Al Jazeera America, which launched Tuesday, filed a lawsuit against AT&T’s U-verse after the telecom giant dropped plans to carry the news net. “We could not reach an agreement with the owner that we believed provided value for our customers and our business,” said AT&T spokesman Mark Siegel. Al Jazeera is suing for breach of contract, saying in a statement that AT&T “presented us with circumstances that were untenable – an affiliate has willfully and knowingly breached its contractual obligations.” Al Jazeera had counted on AT&T’s approximately 5 million customers when it paid $500 million for struggling Current TV in January, planning to have its own programming carried by Current’s cable-satellite distributors. Time Warner Cable, which pulled the plug on Current shortly after the sale was announced, is in discussions with the AJA.

About 175 people are being laid off at DisneyABC Television Group, after a review determined that many positions were unnecessary. “As technological advances continue to alter the competitive landscape and viewer habits, it’s incumbent upon us to stay ahead of the curve,” said Disney of the reorg. “We’ve undergone a review of our organizational structure and processes, and have re-imagined and realigned certain areas and functions to gain efficiencies for future growth.” In other words – 2% of the unit will be out of a job.

A federal judge dismissed a suit by investors against Netflix on Tuesday. Plaintiffs alleged the video rental and streaming company misled them about business prospects in 2011, when the company shifted to a streaming business model, but the judge declared that no proof had been produced that showed Netflix had “made any false or misleading statements about the profitability of the streaming business.”

Arts cable network Ovation has partnered with actor James Franco for a series that looks at Franco’s art projects, from gallery exhibits to video diaries. “This is a show where content dictates form and form dictates content,” said Franco, “meaning the show has synched with the rhythms of my life and work.” James Franco Presents premieres this fall  after Franco is roasted on Comedy Central on September 2.

Kris Jenner‘s talk show, Kris, could end its six-week test run on Friday with a ratings boost, as reports circulate that fans will finally get a glimpse of her granddaughter. Kim Kardashian and Kanye West have kept baby North West under wraps since her birth on June 15, but TMZ says Kris will unveil the long-awaited first baby pic on her talker’s finale.

The Great Santini Brothers, about the exploits of a moving company in Brooklyn, promises to tell stories of bizarre and challenging moves in a family business. But bizarre doesn’t always mean bad, say patriarchs George and Joe Sr. “We loved the time a customer said he didn’t have any money to tip us, so he gave us some scratch-offs he had in the house,” the brothers tell Cynopsis. “When we got home that night and scratched it, we actually won 500 bucks!” Series makes its debut on History on Sunday, September 15 at 10p.

Nickelodeon star Lucas Cruikshank, who rose to fame with his Fred Figglehorn videos on YouTube, chose YouTube as the vehicle to announce that he’s gay. “It feels so weird saying it on camera,” he admitted, adding that while his friends and family have known for three year about his sexual orientation, “I just haven’t felt the need to announce it on the Internet.”

Dancing on the Edge, a Starz miniseries set in early 1930s London, depicts the rise to stardom of a group of jazz musicians, inspired by true accounts of the Duke Ellington Band. Premieres Saturday, October 19 at 10p.

Sportsman Channel promises an “unforgettable night of feral pig ferocity” on Aporkalypse Now: The Silence of the Hams. Really! To educate viewers about hog eradication, the program shows legendary rocker Ted Nugent  really! – and Brian “Pig Man” Quaca, host of Pig Man: The Series, attempting to free a Texas farm from an infestation of destructive pigs. “What other network would allow someone to air 455 hog kills in an hour, saving farmers’ and ranchers’ land from devastation? None,” Quaca tells Cynopsis. “Sportsman Channel does a great job promoting our freedoms and the real issues that face Texas and the South – our feral pig epidemic is a perfect example. They are threatening suburbs, cities and causing billions of dollars in damage each year. We’re taking the fight of the feral pig invasion to the air!” Show airs Sunday, August 25 at 8p.

