Cynopsis: Kids!

Good morning. It’s Friday, December 16, 2005, and this is your first early morning Kids! briefing.

With 17 days to go until January 1, 2006, the date when the FCC’s new Children’s Television Rules are set to be enacted, The Children’s Media Policy Coalition and representatives of kid programming broadcast and cable industry, including Viacom, Disney, Fox, NBC Universal, Time Warner, 4Kids Entertainment, Association of National Advertisers and Discovery, have crafted an agreement that complies with some of the FCC rules and proposes modifications to others in the Children’s Television Rules, which they presented to the FCC yesterday.  Additionally, the group of broadcasters and cablecasters say if the FCC adopts the suggested modifications, each of the individual members of the consortium will withdraw their respective legal challenges to the FCC rules.  Finally, the Coalition and media industry agree to voluntarily comply with the proposed rules beginning March 1, 2006, if the FCC has not acted by that date.  Below is a brief description of the FCC rules concerning kid-targeted educational and informational programming requirements for broadcasters and cablecasters and their digital channels; followed by the Coalition/media industry agreements and proposed modifications.

FCC Requirement: Air a minimum of 3hrs per week of core educational programming, for both analog channels (already required to offer this) and will be required to provide the same on digital broadcasters.  For broadcasters who multicast each, 24/7 digital channel will be required to air at least 3hrs of core programming. 
Coalition/Media Industry Response: The group has agreed to leave in place the FCC’s multicasting guideline as originally written.

FCC Requirement: Core educational programming cannot be preempted more than 10% of the time. 
Coalition/Media Industry Proposal: The rules would impose no specific numerical limit on the ability of broadcasters to sometimes preempt and reschedule children’s programming in order to bring viewers other programming of particular interest to their community, such as live sports programming from another time zone.

FCC Requirement: Digital channels must follow the same guidelines as analog channels when it comes to advertising limitations for programming targeted to kids 12 and under.  Those rules restrict the amount of advertising to 12 minutes per hour during the week, and 10 minutes per hour during the weekend.
Coalition/Media Industry Proposal: Networks be able to run on-air program promotions during kid’s shows without those promotions themselves counting against the numerical limits on paid advertising. The industry has agreed to limit promotions for programming not appropriate for children.

FCC Requirement: The airing of website addresses on screen during a show (in a billboard, a crawl etc.) is permissible only if the website offers a substantial amount of bona fide program-related or other noncommercial content, and the first page presented to users is not used for any commercial purposes, nor does it include links to any other page with commercial material.
Coalition/Media Industry Proposal:  Industry members will not challenge limits on the display of commercial websites during a children’s program.  However, as to prohibiting TV characters from selling products to kids, the members suggest the practice be limited to certain portions of websites, if website addresses are displayed during shows that include those characters.

Still wondering what a family-friendly tier might include?  Yesterday Time Warner Cable offered what it will include in its Family Choice tier, which includes 15 channels and is slated to be offered beginning 1Q 2006, kids channels first (alphabetically) are: Boomerang, Discovery Kids, Disney Channel, Toon Disney, Nick Games & Sports, as well as non kid centric channels: Science Channel, DIY Network, FitTV, Food Network, Home & Garden TV, La Familia, The Weather Channel, C-Span2, C-Span 3 and Headline News.  Kids and families love to sit down and watch everything on any C-Span channel.

NEW PRODUCTION & DEVELOPMENT

Visiware, an interactive TV game company, and Universal Studios Consumer Products Group have signed an agreement to bring Universal Pictures’ properties to interactive TV games.  The first two games Visware will develop under the deal will be based on Peter Jackson’s new movie King Kong, Kong; The 8th Wonder of the World Quiz and an arcade game similarly titled, Kong: The 8th Wonder of the World.  All of the interactive TV games developed under the deal will be broadcast on Visiware’s Playin’TV Channel, currently available in 77 countries on 33 networks, which accessible via TV set top boxes.

