Over the weekend, Fox Networks and Cablevision Systems reached an accord in principle on a new distribution agreement providing 3 million plus households with programming from WNYW FOX 5 and WWOR My9 in New York, WTXF FOX29 in Philadelphia and the cable channels FOX Deportes, FOX Business Network and Nat Geo WILD. The FOX stations and cable channels were back in business for Cablevision subscribers on Saturday just before the first pitch of World Series Game 3 on FOX. Terms of the agreement were not disclosed. On Saturday, Cablevision released this statement:

“In the absence of any meaningful action from the FCC,Cablevision has agreed to pay Fox an unfair price for multiple channels of its programming including many in which our customers have little or no interest. Cablevision conceded because it does not think its customers should any longer be denied the Fox programs they wish to see.
“Cablevision thanks its customers for understanding the reasons for the dispute and for staying with us. We are also grateful to the 175 government leaders who raised their voices to urge government intervention and binding arbitration to prevent this blackout. It is clear the retransmission consent system is badly broken and needs to be fixed.
“In the end, our customers will pay more than they should for Fox programming, but less than they would have if we had accepted the unprecedented rates News Corp. was demanding when they pulled their channels off Cablevision.”

~ MORE GOOD STUFF ~

MGM’s creditors agreed on a reorganization plan which excludes billionaire Carl Icahn. Rather than selling their debt to Icahn, the creditors instead moved MGM into Chapter 11 bankruptcy. The vote happened following Icahn’s two separate offers to purchase MGM debt in an effort to merge the company with Lionsgate where he is the majority stakeholder. If Icahn had been allowed to buy up the debt, he would have tallied a 51% share of MGM and been in a position to force the merger. Last week, a lawsuit was filed against Icahn by Lionsgate in New York Federal Court claiming he has been playing a “double game” with Lionsgate and MGM. During its bankruptcy plan, MGM will have approximately a month to reorganize resulting with its $4 billion in debt turned into equity. Gary Barber and Roger Birnbaum of Spyglass Entertainment will now head MGM. MGM released this statement:

“Metro-Goldwyn-Mayer Inc. (“MGM”) today announced that the secured lenders voting in the Company’s solicitation process have overwhelmingly approved its proposed plan of reorganization (“Plan”). MGM will now move expeditiously to implement that Plan, which will dramatically reduce its debt load and put the Company in a strong position to execute its business strategy. MGM is appreciative of the lenders’ support.”
