Monday represented day three of the on-going carriage battle between Fox Networks and Cablevision Systems. Though both parties talked briefly yesterday morning at FOX headquarters in New York, no resolution was reached. Also yesterday, US Senators Frank R. Lautenberg (D-NJ) and Robert Menendez (D-NJ) urged the FCC to intervene immediately to help solve the argument involving Cablevision and Fox Networks and further asked the FCC to make changes to prevent similar carriage disputes like this one in the future.

With no sign of a deal being reached, Charles Schueler, EVP/Communications at Cablevision made this statement:

“When broadcasters like News Corp. remove their signals, they hurt viewers in an attempt to gain business leverage. Cablevision agrees to submit to binding arbitration, as called for by more than 50 elected officials from New York, New Jersey and Connecticut as the fastest and fairest way to return Fox programming to Cablevision viewers. We call on News Corp. to do the same.”

Fox Networks also released a statement to the press yesterday regarding the status of the negotiations:

“Monday morning the parties talked again briefly. Unfortunately, no significant progress was made because Cablevision continues to demand preferential treatment and rejects the same fair terms that have been accepted by other providers in the market.

“It is increasingly clear that Cablevision’s real intention is to continue making this their subscribers’ problem in the hope that with enough inconvenience, politicians will intervene to protect Cablevision’s huge profits – nearly $795 per subscriber last year.

“That is why Cablevision is calling for “arbitration” despite knowing that this is not a serious solution. After all, Cablevision would never agree to arbitration for its own MSG cable network. Indeed, MSG and MSG Plus recently went off the dial for millions of DISH subscribers  and MSG did not seek arbitration. Cablevision also continues to put out the false information that Fox is seeking $150 million in fees, which is simply not true.

“Fox continues to call on Cablevision to quit punishing its own subscribers in service of a cynical political strategy. Only serious business-to-business negotiations will protect viewers, which should be everyone’s top priority.”

NBC granted full season orders to three frosh series: dramas The Event and Law & Order: Los Angeles and sitcom Outsourced. Through last week, The Event has averaged a 3.0/7 among A18-49 and 9.1 million viewers; LOLA averaged a 2.5/7 and 8.7 million viewers; and Outsourced averaged a 3.0/8 and 6.3 million viewers.

TLC opens a new series called Wreck Chasers on October 28 at 10p. In the six-episode series, viewers will follow competitive tow truck drivers, also referred to as “wreck chasers” through the streets of Philadelphia as they chase after vehicular accidents in hopes of arriving first and collecting cash. The half-hour series is produced by MY Tupelo Entertainment for TLC. Preceding the premiere of Wreck Chasers, TLC launches the next version of its Police Women franchise with Police Women of Dallas at 9p. The eight-episode series follows five competent female police officers working for the Dallas Police Department. RelativityREAL, LLC produces the series.

Later this year, President Obama will make a walk-on appearance on Discovery Channel‘s series Mythbusters. The President’s appearance is part of a White House science fair promotion and Mr. Obama will ask the show’s hosts about the myth involving ancient Greek scientists setting fire to invading Romans by using mirrors to reflect the sun’s rays.

Beginning yesterday, ABC Family will no longer air reruns of Friday Night Lights, reports EW. The network started airing encores of the drama this summer and because it wasn’t delivering the ratings needed by the network, it was pulled. The final season of Friday Night Lights premieres October 28 on DIRECTV.

The upcoming 3D cable network, a joint venture between Discovery, Sony Corp. and IMAX revealed its initial programming lineup scheduled to launch next year, cites Variety.

  • 3D Theatrical Films from Sony include the recent Monster House and Cloudy with a Chance of Meatballs.
  • Original Series include: Abandoned Planet from Flight 33 Productions; Africa in 3D from Aquavision Television Productions; China produced by Natural History New Zealand Ltd. (NHNZ); and Jewels of the World also from NHNZ.
  • Exclusive US Premieres consist of: Attack of the Giant Jellyfish (Discovery) produced by Story House Productions; The Haunted (Discovery) produced by Picture Shack Entertainment; Into the Deep 3D (IMAX); and Magnificent Desolation: Walking on the Moon 3D (IMAX).

Syfy’s third season debut of Sanctuary last Friday at 10p averaged 1.8 million total viewers, as well as 728,000 among A18-49 viewers, a +17% and a +12% increase over the second season premiere, respectively.

Zephyr Media Group formed a separate and dedicated entertainment unit encompassing media planning and buying on behalf of the motion picture, television and home entertainment industries. Furthermore, Zephyr is now the advertiser sales rep for Showplace Television Syndication and its entire library of nationally syndicated reality programming and FCC-friendly children’s programming.

~ DISTRIBUTION, CLEARANCE & CARRIAGE ~

Fox Television Stations and Twentieth Television forged a deal involving the broadcast syndication rights for the sitcom Modern Family. The comedy was picked up by Fox Television Stations in New York, Los Angeles, Chicago, Dallas, Washington, D.C., Houston, Minneapolis, Phoenix, Orlando and Baltimore. This latest syndication deal for Modern Family adds to the previous agreement whereby USA Network acquired the cable syndication rights for the comedy beginning fall 2013. Modern Family currently airs on ABC and is produced by Twentieth Century Fox Television in association with Levitan Lloyd Productions.

REELZCHANNEL made a deal with iN DEMAND to increase the network’s Movies On Demand (MOD) coverage and awareness with viewers. The deal allows REELZCHANNEL to use MOD/PPV schedule information given by iN DEMAND to upgrade the visibility of the On Demand platform in the network’s programming. The two entities will additionally work together on promotional ideas for on-air and digital platforms.

