~ MORE GOOD STUFF ~

Between Cablevision Systems and Fox Networks all appeared quiet on Thursday with their ongoing retransmission-consent dispute with one exception: a lawsuit was filed against Cablevision by customers in New York. A group of Cablevision customers in New York filed a class action lawsuit in federal court saying the company owes them approximately $450 million for the loss of FOX programming on behalf of the 3 million New York area subscribers. Cablevision issued this statement following the news of the filing:

“News Corp. is the company that deserves a lawsuit, for blacking out the World Series in three million New York-area homes. The FCC has all the facts and our customers are demanding that the FCC act to end the FOX blackout.”

Late yesterday, Fox provided this response to “Cablevision’s inducement to violate the Copyright Act”:

“It is alarming that Cablevision would put non-profits and governmental bodies at risk by encouraging them to violate the Copyright Act in order to gain a commercial advantage. The obscure provision of the Copyright Act that Cablevision cites is for boosting over the air signals to rural areas for reception with an antenna — nothing resembling internet streaming.

“Further, the provision cited prohibits any transmission for ‘any purpose of direct or indirect commercial advantage.’  Clearly, this is the case and we remind Cablevision that inducing others to violate the Copyright Act is in itself a violation of the law.”

Yesterday, Lionsgate filed a lawsuit against Carl Icahn saying he was operating a “double game” by publicly opposing a merger with MGM while at the same time stockpiling stake in MGM’s debt. Lionsgate’s suit was filed in federal court in New York. Previously, Icahn filed lawsuits against Lionsgate in New York and Canada regarding Lionsgate’s debt-to-equity transaction this summer that lowered Icahn’s stake from 38% to 33.5% while increasing Lionsgate’s largest shareholder Mark Rachesky’s from 19% to 29%.

HBO’s announced its drama series Big Love will be back for a fifth season on January 16 — but more importantly perhaps, that this will be it’s final season.  The series is produced by HBO Entertainment in association with Playtone and Anima Sola Productions.

CBS scheduled the premiere date for its new reality competition series Live to Dance on January 4 with a two-hour debut episode. The new Paula Abdul-starring reality series may end up going toe-to-toe with Abdul’s former series, FOX’s American Idol as it launches its tenth season the same month.

A&E Network premieres the new original real-life series The Peacemaker: L.A. Gang Wars on December 16 at 10p with two back-to-back episodes. The five-episode, half-hour series follows gang mediator Malik Spellman as he offers mediation between rival gangs in South Central Los Angeles. The series is produced by OOG Productions for A&E.

CBS’ new daytime talk show, The Talk released premiere week ratings results for the week ending October 22. Nationally, The Talk posted a 1.6/06 and 2.14 million total viewers; 1.0/07 among W25-54; 0.8/05 with W18-49; and 0.5/04 with W18-34.

Investigation Discovery gave its series On the Case with Paula Zahn an early nod for a fourth season. The series premieres its third season with 13 episodes on November 7 at 10p. The upcoming fourth season will bow in first quarter 2011. Scott Sternberg Productions and Weinberger Media produce the series for Investigation Discovery and executive producers include Paula Zahn, Scott Sternberg and Scott Weinberger.

Estrella TV is adding four new shows to its lineup:

  • El Humor de Hector Suarez – Well-known actor/comedian Hector Suarez stars in his own weekly comedy series that airs Saturdays at 6p.
  • Estrellitas Del Sabado – Two-hour family entertainment/variety show hosted by Itati Cantoral. Series airs Saturdays at 7p.
  • El Shaka – Drama series shot on location in Mexico about the dangerous drug cartels and the most famous drug lord. Series airs Mondays and Thursdays at 8p.
  • Quiero Triunfar – Reality series hosted by Francisco Gattorno as a life coach who helps Latin immigrants get their lives on track or helps them return to their home country. Series debuted October 27.

Syfy launched new original reality series Hollywood Treasure Wednesday night at 10p and delivered 1.5 million total viewers; 973,000 with A25-54; and 897,000 among A18-49. Hollywood Treasure has become the network’s best new reality series premiere since the original Ghost Hunters began in October 2004.

Wednesday night’s opening game of the New York Knicks 2010-2011 season in Toronto posted a 1.65 HH rating on MSG Network, the highest Opening Night Knicks telecast on the network since the 2006-2007 season.

James MacArthur, best known for his role as Detective Danny “Book ’em Danno” Williams in the original Hawaii Five-O CBS television series died Thursday morning at the age of 72. Mr. MacArthur appeared in 11 seasons of Hawaii Five-O from 1968-1980. During his four-decade acting career, Mr. MacArthur appeared in many movies such as the 1960 Swiss Family Robinson, Kidnapped, Battle of the Bulge, The Bedford Incident and Hang ‘Em High. He also appeared in numerous guest spots on TV shows such as The Love Boat, Murder, She Wrote, Vegas, Fantasy Island, Bonanza, Tarzan, Gunsmoke among others. His last acting role was in the 1998 TV movie Storm Chasers: Revenge of the Twister.

