Good morning.  It’s Monday, October 17, 2005, and this is your first early morning briefing. 

Industry unions SAG, AFTRA, WGA west, WGA east and DGA have all come together in their call for their union members to receive a proper cut of the revenues generated from selling television shows to iPod Video users.  In a joint statement released by the union heads, they said they had not yet head from ABC who owns the shows thus far being distributed/sold to iPod users, but that they “look forward to a dialogue that ensures that our members are properly compensated for this exploitation of their work.”  In response, ABC/Disney issued a statement reading in part “The guilds are our business partners, and we always welcome a dialogue with them on any business-related issue that affects their members.” 

NBC has ordered a full season of its new Monday night series Surface (NBC Universal Television).  Since its September 19th premiere, Surface has averaged a 3.3/9 A18-49 rating.

NBC Universal is back kicking DreamWorks tires, despite DreamWorks called a halt to the acquisition negotiations over three weeks ago.  According to Hollywood Reporter, NBC made a new offer just last Friday.  NBC’s original offer, declined by DreamWorks, was for $1 billion plus $500 million in debt.  Meanwhile, Viacom may be getting in the act with a round of exploratory chats with the studio, tho no concrete offer has been made. 

* MORE GOOD STUFF *

A bill proposed by the Senate Commerce Committee has set the deadline – April 7, 2009.  On that date, analog TV goes dark, and we’ll all be watching digital-only television.  What is not included in the bill is whether cable MSOs must carry multiple digital channels provided by local TV stations.  The Senate has set October 19 (which may reportedly be changed to October 20) for a hearing.

With Microsoft’s launch of Microsoft Windows XP Media Center Edition 2005, users with an Xbox 360 game console or a Media Center Extender, will be able to watch television and play video games without every moving, switching seamlessly between regular TV video and on-demand broadband programming.  Joining the launch is MTV Networks broadband channels MTV Overdrive, VH1’s VSpot, Comedy Central’s soon to launch broadband channel and mtvU broadband early next year.  Also joining Microsoft will be ABC Family Channel. Users with the Online Spotlight feature in Windows XP Media Center Edition 2005 with Update Rollup 2 on Media Center PC will have access to ABC Family’s original series Wildfire, 13 Nights of Halloween and 25 Days of Christmas as well as other exclusive content and services.

Several reports indicate ABC/ESPN will take over the NASCAR deal from NBC/TNT beginning with the 2007 season.  NBC/TNT carried half of the NASCAR 36-race season schedule, with Fox picking up the other half.  While no formal announcement has been made, it could come as early as today.

USA Network has picked up three feature films The 40-Year Old Virgin, Skeleton Key and Serenity, all distributed by NBC Universal Domestic.  40-Year Old Virgin goes to USA in July 2008, while Skeleton Key arrives in May of the same year.  Serenity, the Joss Whedon film that is a continuation of his TV series Firefly, will likely go to Sci Fi Channel.  A broadcast partner for the film trio may also be added to the deal.

  * NEW ORDERS / CASTING / DEVELOPMENT / PRODUCTION *

NBC has ordered 13 episodes of new 60m drama project from Aaron Sorkin and Thomas Schlamme,and produced by Warner Bros. TV. Studio 7 on the Sunset Strip is a behind-the-scenes look into the world of late night network programming, a la Saturday Night Live.  (This project should not be confused with another from Endeavor and Lorne Michaels with Tina Fey, which is also set behind the scenes of a sketch comedy show.)  The project comes with a sizable seven-figure penalty if it does not get beyond the pilot phase.  NBC also has agreed to pay a licensing fee for the series at $2 million per episode, and the show must air at either 9p or 10p, any night between Monday and Thursday.  If all of this seems a little over the top, remember Sorkin and Schlamme are the guys behind West Wing.

* EXECUTIVE MOVES *

Vicky L. Free has joined Turner Network Television as VP/Entertainment Marketing.   Vicky is responsible for building consumer marketing for TNT’s dramatic programming. She is based in Atlanta and reports to Tom Carr, SVP/Marketing.

Michael Klein has has joined RLR Associates as Director/Business Development.  Michael’s will secure and negotiate marketing and broadcasting assignments for RLR’s clients. 

* RATINGS *Thursday — A18-49 Analysis:  CBS was in front on Thursday night with a 7.8/21 A18-49, according to final numbers from Nielsen Media Research.  NBC was #2 with a 4.7/12, followed by Fox 2.8/8, WB 2.1/6, ABC 2.0/5, UPN 1.7/5.  At 8p Survivor pulled in a healthy 6.5/18, with NBC ranking #2 for the hour. At 9p CSI dusted the competition with a 10.0/25, with The Apprentice pulling in a 4.6/11.  At 10p Without a Trace for the second week beat ER, this time with a 6.7/18 over ER’s 6.1/16.  Overall the NLCS Game #2 on Fox drew a 3.1/9, ending at 11:33p.

Friday — A18-49 Analysis:   CBS led Friday night by a skosh – one tenth of a rating point over Fox – according to fast affiliate ratings from Nielsen Media Research.  Remember, fast affiliate ratings measures time periods only, not programs.  With sports programming in particular this is an important distinction because the game probably ran beyond 11pm, and the ratings will likely not accurately reflect the delivery of the game across time zones.  At 8p ABC’s Supernanny and CBS’ Ghost Whisperer duked it out, with ABC coming out on top by a tenth of a rating point with a 2.3/8 over CBS.  At 9p viewers caught on to the game on Fox and that led the hour with a 2.5/8 over CBS and NBC tied at a 2.2/7. At 10p CBS’ Numb3rs won with a 3.0/9, though tied in share with Fox’s 2.8/9 for the game.