~ CASTING NEWS ~

NBC‘s Community will play host to Jonathan Banks during its fifth season. The Breaking Bad hit man will have a multi-ep arc as an intense professor with a mysterious military past. No premiere date has been set for the sitcom.

Eliza Coupe (Happy Endings) has been cast in The Millers as Nate’s (Will Arnett) ex-wife. CBS sitcom debuts Thursday, October 3 at 8:30p.

Teen bride bombshell Courtney Stodden is joining U.K.’s Celebrity Big Brother, reports E!. Stodden’s 53-year-old husband, actor Dough Hutchison, will not be in the house.

Cole Hauser has been cast on Audience drama Rogue, joining Thandie Newton. Season two premieres in 2014.

Starz drama Power has cast Omari Hardwick (The A-Team) as James St. Patrick, a wealthy New Yorker living a double life as a drug kingpin.

~ PRODUCTION & DEVELOPMENT ~

Fox has been busy. Sitcom Fives has won a script commitment from the net; the project, from writer/EP Shawn Wines, EP Aaron Kaplan and Warner Bros., is about hopelessly average people trying to make it in image-obsessed LA. Fox has also picked up Paroled, from writer Andrea Abbate, 20th TV and 21 Laps/Adelstein, with a put pilot commitment; the sitcom is described as Laverne and Shirley on parole. And Fox came out the winner in a bidding war for A Moody Christmas, an adaptation of an Australian series about a young man’s dysfunctional family.

Hitmaker Claude Kelly (Party in the USA) is working with music publishing’s Jenna Hally Rubenstein to produce a reality show about the search for music moguls.

The CW has picked up a show about an LA performing arts school, from EP’s Sam Haskell and Debbie Allen (Fame).

A TV series based on the action movie franchise Rambo is being developed by Entertainment One and Avi Lerner‘s Nu Image. Sylvester Stallone is in talks to be involved in the project, possibly to reprise his movie role.

Spike TV has ordered ten eps of Hungry Investors, about struggling restaurants competing for a cash investment to help turn things around. Series will premiere in spring 2014.
 

~ RETURNING SERIES ~

Hollywood Game Night will return for a second summer on NBC. The net has ordered 10 episodes of the series for 2014, with Jane Lynch onboard to host again.

TBS is bringing back sitcoms Sullivan & Son and Men at Work for season threes, and reality show Deal With It for a sophomore run. New Sullivans start their run next summer, Men comes back early next year and Deal next year.

~ INTERNATIONAL HAPPENINGS ~

Chinese state broadcaster CCTV has struck a deal with the BBC for 65 hours of TV shows, primarily natural history programs like Giant Otters of the Amazon. “We’ve seen interest in documentaries increase among our Chinese viewers,” said managing director of CCTV Documentary Channel‘s Liu Wen.

Sony Pictures Television and Teleset plan to produce 70 eps of one-hour drama El Mariachi. The show will be produced in Mexico, to air on Sony Entertainment Television in Latin America.

Israel’s version of Bravo franchise Real Housewives, Me ‘usharot, is adding its first male cast member. Hairstylist Philip Vazana, along with his luxury salon, will be featured in season three, scheduled to premiere next spring.

 ~ SYNDICATION NEWS ~

Telco Productions, Inc. is offering a year-end travel show, Smart Destinations: The Best of 2013, featuring locales voted on by Smart Meetings magazine. One-hour special has been cleared 30+ stations so far.

~ EMMY Q & A ~

Mark Burnett is no stranger to Emmy – he brought home a sports trophy for Eco-Challenge in 1999, a primetime award for Survivor in 2001 and daytime honors in 2011 and 2013 for Martha. But History Channel’s The Bible was the first time the reality king, who counts The Apprentice, The Voice and Shark Tank franchises among his achievements, ventured into scripted territory. In addition to shattering History ratings records (the Easter Sunday finale drew 11.7 million viewers), the mini-series is up for three primetime Emmys, including Outstanding Miniseries or Movie. Burnett’s partner in the project was Roma Downey, who exec produced the show with her husband and played Mother Mary; Downey was twice nominated for an Emmy for her role in CBS‘s Touched By an Angel (1994-2003). (Bible EPs also include Richard Bedser, Nancy Dubuc, Dirk Hoogstra and Julian P. Hobbs.) For the couple, the project was a labor of love.

