Robbery’s not always a bad thing, said Time Warner chief Jeff Bewkes during Wednesday’s earnings call. If HBO’s Game of Thrones is among the most-pirated TV shows, then “That’s better than an Emmy,” Bewkes said. “We’ve been dealing with this for 20, 30 years  people sharing subs, running wires down the backs of apartment buildings. Our experience is that it leads to more paying subs.”

How patient will the three million Time Warner Cable customers be as TWC chief Glenn Britt and CBS CEO Les Moonves slug it out over retransmission fees? BTIG media analyst Richard Greenfield points out there are options that haven’t been available to viewers in the past. “AEREO takes away some of the leverage broadcasters have with going dark during retrains disputes because there is a simple way for consumers to restore access without having to go to a store,” Greenfleld tells Cynopsis. “We did a demo that shows how affected customers could sign up in less than two minutes and get 30 days free.”

Queen Latifah isn’t going to be shy about enlisting her superstar friends to guest on her new talk show. “The A-list celebrities, yeah you,” Latifah says in a video shoot for Hollywood Reporter. “I see you… and you’d better come on the show.” It’s doubtful she’ll have to twist any arms – Jada Pinkett Smith and Will Smith are among the talker’s producers. Syndicated The Queen Latifah Show bows Monday, September 16.

Speaking of Latifah, if Q scores are any indication, she has an edge in the daytime talk show war this fall, with high familiarity (90%) and negative (11%) scores, in the range of Ellen Degeneres (87/11) and Whoopi Goldberg (89/16). That might not bode well for Kris Jenner (54/63), whose talker, Kris, is testing now, or Bethenny Frankel (31/47) whose syndicated show, Bethenny, debuts September 9. But Wendy Williams of The Wendy Williams Show (46/32) proves polarizing can be profitable – her syndicated chatfest has a commitment from FOX through the 2016-17 season, thanks to strong ratings growth.

Spoiler alert: Downton Abbey exec producer Gareth Neame spilled a few secrets at the TCA about the U.K. drama’s fourth season on PBS. Action will pick up a few months after the death of Matthew Crawley (Matthew Stevens) in 1921. Matthew’s widow, Mary, will have a few new love interests, including Lord Gillingham (Tom Cullen). As for Mary’s less glamorous sister, Edith, “It’s really a very different season for Edith this year,” said Neame. He wasn’t concerned about cast defections like Stevens’ or Jessica Brown Findlay‘s (Sybil). “As far as we know, we’re all doing series five next year,” he said. “If other actors start leaving, it would be a worry, but it’s been fine so far.”

Upfront update: The Hollywood Reporter’s review of the upfronts showed NBC had the biggest jump in ad sales, up 17% with a 7-8 percent CPM increase. CBS also fared well, up 8% with a 8 percent CPM increase; the net scored the most total viewers in 2012-13 and was the only one to improve its ratings. CW was flat, with a 5-6 percent CPM increase. ABC was down 6%, but saw a 7-8 percent CPM uptick. FOX, suffering from a steep ratings decline for once-mighty American Idol was down 14%, with a 5-7 percent CPM increase.

Discovery‘s Megalodon: The Monster Shark Lives drew the net its highest ratings ever for Shark Week (4.8 million viewers P2+), but faced criticism afterward from viewers angry that the special’s claims weren’t science-based. “People watch Discovery to explore the ‘what-ifs’ of the world,” network spokesperson Laurie Goldberg tells Cynopsis. The special “used a novel storytelling device to engage imagination and curiosity in a way that was disclosed to audiences throughout the program. We have found that people are open to exploring different ideas and concepts in addition to the more traditional fare that we air  that would explain the ratings. As in any entertainment, you aren’t going to always please everyone, but we stand behind all of our content and are proud of it.”

Ready, set… swing? Discovery Fit & Health‘s four-part series, Secret Sex Lives: Swingers follows four couples that lead double lives as swingers. The show “captures the deep internal struggles these couples confront – and the repercussions of exposing their lives to family, close friends and the outside world.” The participants are “certainly not the stereotypes of swinging hippies from the 1970s,” Jon Sechrist, vp of production and development for Discovery Networks International tells Cynopsis. “Also surprising are the lines of communication that each couple share with one another being so open and healthy. I found myself wondering if my own relationships and those of my friends and family are as open and honest.” Show premieres Saturday, September 7 at 10p.

The Paley Center for Media‘s 9th annual PaleyFestPreviews: Fall TV will take place September 6-13 at The Paley Center for Media in Beverly Hills, and on September 7-8 at The Paley Center for Media in New York. Series will feature screenings of new shows; the Calif. location will also have panel discussions with stars and producers, streamed live.

E! News has added Ali Fedotowsky and Jesse Giddings as on-air correspondents. Fedotowsky was season six’s Bachelorette on ABC, and has since worked for Fox 5 in San Diego and NBC‘s 1st Look. Giddings hosted MuchMusic flagship programming.

Tiger who? For the third season finale of golf talker Feherty, host David Feherty interviews Curb Your Enthusiasm‘s Larry David – for what “surprisingly turned out to be the season’s most golf-centric conversation,” per Golf Channel. Ep airs Monday, August 12 at 9p.

