Good morning. It’s Monday, August 13, 2007 and this is your first early morning briefing. 

Following a review of facts, the Federal Communications Commission has levied a $12,000 fine against San Diego’s KSWB for “apparently willfully and repeatedly” breaching the FCC’s kid’s TV commercials limits, per Broadcasting & Cable.  According to the FCC, KSWB provided information about all four of its violations, which took place between April 2002 – October 2003, in its summer 2006 application for license renewal: one was 90 seconds, two were referred to as “program-length commercials,” and all three KSWB concluded were caused by human error.  In the fourth incident (fall 2002), KSWB ran a WB Network commercial for the Nintendo GameBoy E-Reader, during a Pokemon episode.  KSWB said that it had not been warned about the ad, and it unaware of the error until after it aired and the WB told them.  According to the current FCC rules, no more than 10.5 minutes per hour of commercial content can air during kid specific programming on weekends and 12 minutes per hour on weekdays.

Also on Friday, the FCC issued letters to WZMY-TV in Derry, New Hampshire and WSPX-TV, Syracuse, NY stating “we ADMONISH you for the admitted violation,” of the rule requiring stations to “provide to publishers of program guides, information identifying programming specifically designed to educate and inform children, including an indication of the age group for which the program is intended.”  No fines were issued in either of these matters.

How do food and beverage companies market to kids and teens?  That is what the Federal Trade Commission wants to know, and in detail too, as it prepares a report on the topic for Congress, according to AdAge.  In an effort to get the nitty gritty strategic details, the FTC has issued subpoenas to 44 food/beverage companies including Burger King, Cadbury Schweppes, California Milk Advisory Board, Campbell Soup, Dole, General Mills, Kellogg, Kraft, Proctor & Gamble, among others.  The subpoenas were expected, though it was unclear exactly which companies and industries would receive them.  The companies have 90 days to provide the FTC with the information requested.

NEW PRODUCTION & DEVELOPMENT

Zonemedia has begun work on a new kid-centric UK channel called Zone Superheroes, per Broadcast Now.  Though there has been no formal announcement, Zonemedia is reportedly looking to acquire rights to a various animated series.  Additionally, Ofcom, the UK broadcast governing body, has granted Zonemedia a license.  Zonemedia’s cable satellite channels (Zone Fantasy, Zone Reality, Zone Horror etc.) are available in the UK on Sky.  Zonemedia is unit of Chellomedia, which in turn is division of Liberty Global.

MORE KIDS STUFF

Discovery Kids brings its series Flight 29 Down to a close in a two-hour movie premiering Saturday, August 25, 2007, 8-10p.  Fans can expect the Flight 29 Down movie to tie-up pesky loose ends and unfinished business.  On the same day leading into the series finale, the network will feature a marathon of all the episodes from the second season, 1p-8p.  Additionally, now through August 24 Discovery Kids is airing back-to-back episodes from season one and two of Flight 29 Down, weekdays 8-9p.  The series is a co-production of Discovery Kids and Stan Rogow Productions in association with Hawaii Film Partners.

Elsewhere in Flight 29 Down news … Showcase Entertainment recently licensed their live-action kids adventure series, Flight 29 Down (30×30) to Astral Media‘s Family Channel in Canada.  The first season has already begun airing on Saturday and Sunday evenings, leading up to a series finale in the fall. The show follows the adventures of a group of kids who crash land on a deserted island and must learn to survive the elements and each other.

Weston Woods Studios has launched a new line of digital audiobooks for K3-8 on Playaway, which specializes in pre-loaded digital audio.  Narrated by celebrities, the initial 12 audiobooks will be released in libraries and schools nationwide by the end of September.  Each audiobook comes pre-loaded with several stories narrated by celebrities.  Users can hear the content by plugging in the provided earbuds.  Additionally, the Playaway audiobooks allow the listener to slow down or speed up the narrator’s voice.  Weston Woods is a division of Scholastic.  Celebrity narrators include:  Sarah Jessica Parker and Meryl Streep in Owen and Other Stories by Kevin Henkes, and Forest Whitaker in Inspiring Figures: Jazz Greats.

MARKETING/LICENSING

Electronic Arts and Hasbro have entered into a multi-year casual gaming licensing agreement.  The deal grants EA the exclusive global rights to create digital games based on Hasbro’s properties, such as Monopoly, Scrabble, Nerf and Littlest Pet Shop, among others.  EA will develop interactive aimed at families across multiple gaming platforms. The first games are scheduled to launch in calendar year 2008.  The initial term of the pact runs through 2013, with the option to extend it for an additional four years subject to a number of conditions.  EA’s Chip Lange will lead the overall Hasbro business initiative as VP and GM, while Hasbro SVP, Mark Blecher will head up Hasbro’s digital gaming efforts.

EXECUTIVE MOVES

Codemasters has opened the doors to Codemasters Studios Guildford, its second UK development studio.  Based in surrey, Studios Guildford joins Codemasters’ existing development facilities Studios Southam and Studios Kuala Lumpur.  Adrian Bolton has been appointed Studio Manager, Codemasters Studios Guildford.  He was previously Development Director, EA Criterion.  Bolton will report to Gavin Cheshire, VP/Codemasters Studios.
