IN THE NEWS
A bipartisan bill introduced in the Senate would protect actors and others from having their likenesses generated by AI, holding people and companies liable for hosting digital replicas without consent. “Creators around the nation are calling on Congress to lay out clear policies regulating the use and impact of generative AI,” said Chris Coons (D-DE), one of the sponsors of the bill, the Nurture Originals, Foster Art, and Keep Entertainment Safe (or NO FAKES) act. “Congress must strike the right balance to defend individual rights, abide by the First Amendment, and foster AI innovation and creativity.”
“Enough with the blackouts,” said Federal Communications Commission Chairwoman Jessica Rosenworcel in a statement, issuing two notices of proposed rulemaking aimed at empowering viewers. “When consumers with traditional cable and satellite service turn on the screen, they should get what they pay for. It’s not right when big companies battle it out and leave viewers without the ability to watch the local news, their favorite show, or the big game,” said Rosenworcel. “If the screen stays dark, [customers] deserve a refund.”
Not so fast, responded trade group ACA Connects, which represents smaller broadband and cable providers. “The nation’s independent broadband and cable providers work hard every day to deliver high-quality programming and services to their customers at fair prices,” said ACA Connects president and CEO Grant Spellmeyer. “They hate blackouts as much as anyone. Unfortunately, the proposals announced today do not appear to address the root cause of these blackouts: the insatiable demand of broadcasters for outrageous, ever-increasing fees.”
In a statement to its members the morning after talks with the AMPTP collapsed, the SAG-AFTRA negotiating committee accused the studios of “bully tactics” and putting out misleading information. “These companies refuse to protect performers from being replaced by AI, they refuse to increase your wages to keep up with inflation, and they refuse to share a tiny portion of the immense revenue YOUR work generates for them,” said SAG-AFTRA. “We have made big, meaningful counters on our end, including completely transforming our revenue share proposal, which would cost the companies less than 57cents per subscriber each year. They have rejected our proposals and refused to counter….One day longer. One day stronger. As long as it takes.” What went awry? Netflix Co-CEO Ted Sarandos, speaking at a Bloomberg event on Thursday, said the union’s request for a levy on every subscriber was a “bridge too far.”
Paramount Global condemned the terrorist attacks by Hamas, and donated $1 million to organizations supporting humanitarian relief. In a note to employees, Shari Redstone and CEO Bob Bakish said the company will match donations by employees, and offered listening sessions and guides for parents for those needing support.
Fox renewed “MasterChef Junior” for a ninth season, and added a new judge. Tilly Ramsay will join her dad, host and executive producer Gordon Ramsay, on the cooking competition.

Google is rolling out Google Ads Data Manager, a measurement tool to simplify the ways users connect and use first-party data with Google’s ads solutions. Through one collaborative interface, analysts can create new data connections while marketers can apply discrete data to measure conversions or reach people with relevant ads. “Google Ads Data Manager does not change the way our products work today, but rather simplifies the way you use them,” said Kamal Janardhan, Senior Director of Product Management, Measurement, in a blog post. “It requires minimal or no code knowledge, reducing the workload to use your data in marketing. It puts all your data management controls in one place, enabling you to drive incremental revenue and better outcomes for your business.” Google Ads Data Manager will become generally available in early 2024.
Seventy-nine percent of marketers believe that the Attention metric is “currently too vague and open-ended” and requires a “clearer, standardized definition to encourage broader adoption,” according to a new survey from Intango around the impact of digital advertisements. Meanwhile, 15% of respondents were neutral, and 6% disagreed. “Attention as a metric holds great potential,” said Daniel Malek, Head of Corporate Development at Intango. “However, the lack of standardization in Attention terminology and practices has hindered rapid adoption and understanding. Transparency and industry-wide education are more important than ever to advance Attention as a long-term measurement solution, especially as we see economic and regulatory changes impact the market.”
STREAMING
FITE announced that its FAST channel, FITE 24/7, achieved a record 7.3 million starts during the third quarter. “This isn’t just growth, this is velocity,” said Louis Lewow, FITE’s VP of Distribution. “Not only did we achieve 7 million starts in Q3 we also logged over 1.2 million viewing hours – more than we hit in what was already an impressive first year.”
MotorTrend Group announced the launch of its first Spanish-language FAST channel, MotorTrend Veloz TV on ViX. There will be 12 series to start, including “Shorty’s Dream Shop.”
SPORTS ROUNDUP
Diamond Sports Group, operator of Bally Sports network, should not be granted another extension to craft a Chapter 11 restructuring plan, Major League Baseball told a Houston bankruptcy court. In a joint filing with five clubs under the Bally umbrella, the filing says Diamond has “made no progress toward reorganization and no progress in negotiations with their creditors.” Having failed to regroup during the 2023 baseball season, “There is no reason to believe that the Debtors will finally figure out a path forward now that the NBA and NHL seasons are beginning,” says the filing. “The Debtors should not be permitted to exploit the protection of exclusivity and the presumption of legitimacy it provides to simply stall for even more time while the entire cycle of sports seasons starts again.” Responded Diamond, “Diamond disputes MLB’s misguided attempt to oppose a customary extension in a complex, multi-billion-dollar restructuring involving myriad stakeholders, with whom Diamond is making significant progress.”
The NHL is bringing back its official free-to-play daily predictor game, NHL PrePlay presented by Bet99. Bet99 is an official NHL partner in Canada. Fans can register and make their picks ahead of puck drop for their chance to win. New this year, GEICO (an official NHL partner in the US) has signed on to be the presenting partner of a new version of the free-to-play game that will allow fans in the US to participate for their chance to win game tickets, event packages, gift codes to NHL shop.com, and a $50,000 grand prize.
