Good morning. It’s Monday, November 1, 2004, and this is your first early morning briefing.

Thursday was the usual race between CBS and NBC and this time, again, CBS won with an overall 8.4/22 A18-49 rating according to final national data from Nielsen Media Research.  NBC’s evening of primarily reruns tallied up a 6.0/16 in the demo, with each of the remaining nets hardly in the race.  At 8pm Survivor on CBS delivered a 7.4/21, well ahead of repeats of Joey (4.1/12) and Will & Grace (4.6/12).  At 9p CSI’s 10.4/25 was six share points ahead of NBC’s The Apprentice (7.7/19).  And at 10p an original airing of Without a Trace on CBS well surpassed a repeat of ER on NBC, 7.5/20 vs. 5.9/16.

Like night and day, the difference between Thursday and Friday.  The ‘big’ winner for the night was NBC with a 2.8/9 A18-49, followed by ABC’s 2.5/8, CBS 1.9/6, WB and Fox tied at 1.3/4, UPN 1.1/4 according to fast national ratings from Nielsen Media Research. At 8pm ABC and NBC, each posting an 8 share for the hour, CBS was close behind with a 1.9/7. NBC stepped it up a notch at 9pm with a 3.0/10 for Third Watch, while ABC’s 9-10p sitcoms earned a 2.4/8.  At 10p NBC’s newest drama series Medical Investigation continues to lead the hour with a 3.4/11, followed by ABC’s 20/20 (2.6/8) and struggling on CBS is dr. vegas with a 1.9/6.

ABC overstepped Fox’s bounds on a Saturday night – doesn’t happen too often, despite a house full of reruns on Fox.  ABC’s 2.8/9 A18-49 rating led according to data from Nielsen Media Research, beating Fox’s 2.2/7, CBS 1.9/5 and NBC 1.7/5.  At 8pm the first hour of ABC’s movie earned a 2.5/9, ahead of Fox’s back to back Cops repeats (2.1/8) and 48 Hours on CBS (1.7/6). The Halloween specials on NBC at 8p and 9p earned a 1.3/4 and 1.4/4 respectively.  ABC’s second hour of Monsters Inc. won the 9p hour as well with a 3.0/9, in addition to the 10p hour with a repeat of Desperate Housewives (2.8/9).

Additional Orders:

  • ABC is moving ahead with its season’s orders with a full season of Wife Swap, 9 more scripts for Rodney (airs Tuesdays at 930pm) and 6 more scripts for Friday nights 830p newbie Complete Savages.   As for Wife Swap, the series will have 22 eps for the season, as well as two specials – Boss Swap and Husband Swap.
  • WB has ordered up four more scripts of The Mountain which just recently moved to Sunday nights.
  • CBS has also ordered more scripts of two of its newest contenders – dr. vegas and Clubhouse will each present 2 more scripts.
  • UPN has ordered four more scripts for both Veronica Mars and Kevin Hill, and three more scripts for Second Time Around.

Meanwhile Fox has decided not to go forward with its reality show The Partner, originally scheduled to launch this month, according to Variety. The show, a la Apprentice, was to have several lawyers all vying for a partner job in a prestigious law firm (Rocket Science Laboratories).  Fox’s website still has the show as premiering on November 7. Rocket Science also produces My Big Fat Obnoxious Boss which will air on Fox in November, Sundays at 9p beginning November 7. Other new reality programs scheduled to kick off on Fox this month are Nanny 911 (Wed at 9p starting 11/3) and The Rebel Billionaire: Branson’s Quest for the Best (Tues at 8p as of 11/9)

One day before Election Day and all the focus is appropriately on the election. Tomorrow night’s primetime coverage will be basically wall to wall election news on the Big 4 broadcasters as well as PBS, and the three 24/7 cable news nets, with coverage also planned from the Spanish-language networks, MTV, BET and coverage from Jon Stewart on Comedy Central’s Indecision 2004.  Meanwhile, if you’re out and about tomorrow evening, say at Wal-Mart, you can count on PRN Corp’s Premiere Retail Networks to supply election updates on monitors throughout the store.  PRN has worked out a deal with Fox News Channel to bring the FNC coverage to Wal-Mart shoppers.  With no one wishing to be the network nailed this time for announcing the wrong winners, it’s entirely likely this election won’t have an announced winner by the time coverage concludes Tuesday night. 

Meanwhile over in the Pappas camp … remember the item last week that Pappas TV has gifted $325,000 of free air time to California Republican party to be used on the candidates of their choosing?  The FCC apparently does not agree that this is beyond the scope of equal time rule and says Pappas must not bring this kind of free airtime to class, unless it plans to share with everybody, including the Democratic party. The FCC order read in part: “The commission has ruled that when a candidate is furnished time at no cost, competing candidates are entitled to receive the same amount of free time in comparable time periods.”

Casting / Development / Production:

  • More divorce on CBS – last week’s news was a new sitcom about a pair of divorcing couples – one a nice divorce, the other not so nice (20th producing, Rich Appel writer/producer).  This week comes news of another divorcee sitcom – this one about a divorced woman/businesswoman/single mom now living with her brother, dealing with daughter’s new stepmother and all that life brings. Writer/producer is Kari Lizer, per Hollywood Reporter.
  • More divorce – Fox has ordered a script of a project from 25C Prods called Unhitched, set in the world of divorce lawyers.
  • WB has ordered a put pilot of a drama project that when it first made the rounds in 2002 was called Spy Girl (Warner Bros. TV/25C Prods). The project is based on Amy Grey’s Spygirl: True Adventures from My Life as a Private Eye, about a 20-something detective. Certainly targeting the WB demographic with a 20-something heroine, the pilot will also be written by Dawson Creek’s Maggie Friedman. 
  • ABC has signed David Boreanaz to star in its newest drama project based on the life and times of Jack Ballantine, undercover cop in the world of hired assassins (Warner Bros. TV/Tannenbaum Co.), per Hollywood Reporter.
  • Fox is developing a drama series based on the best selling books by author Kathy Reichs, per Variety. The stories focus on a forensic anthropologist, who with her group of scientists, can help law enforcement uncover clues of cases from skeletal remains. The project from 20th, will be exec produced by Barry Josephson and writer Hart Hanson, who will also write the script. Fox has ordered a script with penalty.

Evening Post Publishing has agreed to pony up $67.5 million for New Vision Television‘s station KSBY/Santa Barbara in a deal brokered by Kalil & Co. The purchase is subject to FCC approval and is expected to close first quarter next year.

Eric Lazar has been upped from NSM for Sinclair’s Milwaukee, Oklahoma City to Regional NSM, adding WSTR/Cincinnati to his responsibilities.

Audrey Steele has been upped to SVP/Sales Research and Marketing for FOX Broadcasting Company. The upping was announced by Jon Nesvig, President/Sales for Fox, to whom she will report. Audrey will continue to be responsible for marketing FOX’s Sales and Programming strategy to the advertising community through development of sales positioning, materials and primary research.
