~ MORE GOOD STUFF ~

On Wednesday much back-and-forth dialogue occurred between Cablevision Systems and Fox Networks concerning their ongoing retransmission-consent argument.

The day began with Cablevision’s Charles Schueler, EVP/Communications stating,

“Cablevision has and will continue to negotiate in good faith. We are trying to reach a deal that is fair for everyone, including our customers, but there has been absolutely no movement by Fox in their attempts to gain massive fee increases from Cablevision customers to carry broadcast signals that are free over the air.

“The FCC is the government agency charged with protecting television consumers and oversight of broadcast licenses. We do not understand how protecting and interceding on behalf of TV viewers in 3 million blacked out households in the Northeastern United States does not fall under the FCC’s purview. The FCC has the facts and our customers are demanding that the FCC act.”

Cablevision soon followed this by making a new offer to Fox/News Corp. saying they will

“agree to pay the rate Fox charges Time Warner Cable for carriage of WNYW-Fox 5 New York and WTXF-Fox 29 Philadelphia for a period of one year.This is higher than the rate we pay any other New York broadcast station.This solution is in the best interest of not only baseball fans but of all Cablevision customers and Fox viewers. We look forward to a positive response.”

A few hours later, Fox countered with this statement:

“We remain committed to negotiating a fair deal with Cablevision, but today’s incomplete proposal is not acceptable.Cablevision is seeking a discounted ‘package rate’ without buying the entire package.We have told Cablevision all along we are willing to negotiate a deal  based on an entire suite of channels  under the terms we have reached with Time Warner Cable and other providers, or a stand alone agreement for WNYW FOX5, WTXF FOX29 and WWOR My9. Cablevision’s offer  sent to the press just as it was provided to us  is yet another in a long line of publicity stunts.”

Soon after, Cablevision’s Schueler released this statement:

“On behalf of our customers, we are very disappointed that we offered News Corp. what they asked to be paid for Fox 5 and Fox 29 and News Corp. has said no. It is now clear beyond a shadow of a doubt that News Corp. is operating in bad faith. We call on the FCC to intervene immediately to restore the Fox signals to Cablevision’s 3 million homes and order News Corp. to agree to binding arbitration to resolve this conflict.”

Then late yesterday, Cablevision Systems declared its customers can view the World Series games live via online at MLB.com and Cablevision will reimburse these customers in full. MLB.com’s 2010 Postseason.TV package includes live coverage of all World Series games and also allows viewers to choose from eight different fixed camera angles with the option to display up to four camera angles on the screen simultaneously in addition to in-game highlights and other features. Those Cablevision customers who buy this package and forward a confirmation of the purchase to Cablevision will have a $10 credit applied to their monthly bill within two billing cycles.

CBS reduced its episode order for the drama series Medium, decreasing the original 22 ep order to 13 total eps. The network is shaving off eps from Medium to make room on the schedule for midseason shows including Chaos, Criminal Minds: Suspect Behavior and the new reality competition series Live to Dance. CBS Television Studios produces Medium.

Syfy decided to end its freshman series Caprica, the prequel to Battlestar Galactica with the network citing, “Unfortunately, despite its obvious quality, Caprica has not been able to build the audience necessary to justify a second season.” As of November 2, Syfy will take Caprica off its schedule and the remaining five episodes of the first season will air sometime during first quarter 2011.

HBO renewed two of its comedies airing on Sunday nights, the private eye series Bored to Death starring Jason Schwartzman, Zach Galifianakis and Ted Danson and Eastbound & Down helmed by Danny McBride for a third season.

FOX announced its upcoming cop drama Ride-Along from creator Shawn Ryan has switched its name to The Chicago Code.

