~ MORE GOOD STUFF ~

A stalemate continues between Fox Networks and Cablevision Systems regarding their retransmission-consent agreement. Both parties have not spoken to each other since last Thursday. Late on Friday, Fox declared Cablevision should issue rebates to all of its subscribers for the lost programming during the dispute in addition to this statement also on Friday:

“For the past eight days Cablevision has deprived their subscribers of the National League Championship Series, possibly two weekends of NFL on FOX, and a full week of FOX’s primetime shows.
“Unfortunately, it’s becoming clear that Cablevision believes FOX has very limited value to their customers. We urge those Cablevision subscribers who want to see the World Series (beginning October 27) to switch providers or purchase an over the air antenna now.”

Furthermore, the FCC stepped into the fray and asked both Cablevision and Fox to explain by today if their negotiations process has been done “in good faith” which is required by law. The FCC asked each side to produce any evidence against the other party if they have it. In a letter to News Corp. President Chase Carey and to Cablevision President James Dolan, FCC Media Bureau Chief Bill Lake asked each side to describe

“… what has transpired since you initially began your negotiations, and detail the efforts your company is making to end the current impasse. As you know, your contract dispute extends beyond just Fox and Cablevision. Indeed, it affects millions of innocent consumers who expect to watch their preferred broadcast programming without interruption. We urge you to place the interests of these consumers first and conclude your negotiations promptly.”

Charles Schueler, Cablevision’s EVP/Communications also issued a statement on Friday afternoon:

“We welcome the FCC’s intervention.Whether through FCC action, binding arbitration or any other means, the time has come for News Corp to end the Fox blackout of 3 million Cablevision households.”

Fox had no specific comment on the FCC’s request though did say, “We will respond directly to the FCC.”

The CW handed full season, back nine episode orders to two of its newest series Hellcats and Nikita, in addition to One Tree Hill presently in its eighth season. Hellcats, produced by Bonanza Productions Inc. with Tom Welling Productions, Warner Bros. Television and CBS Television Studios has upped The CW’s Wednesday 9-10p time period by +80% among W18-34 with an average of 1.8/5; +100% among A18-34 at 1.2/4; and +126% in total viewers at 2.5 million. Nikita, from Warner Bros. Television in association with Wonderland Sound and Vision, is now the second most-watched program on The CW at 3.6 million total viewers, behind The Vampire Diaries. One Tree Hill is produced by Mastermind Laboratories and Tollin/Robbins Productions in association with Warner Bros. Television.

Beginning Tuesday, Military Channel opens a new 12-part series Missions That Changed the War at 9p. Narrated by Gary Sinise, the series explores the battles, covert operations and soldiers involved in WWII. The series is divided into three separate four-hour miniseries starting with The Doolittle Raid airing October 26-November 16 at 9p; Germany’s Last Ace airing from January 18-February 8 at 9p; and The Flying Tigers airing from April 12-May 3 at 9p. The entire series, Missions That Changed the War is produced by Sleeping Dog Productions, Inc. for Military Channel.

Last Thursday’s second season finale of MTV’s Jersey Shore delivered 6.1 million total viewers, ending higher than the show’s opening episode in July which drew in 5.3 million total viewers. The season conclusion also scored a 6.1 rating among Persons 12-34. MTV will debut season three of Jersey Shore on January 6 and the new season will return to Seaside Heights, NJ.

~ DISTRIBUTION, CLEARANCE & CARRIAGE ~

Eclipse TV is partnering with Carson International and is bringing back eight Incredible Dog Challenge one-hour competition shows for 2011. The shows will be produced for the first time in hi-def and will air in two-month syndication windows from April through October.

~  PRODUCTION & DEVELOPMENT ~

Syfy is working on a new two-hour pilot which is part of the Battlestar Galactica franchise titled Battlestar Galactica: Blood & Chrome from executive producer David Eick and Universal Cable Productions. The pilot is set in the 10th year of the first Cylon war, with action fitting in between the original Battlestar Galactica series and its prequel Caprica. Battlestar Galactica: Blood & Chrome also reintroduces viewers to the character, Ensign William Adama, who has recently graduated from the Academy and finds himself assigned to the newest battlestar in the Colonial fleet, the Galactica.

~ RATINGS ~

Thursday  A18-49 Analysis: FOX conquered the competition Thursday night among A18-49 at 3.5/10, according to final national ratings from Nielsen. At 8p, CBS’ comedies The Big Bang Theory and $#*! My Dad Says averaged a 3.6/11 in first place while FOX’s MLB NLCS Game 5 was #2 at 2.8/9. ABC had a turn on top with Grey’s Anatomy during 9p with 4.0/11 and FOX was #2 again with more MLB NLCS Game 5 action at 3.5/9 with CBS’ CSI just a tenth of a rating point behind at 3.4/9. FOX turned everything its way with the final of the MLB NLCS Game 5 at 4.1/11 and CBS’ The Mentalist came in second with 2.9/8 followed closely with ABC’s Private Practice in third at 2.7/8.

~ EXECUTIVE MOVES ~

In light of Tribune Company’s CEO, Randy Michaels’ resignation, effective immediately, Tribune said its board of directors has formed an Executive Council to take on the duties of the Office of the Chief Executive/President and to supervise the publishing and broadcast operations. The Executive Council, who reports directly to Tribune’s board of directors, includes Don Liebentritt, Tribune’s Chief Restructuring Officer; Nils Larsen, Tribune’s CIO; Tony Hunter, President, Publisher/CEO of Chicago Tribune Company; and Eddy Hartenstein, Publisher/CEO of Los Angeles Times Communications, Inc. Furthermore, Nils Larsen will become Chairman/Tribune Broadcasting. Jerry Kersting, Tribune Broadcasting President will work in tandem with the Executive Council and will continue to oversee the company’s broadcast operations including 23 television stations, cable network WGN America and WGN Radio. Additionally, Gerry Spector, COO will report directly to the Executive Council.

Effective immediately, Tom Siebert has relocated to San Diego to become VP/Communications at the full-service interactive marketing company, Digitaria. Most recently, Tom was with Brooklyn, NY-based HUGE as Director/Communications.

Clear Channel Outdoor Holdings, Inc. named Susan Adams Loyd as Branch President of its Minneapolis/St. Paul Division beginning November 9, 2010. In her new role, Susan will oversee company inventory for the Minneapolis/St. Paul Division. She will report to Rod Firestone, Midwest Group President, Clear Channel Outdoor Holdings, Inc.

Beth Burke has begun a new position at Meetinghouse Productions as VP/Lifestyle Programming and Development. Prior to this appointment, Beth was Director/Programming for Food Network and HGTV.

Anita Helt was tapped as President/GM within Gannett’s Broadcasting Division to head KXTV/Sacramento. Anita has been with Gannett Broadcasting for 15 years and before this new position was VP/Marketing and Programming at KPNX/Phoenix, Gannett’s NBC affiliate.