~  PRODUCTION & DEVELOPMENT ~

ABC Family cast Lea Thompson, Constance Marie and new actress Katie Leclerc in the pilot Switched at Birth, a one-hour scripted drama about two teen girls who discover they were accidentally switched at birth. One girl, Bay Kennish grew up in a wealthy family while Daphne Vasquez, who lost her hearing as a child, grew up in a poor area with a single mom. Production is currently in the pre-production stage. Thompson will play Kristen Kennish, the wealthy mother of Bay; Marie will play Regina Vasquez, the single mother of Daphne; while Leclerc will play Daphne. ABC Family specifically did a casting search for the role of Daphne, wanting to fill it with a deaf and/or hard of hearing actor. ABC Family is currently casting for the role of Bay and for two additional deaf and/or hard of hearing actors to play the roles of Emmett and Penn.

Eric McCormack (Will & Grace) landed the lead role in TNT’s drama pilot Perception (wt). Perception is about Dr. Geoffrey Pierce, an eccentric neuroscientist who uses is unique perspective to help the federal government solve intricate cases. ABC Studios is producing with Kenneth Biller as executive producer and Mike Sussman as co-executive producer. Biller and Sussman are also writing the pilot.

VH1 approved a new reality series using the Saddle Ranch Chop House restaurant as its setting, cites THR. The restaurant has a long reputation of being popular with attractive locals, reality stars and tourists. Saddle Ranch from Bunim-Murray Productions was given 10 half-hour episodes and follows the Hollywood wannabes working as waiters at the restaurant. VH1 is planning a spring premiere date.

Purveyors of Pop principals Matt Anderson and Nate Green, executive producers and showrunners for the Bravo Housewives series, are in the midst of finalizing a production deal with Bravo.  Under that deal, Purveyors of Pop will continue to exec prod the Housewives in addition to producing new series.

Wednesday A18-49 Analysis:  FOX hit it out of the ballpark Wednesday night seizing #1 with 4.8/14 among A18-49, according to final national ratings from Nielsen. FOX’s World Series Game 1 captured a clean sweep posting a 4.3/13 during 8p followed by usual time period winner CBS’ Survivor: Nicaragua at 3.5/10. At 9p, FOX’s World Series coverage hiked up to a 5.2/14 and ABC’s comedies Modern Family and Cougar Town averaged a second place showing at 4.2/11. Then at 10p, FOX’s World Series ratings settled back some to a 4.9/14 with CBS’ The Defenders next at 2.1/6.

~ EXECUTIVE MOVES ~

CNN en Espanol added three experienced Spanish-language news anchors to its on-air anchor team:

  • Fernando del Rincon will be located at CNN’s headquarters in Atlanta and will anchor the new program CNN Investiga in addition to co-hosting Panorama Mundial with Senior Anchor Patricia Janiot. Previously, Fernando was an anchor at Univision, Telemundo and Mega TV.
  • Camilo Egana will additionally move to Atlanta to lead the weekend newscast Mirador Mundial and the new program Archivo CNN. He was most recently a news anchor at Mega TV.
  • Mercedes Soler was tapped to co-host NotiMujer, a new program aimed at women along with co-host Glenda Umana. Prior to this, Mercedes was a columnist for el Nuevo Herald, a journalism professor and a news anchor/correspondent for Univision.

Iambic Media, a UK-based independent production company established two new divisions: Iambic Entertainment and Iambic Scotland. Both divisions will develop new entertainment and factual programming. Iain Thompson was named Creative Director to lead Iambic Entertainment in London. Iambic Scotland will continue the company’s focus on the arts and cultural content, particularly in Scotland and will be supervised by Andy Picheta, Executive Producer and Rebecca Ferrand, Producer, both of whom were former owners of Muckrach Media that was recently acquired by Iambic Media.

Robert W. Sprague was elevated to President/CEO, effective immediately, at PCI Communications. Previously, Robert was SVP/CSO with the company and he follows the late Sam Del Brocco in the President/CEO position. Robert is also one of the co-founders of PCI Communications which specializes in marketing, public relations, crisis communications, training, graphic design, market research, web interactive, video and event productions and more with offices in Washington, D.C. and New York.

Sarah Trahern moves up to GM/SVP at Great American Country (GAC), effective immediately. Sarah, who has been with the network since 2005, will report to Ed Hardy, GAC President. Sarah’s scope of oversight increases to include strategic planning and more daily management of all departments at the network.

Universal Music Group (UMG) upped Rob Wells to the new position of President/Global Digital Business, reporting to Zach Horowitz, President/COO and Max Hole, COO, Universal Music Group International (UMGI). Rob will work in tandem with multiple units of UMG and its business partners to grow the company’s digital strategy and reach across current and emerging platform. Rob is based at UMG’s headquarters in Santa Monica.