On Tuesday, TNT aired exclusive doubleheader coverage of the opening night of the NBA’s 2010-2011 season which drew an average of nearly 5.5 million total viewers. The first game between the Miami Heat and the Boston Celtics tallied 7.4 million total viewers, making it the most-watched regular season NBA game on cable ever. The second game of the doubleheader between the Houston Rockets and the Los Angeles Lakers at 1030p attracted 3.7 million total viewers. Overall, the doubleheader has become the most-watched NBA Opening Night doubleheader in Turner’s 27 years of covering the opening of the season.

MTV is adding to its Thursday night schedule starting November 4 by bringing back a new season of Pranked at 10p, a show featuring film clips of pranks caught on video as well as the new series MegaDrive at 1030p. MegaDrive watches as comedian and crash test dummy Johnny Pemberton tries out the toughest extreme vehicles in America on land and air, all the while panicking the unsuspecting owners of the vehicles. Pranked is executive produced by Cheri Brownlee and John Johnston of Cheri Sundae Productions and MegaDrive is executive produced by Rob Anderson and Allison Corn and Antony Tackaberry of Lion Television.

In other MTV news, the network is premiering a new one-hour reality show, I Used to Be Fat on December 29 as part of MTV’s Ten Spot. Over ten episodes, the series will follow teens during the summer following high school as they lose weight before starting their freshman year in college. Each episode follows one teen as they work with nutritionists, trainers and doctors to make their goals a reality. 3 Ball Productions, the company behind NBC’s The Biggest Loser, E!’s What’s Eating You and the future ABC show Extreme Makeover: Weight Loss Edition is producing I Used to Be Fat.

Fox News reupped its contract with Shepard Smith allowing him to continue as the cable news network’s chief news anchor through the end of 2013. Smith’s current contract was due to expire at the end of this year and his new deal covers three years. Smith anchors Studio B at 3p and also Fox Report at 7p.

Showtime introduces a new free video streaming service called Showtime Anytime giving subscribers the chance to watch all of the premium network’s programs online. A total of 400 hours of Showtime’s series, movies, sports and other programs will be offered. Showtime Anytime is available via Showtime’s cable, satellite and telco affiliates. Comcast customers will have access to the service through Xfinity TV online at XfinityTV.com. Additional MSOs will be announced in the future.

~ DISTRIBUTION, CLEARANCE & CARRIAGE ~  

ION Television secured multiple deals with major Hollywood studios, picking up more than 85 theatrical film titles. The deals were finalized this month with Warner Bros., Twentieth Century Fox and Sony Pictures Television. The new film acquisitions will begin airing this month and throughout 2012, as part of the network’s newly expanded daypart and late night schedule from 1p to 1a in addition to its growing Big Movie Weekend. ION Television picked up 44 films from Warner Bros. Domestic Television Distribution such as Starsky & Hutch, The Perfect Storm, The Guardian, Analyze This and Analyze That. Examples of titles acquired from Twentieth Century Fox include Slumdog Millionaire and Master and Commander: The Far Side of the World. ION Television claimed 16 film titles from Sony Pictures Television including Ali, Vantage Point and We Own the Night. And lastly, ION Television also picked up 12+ titles from MGM including Be Cool, A Guy Thing and Into the Blue.

Univision Communications Inc. and the NFL expanded their current partnership making Univision the Official Hispanic Media Partner of certain NFL events surrounding the upcoming Super Bowl XLV in Dallas. Univision will also upgrade its NFL coverage across its various media platforms. Univision will continue to serve as the official Spanish-language network radio broadcaster for the NFL and both will jointly develop and operate the official Spanish-language website of the NFL at www.nfl.com/espanol .

~  PRODUCTION & DEVELOPMENT ~

Trump Productions LLC, headed by Donald Trump and Andy Litinsky announced it has extended its partnership with NBC Universal by inking a multi-year, first-look deal. The new agreement allows Trump and Litinsky to continue to create, develop and serve as executive producers for television projects encompassing scripted, unscripted, animated and syndicated content for both network and cable. Presently, Trump Productions is in production on its fourth season of Celebrity Apprentice for NBC and has gained a season two renewal for the series Donald Trump Presents: The Ultimate Merger for TV One and the sports series Trump’s Fabulous World of Golf for Golf Channel. In addition, Trump Productions is also producing two pilots. The first is for The CW, a business-themed show titled Keep It in the Family, and in partnership with DHX in Canada, an animated project called The Trump Universe.

