Good morning, it’s Monday, November 12, 2007 and this is your first early morning digital briefing.

The FCC is planning to impose new rules to open up cable television platforms to independent programmers and rival video services, according to The New York Times. New regulations, which could come into play if cable is found to be available and subscribed to in 70% of U.S. homes, could lower the cost of entry for new programming services and force cable to un-bundle its channels, long a goal of FCC chairman Kevin Martin. The commission, which is expected to propose a relaxation in media cross ownership regulations this week, is also circulating a plan that would limit large MSOs from controlling more than 30% of the market.

~ MULTIPLATFORM CONTENT NEWS ~

NBC.com kicked off its NBC Direct download service offering free ad-supported episodes of shows such as The Office, Heroes, Life, Bionic Woman, 30 Rock and Friday Night Lights. The NBC Direct player can be set to schedule weekly downloads of shows, but the videos can only be viewed on the computer that downloaded them.  So far the service supports only Windows PCs running the latest Internet Explorer browser.

ABC.com
will start streaming mini 2-3 minute webisodes of Lost this week originally intended to debut on Verizon Wireless, according to EW.com. The “Missing Pieces,” penned by Lost writers under a separate arrangement before the strike began, will reveal previously unknown backstories of the survivors of flight 815. The bigger screen version of Lost is still scheduled to begin its fourth season in February. ABC.com users have started 160 million full-length episodes since the site began offering them for free last year while a total of 33 million ABC shows have been downloaded via iTunes so far, per Disney CEO Bob Iger’s conference call to analysts last week.

Warner Bros. Television is in negotiations to offer a range of its library content to the News Corp./NBC Universal Hulu joint venture, according to The Hollywood Reporter.

It’s Cynopsis Broadcast Calendar time!  We only have 2500, so they are only available on a first-come-first-served basis.  You can order a max of 10 – but you’ll need to do it right away.  Last year these went fast and furious!  To order your 2008 broadcast calendars, email your name, full mailing address and phone number, to Joanne Flamini at [email protected] with BCST CALENDAR in the subject line.  Please, no calls.  If you don’t hear from us, you can expect to get your calendar within the next 3-4 weeks.

~ INNOVATORS & START-UPS ~

MySpace‘s first original series Quarterlife debuted yesterday, the first of 36 8-minute episodes that will premiere every Sunday and Thursday night on its profile page as well as on MySpaceTV. The series, about a group of twentysomethings trying to figure out what to do with their lives a few years out of college, has its roots as an ABC TV pilot co-written and directed by Marshall Herkovitz called “1/4life” that failed to get picked up in 2005. MySpace has pledged to serve banner ads for the show on more than 500 million MySpace pages.

My Damn Channel will launch two new episodic series this month on its new Big Fat Brain Channel from the minds of Troy Hitch and Matt Bledsoe. In “Itty Bitty Liddy” a miniature G.Gordon Liddy is ordered to break into Dennis Kuchinich’s headquarters to plant “un-liberal” material. “Tim After Tim” puts a comedic twist on the familiar time travel storyline from shows such as NBC’s Journeyman.

Music streaming/social networking service imeem struck a licensing agreement with Canada’s Nettwerk Music Group clearing the way for imeem to offer its users ad supported music from its entire catalog including Avril Lavigne, Barenaked Ladies, Dido, Sum 41, and Sarah McLachlan.

A new service called BlinkBox launched in beta format offering movies and TV shows for viewing, rental and download to own. The service allows users to clip “blinks” or snippets of content to share with others, typing comments directly in the clip. Sounds perfect for snarky remarks.

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

Facebook’s new ad network could run into legal troubles in New York State according to a New York Times report. A 104-year old statute prohibits advertisers from using photos, drawings or other likenesses of people without their express written consent. So the question becomes, does opting in when registering count as giving permission?

Google
still plans to bid on the 700 mHz spectrum up for auction soon by the FCC, according to reports, even though it has secured distribution of its mobile platform through an alliance of partners including T-Mobile and Sprint.

Dolby Labs acquired Coding Technologies AB for approximately $250 million. The privately held company specializes in audio compression for mobile, digital broadcast and internet media applications.

~ DIGITAL ADVERTISING ~

Dentsu America is enlisting the talents of some of the web’s best known videographers in The Battle of the Viral Video Superstars campaign for Canon to promote its HG10 HD camcorder. The Amazing Falcons team led by Gary “Numa Numa” Broisma is competing against Team Wolf including Ben “Obama Girl” Relles to come up with the funniest viral video.

~ TRENDS, RESEARCH, ETC.  ~

Radiohead and Warner Bros. Records are disputing comScore‘s research that determines less than 40% of users who downloaded the In Rainbows album actually paid for it, calling it “purely speculative” as it was based on only a couple of hundred users. comScore defended its methodology on its blog, saying it observed the activity of nearly 1,000 visitors to the In Rainbows site, a “significant percentage of whom” downloaded the album.

~ EXECUTIVE MOVES ~

Fox Interactive Media upped Peer Schneider to SVP & Publisher of IGN Entertainment, the company he helped to found in 1998. In his new role, he will continue to oversee content strategy, editorial coverage and product development, reporting to Roy Bahat, GM of IGN Entertainment in Los Angeles.

Ted Utz was named Director of Local Ad Sales for the CBS Television Stations Digital Media Group. Ted will work directly with local sales teams at each of CBS’ 29 stations as well as the CBS Spot Sales team on internet and wireless sales initiatives, reporting to President and GM Jonathan Leess and SVP/Ad Sales and Business Development Aaron Radin.

~ WEBSITE OF THE DAY ~

The History Channel’s History.com launched a new feature in time for Veteran’s Day that wouldn’t have possible in previous wars. Band of Bloggers features text and video posts from a growing list of soldiers who use camcorders and mobile phones to post their stories directly to the web. It’s interesting to compare and contrast unfiltered “soldier generated content” with those shot for the Department of Defense or from “embedded” journalist reports issued earlier on in the war.
