Good Morning. It’s Wednesday, November 14, 2007 and this is your first early morning briefing. Back in 1984 when cable was still relatively new, there was a law passed that reads in essence, once the cable industry surpasses the 70% US households served mark, the FCC gets more regulatory power over the industry. The reminder of that law is contained in the FCC’s annual report and that report will be presented to the full Commission on November 27, according to a Reuters report. As you might imagine, several from the cable side are more than a little concerned at this prospect. One of the new regulations that is already on the Nov 27 agenda as a result of this law is a proposal from FCC Chairman Kevin Martin that would require cable operators to charge programmers less for leasing spare channels. Elsewhere at the FCC, Chairman Martin has relaxed his stand on the cross-ownership rules of owning a television station and the local newspaper in the same market. His latest proposal allows for the cross-ownership in the top 20 markets, and while it can also happen in the smaller markets, there are some pretty hefty rules you have to get pass. For instance, for Tribune which owns the Fox and CW stations in the Hartford-New Haven market, as well as the local Hartford Courant, for it to hold on to all of these assets, there are some criteria it needs to meet. For instance, if a newspaper is being acquired there must be at least “8 independent voices” beyond the acquisition; and if a station is being purchased it cannot be one of the “top 4” watched stations in the market. WGAE response to Ellen’s decision to not tape in NYC: “We’re delighted that Ellen DeGeneres has decided not to come to New York to tape her program. She knows that the Writers Guild East would have been there to protest her lack of solidarity, not only with her Guild writing staff but all the striking members of the Writers Guild, of which she is a member. We will be even more delighted if she does not cross the Guild picket lines at the NBC Studios in Burbank, where her show usually is produced.” The Writers’ Guild of Great Britain (WGGB) pledged its support with WGA members striking over here in the U.S. The guild asked its members and other British writers to “refuse to break the strike by filling in for U.S. writers in dispute … Strike-breaking would at best bring a short-term payday but would have a devastating long-term effect on a writers’ U.S. career”, according to WGGB general secretary Bernie Corbett. Although the WGGB cannot discipline members for defying its position, the organization did point out to them that future U.S. work would be much harder to obtain if they wished to work for the major studios and networks without WGA membership. The WGGB has already succeeded in negotiating contracts with British broadcasters regarding Internet, DVD, and mobile phone revenues and rights. NBC‘s Clash of the Choirs airs as a one week stunt beginning December 17 from NYC and celebrities participating including Michael Bolton, Patti LaBelle, Nick Lachey, Kelly Rowland and Blake Shelton . The game is simple: go back to your hometown, assemble a choir of 20 amateur singers, bring the group back to NYC and see who’s best. Winners will get to choose what their town needs most to improve it as their prize. Broadcast Evening News Ratings Wrap-Up: The playing field was practically flat between ABC and NBC during the week of November 5, 2007, tho NBC was the clear winning in total viewers: As of this week, ReelzChannel is providing movie-themed original programming to the American Forces Network which will air on its AFN movie channel. American service men and women around the globe can now view series such as the daily show Dailies hosted by Mike Richards, and four weekly programs: Secret’s Out, What It Takes, The Big Tease and What I Learned from the Movies. Food Network’s finale of The Next Iron Chef on Sunday (9p) delivered a 1.4 A25-54 rating and attracted 4.2 million total viewers. Equator HD, part of the VOOM HD Networks, will premiere the new original adventure series EarthTripping next summer, hosted by Survivor Africa winner Ethan Zohn. Each of the seven episodes will be a “go green guide” for exploring unique urban places around the world, not necessarily like a tourist but as a local. The series opens in New York City, where Ethan will seek out local food producers, green spaces and more, then in later episodes will travel to Mexico City, Singapore, Kuala Lumpur, Santiago and Buenos Aires. CABLEready is set to distribute the new hi-def 30m series Epic Conditions, from The Weather Channel. The 15-episode series documents those fleeting moments when weather cooperates allowing for the best experiences in outdoor adventures. Endemol USA has purchased a majority ownership stake in Original Media, the company that brought TV reality series including Miami Ink and Storm Chasers, and a handful of lower budget feature films. In its purchase of 50% of the company, Endemol also has future options to acquire more of the company until it hits a full 100%. Original will continue to work out of its NY, LA and Miami offices. RCN Corporation purchased NEON Communications Group, Inc. for a total transaction price of approximately $255 million. The combined RCN Business Solutions/NEON entity will be re-branded as RCN Metro Optical Networks, offering telecommunications services to businesses and individuals in the Northeast, Mid-Atlantic and Chicago regions. The U.K.’s Fluorescent Media brought in New York-based production company Embassy Row to jointly pitch and produce The Empire, Fluorescent’s new game show series. In the cross-platform format, thousands of players are projected into a game show studio to compete simultaneously in a live TV contest. Sony Pictures Television will distribute the format under its partnership deal with Embassy Row.
