The FCC, backed by the Justice Department, is appealing a Second Circuit Court of Appeals ruling that says the FCC’s indecency enforcement policy is unconstitutionally vague. The FCC contends the court’s recent ruling was “unnecessarily broad” and it would be a “seeming impossibility” to come up with any future indecency enforcement policy to appease the courts. The FCC also said the court had nearly ignored the specifics of the case consisting of fleeting profanities in Billboard awards shows airing on FOX. The FCC indicated it would challenge the FOX decision earlier this week in a petition filed with the same court on ABC’s challenge to its indecency fine of nudity on NYPD Blue. 

TLC said the upcoming sixth season of Little People, Big World will be the series’ last. Over the course of 200 episodes, viewers have glimpsed inside the world of the Roloff family who run a pumpkin farm in Oregon. Produced for TLC by Gay Rosenthal Productions, the final season of new episodes for Little People, Big World debuts September 6 at 8p.

ESPNEWS, along with SportsCenter, ushers in two new shows starting next Monday with each taking a different look at sports:

  • The Beat airs weekdays at 6p hosted by Bram Weinstein with an encore airing at 630p, offers an entertaining and alternative look at sports and sports stories.
  • Highlight Express showcases daily highlights and sound bites in this half-hour format airing nightly at 11p. The show will re-air with new updates at 3p on weekdays, noon on Saturdays and 2p on Sundays.
  • In addition, College Football Overdrive is back for the 2010 season airing each Saturday beginning September 4 at 3p. Ryan Burr hosts the five-hour show along with analyst Jon Ritchie.

Hi-def TV network, Veria renewed its daily series Yoga For Life hosted by yoga guru Kurt Johnsen. The series returns in November with 20 new one-hour episodes, offering a new twist on the traditional yoga class where viewers can gain strength and health in a fun, easy way.

RightNetwork, a multi-platform entertainment company and TV network espousing a right-minded perspective is launching on September 8, the same day it premieres a political reality series, Running. The one-hour series provides behind-the-scenes profiles of eight first-time political candidates as they run for political office in various parts of the country. Also on September 8, RightNetwork’s multimedia platform launches via VOD, mobile phone and online at www.rightnetwork.com .

Cross MediaWorks, a national multi-platform media company has bought Incentive Plus Network (IPN), a company based in Castaic, CA that helps television broadcast stations and cable companies increase advertising revenue through barter incentive programs and promotions. Pat Pattison, Founding Partner at IPN will become VP/Trade, Barter and Promotions with Cross MediaWorks. Specific terms of the transaction were not disclosed.

~ DISTRIBUTION, CLEARANCE & CARRIAGE ~

Hallmark Channels said customers of AT&T U-verse TV will not have access to Hallmark Channel and Hallmark Movie Channel if a new carriage distribution deal is not hammered out by next Tuesday at midnight. Negotiations between Hallmark Channels and AT&T are currently at a standstill. On August 1, AT&T U-verse mailed postcards to its customers informing them of this possible action if a new agreement is not reached by August 31. AT&T U-verse customers can request to keep both networks by calling 1-888-MADE-4-FAMILY or by visiting www.donttakemyhallmarkchannels.com .

~ PRODUCTION & DEVELOPMENT ~

Saturday Night Live alum for eight seasons, Will Forte will no longer be a part of the NBC weekly show when SNL premieres its 36th season this fall. Forte reportedly is leaving of his own accord to pursue other projects. Some of Forte’s more memorable SNL characters include Andy the “Ohhhhhhh, Noooooooo!” guy and MacGruber.

E! opens its new weekly series Fashion Police with a one-hour special on Monday at 10p, with Kelly Osbourne joining Joan Rivers, Giuliana Rancic and George Kotsiopoulos as they dish on celebrity styles from the Emmy Awards. The foursome will continue to host when Fashion Police the series premieres September 10 at 1030p on E!.