Were you surprised by the nomination?
Burnett:
We had such massive ratings and sometimes that can work against you. I was certainly grateful. I said to Roma, ‘Don’t get your hopes up,’ but I knew not to bet against it.
Downey: I’m a born optimist. I have never worked so hard in my life, emotionally, physically, spiritually. To have the show recognized by our community was so humbling and gratifying. We were in Colorado for a screening and when we woke up and got the call, if there had been a chandelier I would have been swinging on it.

What has been the reaction to the miniseries?
Burnett:
I’ve been doing this a long time, but I have never in my career had so many people come up to me in the street, airport, hotel, at the gym, and privately say, ‘Thank you for making this.’ A nun who runs a small bookstore came over to us and told us a woman had been in her store who hadn’t been to church in thirty years, but she’d just seen the show and asked, ‘Can I buy a bible?'”

What were the biggest challenges of the project?
Downey:
It was a long, complicated process. How do we tell these epic stories, but get the emotional connection to these iconic characters? And parting the Red Sea was a challenge, especially shooting in the desert, in the absence of a sea! If we considered this project our baby, sometimes it was like running across a minefield with our child.

~ RATINGS ~

Lindsay Lohan‘s tell-all with Oprah Winfrey wasn’t a record-breaker for OWN on Sunday. Unlike the talk queen’s interview with disgraced cyclist Lance Armstrong in January, which drew 4.3 million viewers its first night, Lohan’s confessions earned a .66 rating, versus .62 for OWN’s regular Sunday night lineup.

It’s been a hot summer for CNN, according to preliminary Nielsen numbers. Fox News is still the ratings leader with1.85 millions viewers, but that’s down 5% from a year ago. MSNBC is down 22% with 540,000 viewers. CNN is third with 533,000 – a 21% jump. HLN trails with 422,000, a 29% boost year over year.

Adult Swim is touting the fact that summer 2013 will be the first time the net ranked tops among basic cable nets for primetime A18-34 and M18-34. “While we’ve consistently been number one among adults 18-34 in Total Day, Adult Swim only entered the primetime arena in 2011,” Stuart Snyder, president and COO of Adult Swim tells Cynopsis. “To end the summer now claiming the number one spot in primetime with this demo is a great testament to the continued growth of Adult Swim.”

Tuesday A18-49 Analysis:  NBC led Tuesday night among A18-49 viewers with 1.8/6, according to final primetime national ratings from Nielsen. Univision’s Porque el Amor Manda topped the 8p hour with 1.6/5, followed by 1.4/5 for FOX’s So You Think You Can Dance. At 9p NBC’s America’s Got Talent grabbed 2.0/6, leaving Univision’s Tempestad and ABC’s Extreme Weight Loss to tie for second with 1.4/4. NBC’s Talent held onto the 10p hour with 2.5/8, against 1.3/4 Univision scored for Que Bonito Amor.

Anne-Marie McGintee and Chris Markey have been selected to run David Janollari Entertainment as VP’s of Development. “Anne-Marie and Chris are two of the most creative and passionate young executives I have encountered in a long time in this business,” said Janollari.

Radio Disney snatched up Lance Washington to serve as an account exec in LA.

Production company The Company named Jason Henry its Senior VP Unscripted Development. “Jason has an incomparable track record of creating shows that attract big audiences to unexpected and entertaining content,” said CEO Charlie Ebersol.

~ IN MEMORIAM ~

Veteran TV and film director Ted Post (Magnum Force, Gunsmoke, Rawhide) died August 20. He was 95. A former teacher at NYC’s famed High School of Performing Arts, Post started his career as a theater usher. He is survived by his wife of 72 years, Thelma.
