~ MORE GOOD STUFF ~

Late last week, the FCC asked both Fox Networks and Cablevision Systems to document their retransmission-consent agreement dealings that has resulted in the current impasse between the two companies. Yesterday, Cablevision responded to the FCC’s request saying it was documenting bad faith negotiations by Fox Network’s parent company News Corp. According to Cablevision’s EVP/Communications, Charles Schueler

“The FCC filing clearly demonstrates that News Corp. has acted in bad faith and outlines the FCC’s authority to order binding arbitration and immediately end the Fox blackout of Cablevision customers. News Corp. never engaged in real negotiations, they only made a ‘take it or leave it’ proposal for Fox 5, and they timed the Fox blackout to leverage major national sporting events to force Cablevision to accept unreasonable demands.”

In response to Cablevision’s testimony to the FCC, Fox Networks said:

“From the genesis of our talks with Cablevision, Fox has negotiated in good faith.We have never made any “take it or leave it” demands, nor are we asking for $150 million in fees.
        
“For Cablevision to still be making those claims is yet another example of their ploy to secure an advantage through government intervention.
“Fox once again calls on Cablevision to stop punishing their subscribers in service of a cynical political strategy and resume constructive negotiations.”

The dispute between Fox Networks and Cablevision has also prompted one politician to reassert her concerns about the pending Comcast-NBC merger. Yesterday, Congresswoman Maxine Waters sent a letter to FCC Chairman Julius Genachowski and her letter in part reads:

“As a Member of the U.S. House of Representatives Committee on the Judiciary, I write to express my ongoing concern for the potential impact the Comcast-NBC merger could have on our already heavily-consolidated media industry. Moreover, in light of Cablevision’s current dispute with News Corporation (News Corp.) over the fees it pays the media conglomerate to carry Fox programming, I have grown increasingly concerned with the potential harm that could result if such a dispute ever arose between a competing cable company and a combined Comcast-NBC. Absent substantive diversity and other public interest conditions, the Comcast-NBC merger could prove harmful to competition among traditional cable and broadcast companies, as well as the American public’s ability to access independent and alternative sources of news and entertainment. I therefore urge the Federal Communications Commission (FCC) and Department of Justice (DOJ) to conduct an extensive review, ensuring that if the merger is approved, it contains substantive and enforceable conditions that foster greater diversity, localism, and competition.”

ABC gave full season orders to two frosh series Better With You and No Ordinary Family and also added more episodes to new series Detroit 1-8-7 and established drama series Brothers & Sisters.

Before AMC premieres its newest original drama series, The Walking Dead on Halloween night at 10p in the US, the network and Fox International Channels (FIC) are teaming on a zombie invasion stunt happening in major cities worldwide all this week. Beginning at dawn today in Taipei and Hong Kong and moving around the world to culminate at the show’s Los Angeles premiere, morning commuters in each invasion city might see or run into hundreds of zombies over a 24-hour period. Zombies will congregate at iconic landmarks in each city such as the Brooklyn Bridge in New York City, the Lincoln Monument in Washington, D.C. to Big Ben in London and the Acropolis in Athens. The 26 global zombie outbreaks will also occur in Istanbul, Madrid, Munich, Rome, Sao Paolo, Buenos Aires as well as Boston, Chicago and San Francisco in the US among other cities. Just hours after the series’ US premiere on AMC this Sunday, the debut episode of The Walking Dead will launch in 120 countries to 250 million households worldwide. Executive producers include Gale Anne Hurd, Chairman of Valhalla Motion Pictures, David Alpert of Circle of Confusion and Charles “Chic” Eglee. FIC owns all international rights to the series outside of North America and recently tapped Entertainment One as a third party company to be involved with broadcast, digital and home video sales of the series. The Walking Dead is based on the comic book series by Robert Kirkman published by Image Comics.

Beginning November 7, Bravo offers five nights of original programming. On Sundays, the network’s franchise series The Real Housewives of Atlanta will air at 10p followed by Watch What Happens Live which moves to Sundays from Mondays at 11p. Besides the new Sunday schedule, Bravo’s original programming lineup also includes Thintervention on Mondays; Millionaire Matchmaker on Tuesdays; Top Chef Just Desserts on Wednesdays; and The Real Housewives of Beverly Hills and a second installment of Watch What Happens Live on Thursdays.