Cooking Channel dishes up a little crazy with Food Fanatics With Eden Grinshpan. Traveling cross-country, food enthusiast Grinshpan finds fabulous foodies like a costumed blogger who makes caramelized bass, and Gabe the Fishbabe, a fishmonger who teaches Grinshpan to “eat like a mermaid.” Series premieres Friday, September 13 at 10:30p.

We’ll find out more of what went on behind the scenes of sudsy Beverly Hills 90210 (1990-2000) now that Jason Priestley (Brandon) has inked a deal for a memoir with HarperCollins. Priestley not only acted on the series, but also directed 19 episodes, and won the title of exec producer. Priestley’s eventual rift with series creator Aaron Spelling will also be explored.

Emmy-winning composer Geoff Zanelli will score National Geographic November TV movie Killing Kennedy. Based on a book by Bill O’Reilly and produced by Ridley Scott, the movie stars Rob Lowe and Ginnifer Goodwin.

Bravo will have to settle for its Housewives – the mean girls from Heathers will not be joining the net, which has scrapped plans for a TV reboot of the 1988 coming-of-age black comedy.

~ PRODUCTION & DISTRIBUTION ~

Rashida Jones, who’s leaving NBC’s Parks and Recreation during the sitcom’s season six, is developing a comedy with Parks writer Alexandra Rushfield called Stuck, about a mother and daughter. Jones and writing partner Will McCormack will exec produce for Warner Bros., with a put pilot commitment from Fox. As for Jones’s exit from Parks, “Everyone is happy,” said showrunner Mike Schur at the TCA. “There’s no controversy involved here.” A baby story for Jones and sometime on-screen love interest Rob Lowe, who’s also leaving, “aligned with what the two actors envisioned for themselves and their careers.”

CBS has ordered futuristic Steven Spielberg series Extant for summer 2014, to join Spielberg/Amblin Television‘s Under the Dome. “Our partnership with Amblin for Under the Dome showed that viewers respond to high-quality event programming in the summer,” said CBS Entertainment president Nina Tassler. “We look forward to building on that with Extant.”

Tom Sizemore (Saving Private Ryan) has joined Sundance Channel‘s upcoming gritty drama The Red Road as a drug dealer.

Justin Kirk (Weeds) will star in FX pilot Tyrant. The drama is about an American family sucked into the turmoil of a Middle Eastern nation; Kirk will play a sexy, mysterious American diplomat.

CBS’s The Mentalist is losing Amanda Righetti (Grace Van Pelt) and Owain Yeoman (Wayne Rigsby) at the end of the upcoming sixth season, according to TVLine. “I can neither confirm nor deny,” hedged series creator Bruno Heller of the departures, “but this is the most dramatic and game changing season and anything can happen.”

Tahmoh Penikett (Battlestar Galactica) will guest star on Supernatural as fallen angel Ezekiel. He appears on the CW drama’s premiere on Tuesday, October 8 at 9p.

~ RATINGS ~

President Obama was a ratings draw in late night, giving Tuesday’s Tonight Show With Jay Leno its highest numbers (3.8/10) since his last appearance nine months ago.

ABC Family‘s The Fosters and Bravo‘s Real Housewives of Orange County wrapped their seasons on high notes Monday, with record ratings. Freshman Fosters drew 2.07 million total viewers, a 46% improvement from its June premiere. Housewives won a season high 2.39 million total viewers. 

Tuesday A18-49 Analysis:  NBC led Tuesday night among A18-49 viewers with 2.0/6, according to final primetime national ratings from Nielsen. Univision’s Porque el Amor Manda topped at 8p with 1.6/5, followed by 1.5/5 for FOX’s So You Think You Can Dance. But at 9p the first hour of NBC’s America’s Got Talent grabbed 2.4/7, to a 1.4/4 for Univision’s Tempestad. NBC’s Talent was still going strong at 10p with 2.7/8, versus 1.2/4 for Uni’s Que Bonito Amor.

Agent James Degus is leaving UTA after 19 years to run Bryan Cranston‘s Moon Shot Entertainment. “James is a great guy, a great agent and has been an integral part of UTA,” said managing director Jay Sures. “We’re sad he’s leaving but truly excited for him.”

Nancy Kanter has been bumped up to executive vp original programming and general manager of Disney Junior. “Nancy’s vision for Disney Junior has transformed it into a creative powerhouse for our youngest viewers and their parents,” said president and chief creative officer Gary Marsh, to whom Kanter will report.

Paul Pastor adds to his research responsibilities as he jumps to senior vp of strategy and consumer analytics at Disney/ABC Television Group. Exec vp and SFO Peter Seymor, to whom Pastor will continue to report, lauded Pastor’s “profound strategic insight.”

FOX has promoted Will Somers to vp, network research. Said his new boss, COO Joe Earley, “Will is an incredibly talented and strategic executive who is passionate about understanding and communicating with our viewers.”

~ IN MEMORIAM ~

Captain Kangaroo‘s Cosmo Allegretti, who created and was the voice of puppet characters on the long-running (1955-1992) children’s television show, died on July 26 in Arizona. Alleretti had been working on the show as a set painter when he volunteered to make a replacement for a puppet, and went on to create Mister Moose, Dennis the Apprentice and more. He was 86.
