Good morning. It’s Thursday, December 1, 2005, and this is your first early morning Kids! briefing.

In Washington yesterday, Sen. Hilary Clinton (D-NY) and Joe Lieberman (D-CT) introduced plans for a new bill, The Family Entertainment Protection Act, prohibiting selling M-rated (mature) video games to minors everywhere in the US.  The Family Entertainment Protection Act is comprised of five specific provisions:

  • The centerpiece of this bill is a prohibition against any business for selling or renting a Mature, Adults-Only, or Ratings Pending game to a person who is younger than seventeen. Similar prohibitions have become law in the last several months in California, Michigan, and Illinois. 
  • Annual analysis of the ESRB Ratings System in an effort to help ensure the system accurately reflects the content of each game.
  • Authority for the FTC to investigate misleading ratings.  This provision speaks to the Grand Theft Auto: San Andreas debacle and if passed would require that the FTC investigate to see if such problems are prevalent throughout the industry.
  • The Bureau of Consumer Protection of the FTC would be where consumers may register their complaints if they believe that the ratings do not accurately reflect a game’s content.
  • And the FTC has the authority to conduct annual and random audits of retail outlets. This means they can basically set up a secretive operation to see how easily minors can purchase mature and adult only rated games from the store.

As you know, similar such bills introduced in California, Illinois and Michigan have been found to be unconstitutional by various judges.  Among those who spoke out against such legislation yesterday was Hal Halpin, President/Interactive Entertainment Merchants Association, a trade group for video game retailers. Halpin issued a statement saying the industry had “committed voluntarily to a self-regulatory enforcement system substantially similar to the motion picture business, which the very same legislators hold up as the ‘Gold Standard’.”

NEW PRODUCTION & DEVELOPMENT

The N has begun production on Whistler, a new 13-part drama/thriller series set to launch in fall 2006.  Whistler is the result of a partnership between The N and co-producers Blueprint Entertainment and Boardwatch Productions, in association with Canadian broadcaster CTV.  Whistler is about a seemingly perfect mountain resort that is the Mecca to elite athletes from all over the world.  But things take a curious turn when the local snowboarding legend is found dead on the slopes shortly after returning home from winning a gold medal at the 2006 Torino Winter Olympics … and that is when secrets begin to surface.  Whistler was created by Executive Producer/Show Runner Kelly Senecal (National Lampoon’s Going the Distance, Just Deal).  He is joined on the creative front by the Writer/Executive Producer team of Tony Blake and Paul Jackson (She Spies, Charmed, The Pretender) as well as Writer/Co-Producers Russ Cochrane (Last Exit, The N’s Radio Free Roscoe, MTV’s Undressed) and Alison Bingeman (CSI-Miami, FX: The Series).

Disney Channel has picked up a fourth season (22 eps) of its animated comedy/action series Kim Possible.  Series Creators/Executive Producers Bob Schooley and Mark McCorkle will continue to oversee production and Steve Loter also returns as Director/Producer for season four.

MORE KIDS STUFF

The preschool TV series Mustard Pancakes will release Courtney Campbell/Mustard Pancakes the first CD featuring music from the music-based live action program on December 6.  Campbell hosts and performs songs on Mustard Pancakes, which airs in 200+ Public TV stations nationwide.  The CD will be available at mass retailers including Target as well as music stores such as Tower Records.

Nelvana Home Entertainment and Criterion Pictures have inked a 5-yr agreement for the non-theatrical distribution of titles from Nelvana’s library of animated programming.  Under the terms of the deal, Criterion Pictures picks up distribution rights to Anatole (26 eps); Babar (78 episodes), The Berenstain Bears (40 eps), Corduroy (13 eps), Franklin (78 eps), Little Bear (52 eps) and Elliot Moose (13 eps), with other titles expected to be announced.  Available in both English and French, the shows will be offered to all major non-theatrical channels including schools/school boards, daycare centers, libraries and museums.  Criterion Pictures, and Visual Education Centre, an associated company, is the principal provider of audiovisual learning resources to Canadian schools.

MARKETING/LICENSING

Mforma, a mobile entertainment content publisher, has released its Marvel game title, Ultimate Spider-Man, for its subscribers in Europe and the US and will soon be available in Asia.  The new mobile game is based on Activision, Inc’s console video game of the same title, and of course on Marvel’s comic book character Spider-Man.  The game features 24 levels of play, 12 each for Spider-Man and Venom.

Disney has entered into a multi-year agreement with Super RTL, which broadcasts Kim Possible and will, in coordination with Disney Consumer Products, be responsible for licensed product based on the series in a range of categories in Germany and other German-speaking countries.  Buena Vista Home Entertainment, Buena Vista Games and Disney Publishing will continue to represent the license for Kim Possible branded home entertainment, interactive games and print categories.  Super RTL is owned in equal shares by The Walt Disney Company and the RTL Group and reaches about 95 per cent of all the 35m TV HH in Germany.

Cookie Jar Entertainment is partnering with Ty’s Toy Box LLC, an online retailer, to create a licensed merchandise program for the preschool music-centric series, The Doodlebops.  As of November, at www.tystoybox.com, the first items of exclusive Doodlebops merchandise became available.  Products include Doodlebops branded apparel, backpacks, lunch bags, clocks, watches, picture frames etc.  All merchandise will be available only at.  Consumers also can access the website via the Stuff link at www.doodlebops.com. Cookie Jar Entertainment is the entertainment arm of Cookie Jar Group

In conjunction with Universal’s release of Peter Jackson’s King Kong on December 14, Nestle has introduced a limited-edition King Kong bar and special edition King bar and a sweepstakes.  Outfitted with movie related packaging the King bars weigh in at a hefty 3.5-5.0 ounces and are available in Nestle’s Crunch, Crunch with Caramel, Baby Ruth, Butterfinger and 100 Grand.  I would like to personally thank Nestle or not trying to figure out how to mix banana flavoring in with this promotion.  Don’t get me wrong, bananas are great but … keep it simple stupid applies in this case.

EXECUTIVE MOVES

Archie Comics Entertainment, LLC. has appointed Ben Berlin to the newly created position of Director of Operations, effective immediately. Headquartered in the company’s Norwalk, Connecticut office, he will report to Steve Herman, VP/Licensing. In his new position with Archie Comics Entertainment, Ben will manage the day to day operations of the company, interface with Licensees, execute promotional concepts, create marketing plans and develop business to business partnerships.

Scholastic Education has announced the appointment of Ana Bishop as Marketing Director/SCHOLASTIC REDO Professional Development.  Ana will oversee all marketing efforts for the breakthrough online and in-person professional development program that helps K-12 teachers to improve their reading instruction and raise student achievement. She will report to John Lent, VP/Professional Development.

RATINGS

Nickelodeon earned double-digit month-to-month growth in total day for November sweeps onth among all kid and tween demos.  The network also delivered about 2.3m total viewers K2+, up by +19% over October.

  • The network delivered an avg. 1.3 million viewers K2-11, up by +18% versus October’s total day ratings (on par with November’s 2004 ratings). 
  • Also getting a boost in total day delivery was K6-11 with 730,000, and Tweens 9-14 with 569,000, up by +20% and +23% respectively versus October. 
  • Among the youngest viewers, Nick delivered an average of 564,000 Kids 2-5 for November, up +14% over last month,

November sweeps were also kind to Disney Channel which averaged its highest ever November delivery in primetime for P2+ (2,169,000), K6-11 (892,000) and Tweens 9-14 (770,000).
