And the saga continues … The fifth day of the ongoing retransmission-consent dispute between Cablevision Systems and Fox Networks accomplished nothing yesterday and a deal appears to be nowhere in sight. According to Fox, both parties talked briefly Wednesday and discussions are likely to resume today.

FCC commissioner, Michael Copps weighed in on the disagreement saying consumer’s rights have been trampled with this fight. “If the Fox-Cablevision dispute proves anything, it is that the consumers are clearly not being protected,” he said in a statement yesterday. The Commissioner said the FCC should scrutinize good faith negotiations and what that means in “a fast-changing media landscape with the big players maneuvering to see how they can create new business models that will give them the upper hand over their rivals going forward.”

Despite being a consumer protection agency, by law the FCC can only be involved in negotiations to insure the parties are bargaining in good faith. “I believe the Commission should take a very serious look at whether ‘good faith’ negotiations are indeed occurring. What, indeed, does ‘good faith’ mean in the dog-eat-dog world of big media? If such talks are not taking place, we should move promptly to protect consumers,” Copps said.

Copps went on to make a comment about Fox’s decision to briefly block Cablevision’s subscribers from seeing its programming via the internet. “For a broadcaster to pull programming from the Internet for a cable company’s subscribers, as apparently happened here, directly threatens the open Internet,” Copps said.

Ellen DeGeneres expanded her business relationship with Warner Bros. Television Group (WBTVG) by signing a new multiyear exclusive agreement with Warner Bros. Television. According to the terms of the new deal, DeGeneres and A Very Good Production will develop and executive produce television projects utilizing different production divisions of WBTVG including scripted and unscripted broadcast and cable series for Warner Horizon Television as well as syndicated programming with Telepictures Productions, also producer of The Ellen DeGeneres Show. The deal also allows Warner Bros. to have a first-look at any social media and digital gaming ideas emanating from DeGeneres.

Comedy Central’s The Daily Show with Jon Stewart welcomes President Obama as a guest on October 27 at 11p. This appearance marks the President’s fifth time on the show though the first one as POTUS.

Comedy Central is serving up a new original series, The Benson Interruption on November 5 beginning at midnight. The six-episode series features comedian Doug Benson as he sits on stage and interrupts his friends’ performances. Benson’s guests will include Adam Carolla, Nick Swardson, Patton Oswalt, Brian Posehn, Thomas Lennon, Mary Lynn Rajskub and Eugene Mirman.

As the price of gold increases worldwide, so does interest in mining the rare mineral in Alaska where there are veins worth an estimated $250 billion. Discovery Channel premieres the new series Gold Rush: Alaska on December 3 at 10p following six men who are risking everything in an attempt to strike it rich in the wilderness of Alaska. Oregon-native Todd Hoffman leads this group of inexperienced miners, all from Oregon, to an area called Porcupine Creek, where they have leased a mine. The series watches as the men face down the hardships of their venture away from their families with the backdrop of Alaska’s breathtaking vistas around them. Gold Rush: Alaska is produced by Raw Television for Discovery Channel.

Just prior to Halloween, cable channel Chiller is unveiling a new logo, fresh on-air look and an updated tagline: Scary Good on October 27. Chiller has also seen a boost in ratings and has added original programming to its lineup such as the network’s first original movie, The Passenger premiering next spring and its upcoming first original special, Chiller 13: The Decade’s Scariest Movie Moments airing this December. Since this past June when Nielsen began measuring Chiller, the channel has delivered a +86% increase in A18-34 viewers; +66% with A18-49; and +45% among A25-54. Chiller’s median age has also dropped in the last four months to 47.1.

Bravo’s The Millionaire Matchmaker opened its fourth season on Tuesday at 9p, making it the highest-rated season premiere for the series. The debut episode attracted 1.3 million total viewers and 874,000 A18-49.

~ DISTRIBUTION, CLEARANCE & CARRIAGE ~

In another carriage battle between Comcast and Tennis Channel that has raged since early this year, the two parties agreed in a brief filed with the FCC yesterday to try mediation. Comcast and Tennis Channel must complete mediation before November 24 or the case will go in front of an FCC administrative law judge. In January, Tennis Channel filed a complaint with the FCC against Comcast, claiming Comcast is discriminating against networks it does not own. The complaint says Comcast put Tennis Channel on a premium tier where consumers must pay extra while its own cable sports channels, Versus and Golf Channel are carried on its basic tier. 

Connection III Entertainment Corp. made the first sale for its new FCC-friendly, E/I weekly series Live Life & Win! to the CW Plus for the 2011-2012 season. The half-hour series targets young viewers with inspirational teen success stories and segments about the arts, school and sports, exercise and nutrition as well as health and wellness. Connection III is producing 22 episodes for the first season.

Tuesday  A18-49 Analysis: CBS ruled the roost Tuesday night with a 3.6/10 among A18-49, according to final national ratings from Nielsen. CBS won the 8p hour with NCIS at 4.3/12 well ahead of the next nearest competitors, NBC’s The Biggest Loser at 2.3/7 and ABC’s No Ordinary Family at 2.2/6. CBS hung onto the lead through 9p with NCIS: Los Angeles at 3.9/10 and ABC’s Dancing with the Stars Results placed second at 3.2/8. CBS captured the final win of the night with The Good Wife at 2.6/7 with NBC’s Parenthood following at 1.9/5 and ABC’s Detroit 1-8-7 at 1.8/5.

Chris Elwell was promoted to EVP/US Distribution with Sony Pictures Television (SPT). Chris will head a team involved with strategic planning for all facets of distribution as well as targeting and developing US television and cross-platform sales opportunities. Furthermore, Chris continues to manage business affairs and sales and syndication oversight for SPT’s US television distribution, ad sales and digital distribution efforts. Chris reports to Steve Mosko, President, SPT.

Lauren Corrao was named President of A Very Good Production by Ellen DeGeneres. Lauren joins from Comedy Central where she served as President/Original Programming and Head/Development.

Jen Mayerkulp has taken on a new position at Asylum Entertainment as SVP and Head/Television Development where she will supervise the company’s television development. Prior to this appointment, Jen was with LMNO Productions as VP and Head/Development.

Effective immediately, TidalTV added Kevin Smith as Sales Director  Midwest/Automotive and Jim Kleinick as Senior Sales Manager/Midwest for the company’s Chicago office. Both Kevin and Jim are charged with increasing the company’s reach in Detroit and the Midwest. They will report to Steven Sackey, VP/National Sales.