According to its series star, Whitney Port, the reality show The City on MTV has been canceled. The City was a spinoff show of The Hills. During a Monday morning appearance on Ryan Seacrest’s radio show, Port said the show is indeed canceled and doesn’t expect it to move to another network.

GSN is set to premiere the fourth season of The Newlywed Game on November 1 at 6p. The show airs Mondays through Fridays at 6p with new host Sherri Shepherd of ABC’s The View. The Newlywed Game is produced by Embassy Row, owned by Sony Pictures Television.

AccuWeather and O2 Media, Inc. are partnering to offer daily weather updates for The Balancing Act a health and lifestyle show airing on Lifetime Television weekdays at 7a. AccuWeather Meteorologist, Mark Mancuso will host the national weather video segments.

Sundance Channel introduces the Measurement Innovation Metric (MIM) developed by Nielsen, a new qualitative tool that measures an advertising campaign’s effectiveness over multiple networks whether or not the campaign uses branded content or traditional advertising. MIM calculates audience loyalty and engagement in addition to a viewers’ receptivity to advertising.

Tribune Company on Friday filed a Plan of Reorganization with the US Bankruptcy Court for the District of Delaware with the goal to keep the company whole, to reduce its debt and turn ownership over to holders of the company’s Initial and Incremental Term Loans. The plan is pending approval from Tribune’s creditors and the Court and also merges two previously announced settlement agreements okayed by the mediator and reached by its Unsecured Creditors Committee, Oaktree Capital Management, L.P., Angelo, Gordon & Co. L.P. and JPMorgan Chase Bank.

E’s season finale of Keeping Up with the Kardashians airing on Sunday at 10p averaged 4.1 million total viewers and posted a 5.31 rating among W18-34. The season five ender now ranks in the top 10 of the most-watched shows on E! in the network’s history over the last 20 years.

~ DISTRIBUTION, CLEARANCE & CARRIAGE ~  

NBC Universal Domestic Television Distribution sold three of its long-running daytime talk shows, Maury, The Jerry Springer Show and The Steve Wilkos Show through September 2014 to stations that are a part of station groups Tribune, Sinclair and Hearst. The three talk shows have been renewed on stations representing more than 50% of the US in national syndication over the upcoming three seasons. Tribune stations consist of WPIX/New York, KTLA/Los Angeles and WPHL/Philadelphia; Sinclair’s stations are WPGH/Pittsburgh and WTTE/Columbus; and with Hearst the stations include WKCF/Orlando and WMOR/Tampa.

REELZCHANNEL reupped its carriage deal with its affiliate partner Time Warner Cable, signing an extension for five more years.

~  PRODUCTION & DEVELOPMENT ~

CBS ordered a reality show pilot about people who in real-life have the same name as a celebrity. The premise of The Same Name has celebrities switching places with ordinary people who share the same first and last name. The show will follow the regular person and the celebrity as they temporarily take on each other’s life and each episode will be self-contained. Endemol’s production company 51 Minds will produce with Cris Abrego and Eugene Young on board to executive produce.

Comedy Central ordered a TV show pilot based on the independent film Waiting from 2005, cites THR. Waiting is about employees at a Shenaniganz chain restaurant as they gossip, make fun of customers and are generally involved in immature antics. Lionsgate will produce with Rob McKittrick as writer and executive producer along with other executive producers Jeff Balis and Thomas Augsberger.

Friday A18-49 Analysis: UNIV delivered #1 ratings Friday night at 1.8/6 A18-49, according to final national ratings from Nielsen. At 8p, UNIV’s Hasta que el Dinero Nos Separe did best with a 1.7/6 and Medium on CBS was #2 at 1.4/5. UNIV continued in #1 through 9p with Soy Tu Duena at 2.3/7 with CBS playing second fiddle again, this time with CSI: NY at 1.8/6. A shift happened during 10p as CBS’ new series Blue Bloods was first at 1.8/6 and ABC came next with 20/20 at 1.5/5 and UNIV dropped to third place with La Rosa de Guadalupe at 1.4/5.
