz Gottwald) won’t be taking a seat on Fox’s American Idol judging panel after all. The hitmaker (Since U Been Gone, I Kissed a Girl) decided the job on the Fox singing competition would take too much time away from his producing duties, according to the Hollywood Reporter. Also complicating matters: Luke has a deal with Sony Music, but the Idol gig would have had him furthering the careers of talent that would be signed to rival Universal Music Group, which holds the rights to American Idol recordings.

Lawyers for Fox and Aereo were prepared for battle in California on Tuesday. After New York judges failed to (so far) shut down the online streaming service that the nets contend retransmits content it doesn’t own and charges a fee for, Fox will attempt to uphold its victory in LA, where a federal judge closed a similar service, FilmOn X. As the companies behind CBS, NBC, ABC and Fox pursue copyright litigation, Dennis Wharton, spokesman for the National Association of Broadcasters, tells AdAge, “This case has united the broadcast industry like no other.” A hearing is set for September 20th.

The FCC insists it’s trying to get CBS back on the air for Time Warner Cable‘s three million plus subscribers. Acting chairwoman Mignon Clyburn said in a statement that the FCC is “engaged at the highest levels with the respective parties and working to bring the impasse to an end.” A dispute over retransmission fees has left CBS stations, plus cable stations Showtime and Smithsonian, dark in New York, Los Angeles and Dallas since August 2.

Yahoo! is launching eight short-form comedy series, with plans to use its 5,000 Saturday Night Live clips as bait to lure viewers into sampling them. Following Netflix‘s binge-viewing model, Yahoo! will offer most of the eps at once. “We are working hard to drive traffic and video views and will make this a primary area of investment over the next year,” said Yahoo! CEO Marissa Mayer in a July earnings call. “We think there’s room for lots of players and video really comes down to the question of the content.”

A new Cooking Channel show turned to YouTube to find breakout chefs – a strategy that could be a recipe for ratings. Food Fanatics with Eden Grinshpan host Eden Grinshpan tells Cynopsis, “We go online to see what people are talking about, to scout out what’s cool, and we find the most incredible personalities,” like online sensation Vegan Black Metal Chef. “He’s dressed in head to toe Goth and we thought, we need to know his story.” Series premieres Friday, September 13 at 10:30p.

Miley Cyrus‘s raunchy VMA performance on the MTV awards show Sunday night drew harsh criticism in many quarters  the Parents Television Council said in a statement blasting the show, “How is this image of former child star Miley Cyrus appropriate for 14-year-olds?” – but it’s reaping rewards, too. Cyrus’s medley with Robin Thicke drew 306,100 tweets per minute (“I was not expecting her to be putting her butt that close to my son,” said Thicke’s mother, actress Gloria Loring), and she has two songs in the top five on the iTunes music chart.  

Accused by the Writers Guild of America of blocking unionization, NBCUniversal‘s nonfiction program producer Peacock Productions  which the union alleges impounded votes from a June ballot – insists it’s done nothing wrong. The guild sent a letter Monday to NBCUni Pres Steve Burke pressing its case, saying nonfiction programming relies on “low wages, smaller crews and longer work schedules by freelance employees with no health care,” and wants the votes tallied. The net contends Peacock producers’ supervisory authority makes them ineligible for unionizing, and therefore their votes shouldn’t count. “As is part of the normal process, the votes were impounded by the [National Labor Relations Board] until a decision is made,” Peacock said in a statement to TheWrap. “We are still waiting for the NLRB to render their decision, which is why no votes have been counted.”

In a sure sign Twitter‘s serious about amping up its e-commerce activity, the social site has hired Nathan Hubbard, former president of Ticketmaster, as its first head of commerce. By offering retailers opportunities to sell products within tweets, Twitter could collect online shopping data valuable to advertisers, as well as extend the user experience. Hubbard told Bloomberg News he’s looking to partner with companies, possibly taking a percentage of transactions on the site. “We’re going to people who have stuff to sell,” said Hubbard, “and help them use Twitter to sell it more effectively.”

Apple TV is expanding with new Watch Disney and Watch Disney XD apps, providing live feeds and on-demand content from the nets. Apple TV viewers will also be able to access info via a new app from The Weather Channel; there’s an app for Smithsonian as well. The latter two are free, but Disney viewing will require a pay-TV subscription with a provider that has a deal with Disney.

American Horror Story: Coven returns for season three on Wednesday, October 9 at 10p. The date was revealed on a teaser for the FX anthology series.

Joshua Jackson has been cast in Showtime pilot The Affair, about two marriages rocked by infidelity. He joins Dominic West, Maura Tierney and Ruth Wilson.

Siena Goines (Criminal Minds) has been cast in Lorne Michaels‘ untitled comedy project for HBO, about reporters in Atlanta. The pilot starts shooting in September.

~ EMMY Q & A ~

Amazing Race has won the Outstanding Reality-Competition Program every year but one since 2003 (Top Chef took the trophy in 2010), but creator, with Elise Doganieri, and exec producer Bertram van Munster takes nothing for granted. As the reality show readies for its 23rd cycle premiere on Sunday September 29 at 8p, Munster faces the prospect of another anxious Emmy night.