Sony Movie Channel, the first multi-platform television network in the US from Sony Pictures Television has launched on DISH Network, DIRECTV and AT&T U-verse TV. Sony Movie Channel is available on linear in addition to authenticated VOD and online platforms. The network airs theatrical releases in hi-def from Sony Pictures’ extensive library of film titles.

~ PRODUCTION & DEVELOPMENT ~

CBS has a drama series in development based on the novel The Pawn by Steven James and is collaborating with ABC Studios on the project. Michael Goldstein and Michael Larkin are producing under their company banner Larkin-Goldstein Productions which also produced Scoundrels for ABC. Charles Murray (Criminal Minds, Castle) is penning the script. The Pawn is the first of James’ series of eight books featuring FBI agent Patrick Bowers who uses geospatial investigative techniques to solve high-profile crimes.

CBS is developing another series based on a Twitter feed, this one called Dear Girls Above Me, reports THR. This project is from Katalyst Productions, headed by Ashton Kutcher, and Schiff Co. and is written by Charlie McDowell about a guy who is distracted by the female roommates living above him. Kutcher is also producing another Twitter feed series for CBS called Shh . . . Don’t Tell Steve.

Also from THR, CBS additionally picked up a medical drama television project from Denis Leary and Jim Serpico (Rescue Me) about three doctors who become employed at their university’s hospital. Elle Johnson is penning the script and executive producing along with Leary and Serpico at CBS Television Studios.

CMT said its first scripted comedy Working Class is scheduled to begin production in Los Angeles today. The 12-episode multi-camera series stars Melissa Peterman as Carli Mitchell, a single, blue collar mom who moves her three kids to a wealthy suburban neighborhood. The series also stars TV veteran Ed Asner along with Steve Kazee, Patrick Fabian, Lachlan Buchahan, Courtney Merritt and Cameron Castaneda. Produced by The Film Syndicate, Working Class is slated to premiere in January 2011.

IFC announced a number of celebrities will make appearances in its upcoming original comedy series Portlandia set to debut in early 2011. The combination of actors and musicians include Selma Blair, Heather Graham, Aimee Mann, Edie McClurg, Kumail Nanjiani, Jason Sudeikis and Gus Van Sant along with Sarah McLachlan and James Mercer among others. The half-hour episodes of Portlandia offer up a dreamy and zany picture of Portland, Ore consisting of comedy sketches starring Fred Armisen (SNL) and Carrie Brownstein, the vocalist/guitarist of Sleater-Kinney. Armisen and Brownstein wrote the show along with Allison Silverman and Jonathan Krisel. Lorne Michaels serves as executive producer and the series is produced by Broadway Video.

~ RATINGS ~

Friday A18-49 Analysis: Week to week, UNIV maintained the same winning ratings Friday night at 1.6/6 A18-49 each, according to final national ratings from Nielsen. At 8p, UNIV’s Hasta que el Dinero Nos Separe won with a 1.7/6 followed by The CW’s Smallville at 1.3/5 and CBS’ Medium in third at 1.1/4. Also this hour NBC debuted new series School Pride at 0.9/3 which tied for fourth place with ABC’s rerun of No Ordinary Family. UNIV continued its success streak through 9p with Soy Tu Duena at 2.1/7 and CBS’ CSI: NY was next at 1.7/6. CBS took over at 10p with Blue Bloods in #1 at 1.7/6 and ABC’s 20/20 and NBC’s Dateline tied for #2 at 1.3/4 each.

~ EXECUTIVE MOVES ~

Atlanta-based MaxMedia hired Jeff Doud as Executive Creative Director. Jeff joins MaxMedia’s team and will work closely with current ECD, Thomas W. Frank. Previously, Jeff worked as an ECD at RIOT in Atlanta.

EchoPoint Media, a unit of Young & Laramore based in Indianapolis, added two executives and promoted one, effective immediately:

  • Megan Suttile joins as Senior Media Planner/Buyer to work on the Clarian Health Partners business coming from Starcom in Chicago. She reports to Jen Renzi, Media Supervisor.
  • Jamie Simpson was hired as an Assistant Media Planner/Buyer joining from Pearson and Partners in Indianapolis. Jamie also reports to Jen Renzi and works on the Clarian Health Partners account.
  • Brian Schluep was upped to Senior Media Planner/Buyer, reporting to Shannon Quinn, Media Manager and to Linda Allee, Media Supervisor.

Andy McKenna rejoins the independent, full-service advertising agency Brunner as Creative Director. Previously, Andy worked at Brunner from 2003-2006 as Creative Director. In his new role at Brunner, Andy will work on the accounts Cub Cadet, Musselman’s and Bob Evans among others. Based in Pittsburgh, Andy will report to Jay Giesen, Executive Creative Director.

Superna Kalle was tapped as GM for Sony Movie Channel to manage distribution, marketing, programming and all network operations.

Si TV employed Rafael “Rafe” Oller as SVP/Marketing. Rafe formerly worked for Warner Bros. International, FOX Broadcasting and USA Broadcasting and in his new position at Si TV, he will report to Michael Schwimmer, CEO.

Iconix Brand Group, Inc. declared Peanuts Worldwide, its joint venture entity with Charles M. Schulz Creative Associates named Tamra Knepfer to the role of EVP, Peanuts Worldwide and also elevated Helene Gordon to SVP/Brand Management, Peanuts Worldwide.
