Good morning, it’s Friday, January 18, 2008, and this is your first early morning digital briefing.

That was fast. The Directors Guild of America reached a tentative 3-year contract agreement with the studios after just 5 days of negotiations, putting pressure on writers to end their walkout after 11 weeks of work stoppage. The deal gives DGA jurisdiction over programs produced for online distribution and establishes new residuals formula for paid download-to-own sell-throughs that “essentially doubles” the current rate paid by employers. (Sell-through residual rates will be .70% for TV downloads and .65% for film downloads, based on distributors gross.) For ad-supported streaming product, companies must pay 3% of the residual base (approx. $600 for 1 hour of prime time) for 26 weeks of streaming, after an initial 17-day window of free promotional streaming. The agreement does not cover lower budget projects that cost less than $15,000 per minute, $300,000 per program or $500,000 per series (whichever is lowest.) For all the nuts and bolts of the deal, characterized by head DGA negotiator Gil Cates as “groundbreaking and substantial,” go to dga.org.
 

~ MULTIPLATFORM CONTENT NEWS ~

 
Turner greatly broadened its digital rights deal with the NBA to allow TBS to jointly manage a broad portfolio of the NBA’s digital businesses out of its Atlanta production facility. The deal, which will run from this season all the way through 2015-16, gives TBS control over:

  • NBA TV’s programming, marketing and technical operations
  • Hosting and operations of NBA.com, WNBA.com and NBADLeague.com
  • Out-of-market game package NBA League Pass
  • The NBA’s broadband and wireless businesses

On-air talent from TNT will now appear on NBA TV and Secaucus, N.J.-based production arm NBA Entertainment will continue to provide content for the NBA’s digital businesses.
 
Political themed websites are all the rage this week:

  • Scripps debuted RedBlueAmerica.com to serve as a public forum on the issues featuring user-generated content, blogs, personal profiles and videos
  • AOL‘s Truveo election video site allows users to grab video feeds from the more than 100 million videos it indexes and filter by politician, date, ranking and relevance
  • Lin TV launched local political sites in each of its 17 markets including michiganpolitics.tv, indianapolitics.tv and masspolitics.tv

 
NBC Universal Domestic Television Distribution‘s syndicated series The Steve Wilkos Show is putting on a web-only concert at 9 pm ET on Sunday, Jan. 20 on stevewilkos.com. Wind-up Records’ Finger Eleven will play a set to commemorate the final stop of Wilkos’ two-week tour to benefit underprivileged children, families in need and veterans.
 
ABC-operated Oscar.com plans to stream the Oscar nominations live on the web for the first time next Tuesday at 8:30 am ET, reported MediaPost.
 
MyLifetime.com has collected more than 20 million signatures on its site in support of eliminating the dangerous practice of “drive-through” mastectomies, a much criticized practice that releases patients from the hospital sometimes only hours after their surgery.
 

~ INNOVATORS & START-UPS ~

 
Google is living up to its Don’t Be Evil mantra pledging nearly $30 million in new grants and investments to a wide variety of non-profits and philanthropic initiatives.
 
Online TV network Revision3 launched a new program showcasing user-generated videos submitted to content discovery site Digg.com. Feeds are available in a variety of formats including Quicktime HD.
 
Video sharing site Broadband Enterprises received a $10 million equity investment from Velocity Interactive Group. The inaugural investment will be used to accelerate the company’s strategic growth initiatives, including expanding the breadth and depth of content.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
Unhappy with the company’s sagging stock price and prospects for the future, institutional investor Chieftain Capital Management is calling for the ouster of Comcast CEO Brian Roberts, reports The Wall Street Journal. Chieftain also wants the company to return cash to shareholders and revise its voting structure that allows the Roberts family to control the MSO, despite holding a tiny share of the company stock.
 
Time Warner Cable
is planning to test a bandwidth consumption-based billing plan in its Beaumont, Texas system later this year as way to charge heavy internet users their fair share. News of the trial broke in a leaked memo on a BroadbandReports.com forum posting.
 
Tivo struck a deal with online film distributor jaman.com allowing Tivo subscribers to access and download thousands of films from its library. Viewers will be given the option to rent or purchase movies with pricing starting at $1.99 per title. Jaman has similar agreements in place with SanDisk’s TakeTV and DivX.
 
Amazon.com subsidiary Internet Movie Database agreed to acquire web-based media shop Withoutabox. Withoutabox provides tools to manage and promote film festivals online.
 

~ DIGITAL ADVERTISING ~
 

CBS Outernet reached an agreement to add the Ripple network of interactive public screens to its out of home ad network. The agreement grows CBS Outernet’s reach to 1,500 public locations including retailers Borders, Coffee Bean & Tea Leaf and Tully’s. CBS also announced an alliance with the Automotive Broadcasting Network to form a new marketing channel via the private television network piped to dealerships around the country. CBS will provide clips of CBS programming from shows such as Entertainment Tonight and 60 Minutes to be interspersed with ABN’s automotive-themed shorts designed to educate consumers and increase sales.
 
SinglePoint is partnering with mobile rich multimedia messaging company Tapioca Mobile to offer an enhanced suite of mobile advertising services, including the development of ad-supported mobile campaigns.
 
Euro RSCG New York subscribed to Tivo‘s second-by-second Stop||Watch DVR measurement service, derived from a sample of 20,000 Tivo subscribers.

YouTube increased its dominance in the online video space in November, according to comScore, registering 2.9 billion video views accounting for 30.6% of all videos viewed on the net. More than 75% of U.S. internet users watched a least one video during the month, with consumption averaging 3.25 hours of video per person.

Bravo digital guru Jason Klarman was named GM of newly acquired Oxygen Media. Working closely with Bravo and Oxygen President Lauren Zalaznick, Jason will oversee marketing, digital, communications & sales strategy for the female-focused network as well as its websites Oxygen.com, Quizfarm.com, BabyNamer.com, MyOvulator.com and SheDidWhat.TV.
 
Chuck Dages has the new title of EVP/Emerging Technology at Warner Bros. Home Entertainment Group, reporting to Kevin Tsujihara, President. In his new dual role he will continue to oversee Motion Picture Imaging and Advanced Media Editorial as well as lead projects relating to digital repurposing of the studio’s assets.
 
AtomicOnline’s SheKnows.com hired new sales executives in 3 cities: Aimee Gerry will be based in Los Angeles and responsible for leading sales efforts as West Coast Director of Sales; Martha Goebel will be based in New York as East Coast Account Executive; and Tara Tomlinson will be based in Chicago as Midwest Account Executive.