~ INTERNATIONAL HAPPENINGS ~

U.K. regulator Ofcom has commissioned a study about TV violence, warning nets to limit onscreen mayhem during the hours viewers under the age of 18 likely to watch. “Broadcasters should consider whether individual acts of violence within a program are suitable, as well as where the overall tone is malevolent, menacing and threatening,” said the regulator. The announcement of the study comes after Ofcam ruled that a March scene on Channel 4 soap Hollyoaks, in which a character was kicked to death in front of a train, was excessively violent for the time period.

~ RATINGS ~

August was the OWN: Oprah Winfrey Network‘s highest-rated primetime month in the net’s two-and-a-half year history, growing 23 percent in total viewers and 26 percent W25-54. Erik Logan, president, OWN and Harpo Studios, tells Cynopsis, “We feel this is just the beginning. We’ve focused on building night by night. Sunday was our tentpole night, and then we saw what was happening Saturdays, first with Welcome to Sweetie Pie’s [10p] and then Iyanla: Fix My Life [9p]. That was a breakout hit – Oprah went all in on that. Small successes built on each other, and now we’re focusing on scripted drama on Tuesdays.” So far, so good – The Haves and the Have Nots (9p) scored its best rating so far on August 20 with 1.76 W25-54.

What blackout? CBS‘s Under the Dome delivered a winning 10.8 million viewers on Monday night and dominated A18-49 with a 2.5/7 rating, per preliminary numbers, despite the retrans dispute that’s blocked 3.2 million Time Warner Cable subscribers from the net’s programming. That’s up from a 2.4 rating the prior two weeks.

A move to 9p – out of the shadow of Under The Dome at 10p – gave Mistresses a boost. Fast affiliate ratings had the ABC show growing 6 percent over prior week (3.4 million vs. 3.2 million), and 11 percent  A18-49 (1.0/3 from .9/3). Even with tough competition, the first-year frothy drama has delivered a decidedly upscale audience season to date, with 48 percent higher numbers with A18-49 in homes earning $150k+.

People must like what Kelly Ripa and Michael Strahan have been saying. During the week of August 12, LIVE with Kelly and Michael was the top syndicated talker in households, total viewers and W25-54. With a 2.5 rating, the show dipped 4 percent from last week but versus the year-ago week was up 27 percent in total viewers and 50 percent W25-54. Strahan joined the show last September, after a 10-month string of guest hosts filled in for the “moving on” Regis Philbin.

ABC Family‘s Pretty Little Liars had another scorching summer, ranking as TV’s top series among females 12-34 (2.22 million/4.9 rating) and teens 12-17 (943,000/3.9 rating). Not surprisingly given the demo, the teen drama filled with twists and turns accounts for the top four most-tweeted series episodes; its June 12 premiere drew 1.3 million tweets.

Monday A18-49 Analysis: CBS won the most A18-49 viewers with 1.7/5, according to final primetime national ratings from Nielsen. Univision’s Porque el Amor Manda and NBC’s American Ninja Warrior tied to top the 8p hour with 1.7/5. The 1.6/4 Univision earned for Tempestad put it in the lead at 9p, besting CBS’s sitcom set 2 Broke Girls (1.4/4) and Mike & Molly (1.5/4). But CBS powerhouse Under the Dome dominated at 10p, with 2.5/7 versus Uni’s 1.3/4 for Que Bonito Amor.

Sunday A18-49 Analysis: NBC grabbed the most A18-49 viewers with 2.1/7, according to final primetime national ratings from Nielsen. At 7p, FOX earned 1.3/4 with The Simpsons while ABC and CBS tied for second, posting 1.1/4 for America’s Funniest Home Videos and 60 Minutes. NBC’s football game scored 2.7/8 at 8p, holding Big Brother to second place with 2.5/7. The NBC game dominated the 9p hour, its 2.7/8 besting the 1.3/3 for a set of FOX Family Guys. ~ EXECUTIVE MOVES ~

Robert Gottlieb has been upped from Senior VP and head of marketing to Exec VP of marketing for Fox Sports. Gottlieb has been with the net since 2004.

WGN America and Tribune Studios are forging ahead with original programming with the hire of Tom Huffman as Senior VP, Unscripted Programming. Huffman, who starts in October, comes from VH1, where he was VP of Development and Production.

Joonas Hytonen has been named CEO of TV Production for Banijay Finland, one of Scandinavia’s largest TV companies. He replaces Petteri Ahomnaa.

Global media investment firm GroupM named Pierre Conte its new CEO. He replaces Bruno Kemoun and Eryk Rebbouh, who will continue with the company as consultants.

David Ford will join Fusion, the new net from ABC and Univision, in mid-September as VP for Corporate Communications. He comes from the PR team at ABC News.

~ IN MEMORIAM ~

Bruce Dunning, the CBS News correspondent who reported “the last flight from Da Nang,” died from injuries suffered in a fall on August 26. He was 73. Dunning spent most of his career in the Far East, rising to CBS News Asia Bureau Chief in 1989. He is best-remembered for his riveting report during the chaotic 1975 attempt to rescue refugees in South Vietnam.