Syfy announced its cast roster for the 90m pilot Three Inches. Noah Reid stars as Walter Spackman, a full-time daydreamer and underachiever who is struck by lightning and develops a “super” power, the ability to move any object three inches by using his mind. Other series regulars include James Marsters, Andrea Martin, Stephanie Jacobsen, Antony Del Rio, Naoko Mori, Kyle Schmid and Brandon Jay McLaren. Fox Television Studios and Landscape Entertainment are producing with production commencing in Toronto next Monday.

Even before the official announcement takes place on Monday night, cast members for the 11th season of ABC’s Dancing with the Stars are surfacing, per E! Online. Bristol Palin, daughter of former Alaska governor Sarah Palin is supposedly one of the celebrity cast members along with David Hasselhoff, Audrina Patridge, Jersey Shore’s The Situation and Brandy. ABC won’t comment on these casting rumors, stating the full cast will be unveiled Monday night during a live announcement within Bachelor Pad.

Casting Call: mtvU and the New York Stock Exchange (NYSE) are teaming in their continued search for aspiring young entrepreneurs in the 2010 “Movers & Changers” competition. Finalists in the competition will be seen on mtvU in the short-form series Movers & Changers opening November 17 and will compete for the chance to ring The Closing Bell at the NYSE. The ultimate winner will receive $25,000 in start-up money. Interested college students who are 16 to 28 years old can compete as individuals or in teams of three where they develop and produce an enticing business proposal using social media to enhance their venture. The overall ideas presented should be original, innovative and practical and must have potential to be profitable. Students can target a niche audience or appeal to the masses with their idea. Wednesday A18-49 Analysis: FOX was a cut above the pack Wednesday night at 2.2/7 among A18-49, according to final national ratings from Nielsen. CBS ruled the 8p hour as Big Brother delivered a 2.8/9 with FOX’s Masterchef in #2 at 2.1/7. NBC was #1 at 9p with a 2.7/8 for America’s Got Talent while FOX’s Masterchef and UNIV’s Soy Tu Duena tied for second place at 2.3/7. During 10p, NBC’s Law & Order: SVU did best at 1.6/5 with UNIV’s weekly Don Francisco Presenta trailing next at 1.3/4.

~ EXECUTIVE MOVES ~

 

Beginning September 7, Perry Simon takes on the new position as GM/Channels with BBC Worldwide America. Perry will oversee the growth strategy and overall direction of BBC America, BBC America HD, VOD, BBCAmerica.com and future content distribution platforms for the company’s US operations. Based in New York, Perry will report directly to Herb Scannell, President, BBC Worldwide America. Prior to this appointment, Perry was Chief Content Officer at Sezmi Corp. since its start-up in 2006.

Cream Productions tapped Amy Manchester Borg as Co-Director/Development. In her new role, Amy is charged with increasing Cream’s US broadcast client base and will be integrally involved with creating the company’s slate of factual series and specials. Amy will report to company Founders Christopher Rowley and David Brady and working closely with Co-Director Jenn Kuzmyk Ruch. Amy is also stepping in for Co-Director/Development Yasmine Abbasakoor who is now on maternity leave.

Jane Buckwalter advances to Director/Content Operations at WNET.ORG, the parent of public television stations THIRTEEN and WLIW21. In her new position, Jane will work in tandem with Stephen Segaller, VP/Content to align the operations relating to production for WNET.ORG’s three subsidiaries: THIRTEEN, WLIW21 and Creative News Group. Jane’s previous job within WNET.ORG was Senior Project Manager where she supervised several THIRTEEN-produced series such as American Masters and Great Performances. Additionally, WNET.ORG hired Harry Forbes as Senior Publicist in the company’s Communications Group. Harry will manage publicity campaigns for THIRTEEN’s national and local arts productions including Great Performances, Great Performances at the Met, SundayArts and Reel 13.

Chicago-based Towers Productions, LLC moved Mike Schmiedeler to the position as VP/Development and Executive Producer. Mike will have oversight on program origination as well as editorial. Mike has been with Towers Productions since 1999, most recently as Managing Director.