On the heels of her stint on ABC’s Dancing with the Stars, Audrina Patridge will soon get her own reality series on VH1. The former star of MTV’s The Hills made a deal with VH1 to produce and star in a reality series about her life and family in Hollywood as she tries for an acting career. Mark Burnett Productions is producing and production will commence next year.

Call for Entries: There are a few days left to submit video entries to the Time Warner Cable Short Film Contest in conjunction with IFC. The contest invites aspiring filmmakers across the nation to highlight their talent by creating a short two to five-minute film. The deadline for submissions is this Sunday, October 31. Four Grand Prize winners will receive a four-night trip for two to the 2011 Sundance Film Festival in Park City, Utah in January. Tuesday  A18-49 Analysis: As the winner Tuesday night, FOX was gleeful at 3.7/10 among A18-49, according to final national ratings from Nielsen. At 8p, FOX’s Glee took charge with a 4.9/13 with CBS’ NCIS in second place at 4.1/11. CBS won at 9p with NCIS: Los Angeles at 3.4/9 while ABC’s Dancing with the Stars Results was next at 3.1/8. Then at 10p, CBS remained the leader with The Good Wife at 2.4/7 followed by NBC’s Parenthood at 2.0/6 and ABC’s Detroit 1-8-7 in a close third position at 1.9/6.

~ EXECUTIVE MOVES ~

Saban Brands LLC hired Mary Rafferty as VP/Toys & Hard Lines and Rob Hughes as Marketing Director. Mary will manage toy licensing, product development and retail for properties represented by Saban Brands including Paul Frank and the new Power Rangers series premiering in 2011. Rob will oversee marketing campaigns for the company targeting Power Rangers and Paul Frank in addition to other future acquired properties.

Effective immediately, Jeff Gurley was promoted to VP/Director of Sales at KDFW FOX 4 and KDFI My27 in Dallas-Fort Worth. Jeff, who was most recently VP/GSM at the stations, will now manage the station’s entire sales efforts. He will report to Kathy Saunders, VP/GM.

Bob Winter was named CCO for the Chicago office at WPP’s Young & Rubicam, reporting to Tony Granger, Global CCO. Bob will begin his new position in December and once at the agency will head creative direction on behalf of clients such as Sears, DieHard, Craftsman, Hotels.com, Giant Eagle and Kenmore. Bob joins from Leo Burnett Chicago where he was SVP/Executive Creative Director for more than three years.

Atlas Media Corp. elevated Andrew Jacobs to Director/Development. Andrew’s new role is effective immediately and he will continue to be located at Atlas Media’s New York headquarters. He reports directly to Kaki Kirby, EVP/Business Development and Special Projects.

Telemundo tapped Michael Alvarez as VP/Advertising Sales for the Telemundo Network Sales New York. Michael will co-manage advertising and sponsorship functions for Telemundo Network’s assets in the New York region as well as supervise a team of Account Managers. Michael will report to Michael Rodriguez, SVP/Network Ad Sales, Telemundo.

This month, Landmark Theatres and Arthouse Marketing Group launched a new company to concentrate on cinema advertising sales called Spotlight Cinema Networks based in Santa Monica, CA. The new entity represents more than 400 cinema screens in top markets in the US. Michael Sakin will take on the role of EVP at Spotlight Cinema Networks in charge of sales, marketing and industry relations. Michael was formerly SVP/Sales at Landmark. Furthermore, Jerry Rakfeldt, Managing Director at AMG will become President of Spotlight Cinema Networks.