MORE KIDS STUFF

Nickelodeon will air a new special Nick News with Linda Ellerbee: Ten Things Wrong with Television, this Sunday, December 18, 8:30p.  Since kids watch an average of 8 hours of TV a day, per family, Nick News surveyed kids across the country for the show to find out what bugs them about TV.  According to the survey, the most popular responses to what bothers them about TV are (in random order): stereotypes of people; too much sex, violence and bad language; TV news is biased; so many channels and nothing to watch; TV shows don’t reflect real life; TV makes me feel bad about myself; and TV news is too negative and scary; and there are too many commercials.  Topics that will be discussed on the special include the concept of media literacy and what that means, and the relevance of advertising to TV.

Genius Products, Inc., has entered into a long-term production and distribution agreement with production company Brandissimo!  Under the agreement, Genius Products will represent the North American distribution of Brandissimo produced and controlled titles intended for initial release on DVD.  At the same time, Brandissimo will serve as exclusive producer of all original, branded family entertainment products distributed under Genius Products’ slate of kid/family brands.  The first project as part of this deal is Spectrum Connections, Brandissimo’s brand created for kids on the spectrum of autism and related disorders.  Developed and produced in association with RX Entertainment and under the guidance of autism medical specialists, Spectrum Connections is designed to meet the developmental needs of autistic children.  Spectrum Connections launches at retail this month with two DVDs and a companion CD.  Additional Genius and Brandissimo projects are expected to be announced in the near future.

CBS will air a digitally remastered version of the 1964 holiday special Rudolph the Red-Nosed Reindeer on Thursday, December 22 at 8p.  The perennial special features a well-known score by Johnny Marks, and made famous by actor/singer/storyteller Burl Ives, as Sam the Snowman.  However, Ives only sang Rudolph in English and never in Latin!  So, if Latin is your favorite language then this is your year as the choir of St. Bartholomew’s Church in NYC has recorded both a novelty all Latin version of Rudolph the Red-Nosed Reindeer, as well as one in English, which is available for MP3 and AIFF download ( http://stbarts.whisperaudio.com/ ). Okay, all together now: Rudolphus rubrinasus fulgentissimo naso, vidisti et si eum dicas quoque candere. …I’m having trouble hearing you….

MARKETING/LICENSING

AOL kids service KOL has inked several new licensing deals for its original webisode series Princess Natasha, for toys, home accessories and apparel.  New Princess Natasha licensing partners, set up by licensing agent 360ep, include deals with Jazwares (toys, figures, dolls, accessories  bend-ables), Westpoint Home (sheet sets, pillowcases, decorative/printed pillows, comforter/accessories/bedspreads, blankets/throws, towels, shower curtain and hooks & bath accessories) and BeeZeeTees (graphic T-shirts, novelty knit tops and fleece wear).  Other licensing partners for Princess Natasha include deals with Cartoon Network, which is developing an animated TV series based on the property; DC Comics, planning a limited series comic book series; Little, Brown Books For Young Readers, a Princess Natasha book series; and a DVD/VHS distribution agreement with Anchor Bay Entertainment.  The Princess Natasha webisode was developed for KOL by indie animation house Animation Collective, and debuted as part of the newly launched KOL service in fall 2003.

Talicor Inc. has signed on as a new licensing partner for the preschool TV series ToddWorld.  Talicor will produce products under its Aristoplay banner and will include puzzles (of varying sizes), board games and card games.  Retail distribution is currently set at specialty, mid-tier, catalog and website.  The first products will be marketed at the American International Toy Fair, this coming February 2006.

Production and distribution studio Lions Gate has changed its name to Lionsgate (which is pretty much what everyone pronounces it anyhow) and unveiled a new logo for the company.  The company says that the name change is a reflection of the coming together of the its many divisions.  The company’s official legal name of Lions Gate Entertainment Corp. remains unchanged.  In addition the company has also acquired the lionsgate.com domain name.

Electronic Arts has selected John Dutton, quarterback for the 2005 Arena Football League Champion Colorado Crush, to appear as cover athlete and spokesman for Arena Football, available in stores on February 7, 2006 for PS2, and Xbox, under the EA Sports brand.

EXECUTIVE MOVES

Maria Grasso has been named to the newly created position of SVP/Series Development, Lifetime Television Entertainment, and will report to President Susanne Daniels.  In her new role, Grasso will oversee the development of all scripted programming for Lifetime Television.  Grasso joins Lifetime have served as SVP/Drama Development for The WB, where she is credited with developing primetime series including Everwood, One Tree Hill, and Supernatural among others.  Go, Maria, Go!
