Good morning, it’s Wednesday, February 4, 2009, and this is your first early morning digital briefing. 

The Screen Actors Guild and the Alliance of Motion Picture and Television Producers postponed scheduled contract negotiations after SAG President Alan Rosenberg notified members late Monday that he intends to file a lawsuit to reinstate Doug Allen as the union’s chief negotiator. Superior Court Judge James Chalfant rejected Rosenberg’s initial attempt to sue the guild on Tuesday morning on technical grounds, according to The Wrap, ordering him to refile the complaint on Thursday.


News Corp.’s HarperCollins launched a new digital video book format yesterday with a video edition of Jeff Jarvis’s new book What Would Google Do?, available though Amazon’s digital download store. Available to instantly stream or as a download to a PC, Tivo or portable device, it consists of a 23-minute lecture of the Buzz Machine blogger speaking directly into the camera about what companies can learn from the search giant. (At $10, that works out to be about .85 cents/minute.) The publisher plans to produce 6 more video books this year according to the WSJ, focusing on non-fiction and business books ­- presumably for executives who have more money than time.
Amazon also launched a casual game store yesterday with the assets from its acquisition of Reflexive Entertainment. The outlet allows you to trial any game before you buy it and offers more than 600 titles priced at $9.99 or less.
Spanish film studio Filmax Entertainment, producer of Brad Anderson’s The Machinist and Trannsiberian, launched a new Spanish-language entertainment web portal dubbed Yodecido under its 24-7 Entertainment brand. The service, which also offers film related social networking features and web TV series content, currently offers online rentals and download-to-own purchasing of licensed film titles and songs from providers such as EMI, Warner, The Orchard and Pias. The site also plans to introduce a subscription service in the near future. reported double and triple-digit increases in key metrics in 2008 including unique visitors and time spent per user, citing internal Omniture numbers. The site’s Character Arcade casual gaming portal racked up 10 million page views per month, on average. Fans spent an average of 142 minutes/month using USA’s Character Rewind full episode and clip video player with Monk and Burn Notice registering as the two most viewed series, respectively.
CBS Interactive signed with Head & Shoulders to sponsor a new original scripted web series, Heckle U, starring Owen Benjamin (House Bunny) as a man hired to become a professional heckler. (Tom Arnold co-stars as Lou the Bartender, Owen’s uncle.) The series will include a UGC component allowing users to rate, review, vote on and share their own comedic videos. The 10-episode show, produced by NuMedia Studios, will premiere on Feb. 9 exclusively on and the newly-revamped
Minority-owned Spanish-language broadcaster Liberman Broadcasting entered into an affiliation agreement with Communications Corporation of America to bring Estrella TV to four markets in Texas, including #10 Hispanic market Brownsville – McAllen (KVEO) and #16 Hispanic market El Paso (KTSM).
Mexicanal Network completed a carriage agreement with Comcast, which launched the network in Chicago as part of its CableLatino package.  Comcast will be the first cable company to carry the channel.


Getty Images is shuttering Glascow-based citizen photojournalist site Scoopt about two years after acquiring the company. Scoopt, which will remain active until March but will cease accepting uploads later this week, was one of the first start-ups to market and offer revenue sharing from digital and mobile phone pictures submitted by users.
Broadband television network KoldCast TV launched a new Series Pilots channel to introduce pilot episodes of series programming created for broadband and traditional television. The channel currently features 4 pilot episodes – “Dirty Bomb Diaries,” “Jenn2.0,” “OzGirl” and “The Temp Life” – from web series creators and other KoldCast TV partners seeking funding and/or brand sponsorship.
Social network syndication service iWidgets closed on $4.1 million in series A funding from Opus Capital and University Venture Fund. iWidgets offers widget creation tools and works with clients such as CBS interactive to develop apps to drive traffic and viewers to media sites.


Social media app creator RockYou, creator of Facebook hits like SuperWall, added a new IAB standards-compliant video ad format to its widget ad network to enable advertisers deliver video ads across its vast network of social network users. RockYou, which serves more than 130 million users worldwide across Facebook, MySpace and other social networks, will focus on creating customizable integrated ad programs that combine video with other targeted applications.
Locally-focused web video ad start-up Jivox unveiled a new online video ad affiliate program to offer larger publishers and marketers a white label video ad option and smaller publishers a paid incentive for referring advertisers. Jivox offers a number of do-it-yourself video ad creating and editing tools to help smaller advertisers add video to their marketing mix.


Four Google executives began trial in Milan yesterday facing charges of privacy violation and defamation of character, per the NYTimes. The case involves the posting of a video in 2006 in which 4 kids tease a boy with Downs Syndrome. “To our knowledge, this is the first time an individual has been criminally charged for violation of data protection laws that occurred by the company he or she works for,” Trevor Hughes, executive director of the International Association of Privacy Professionals, is quoted as saying.
HD video portal and content delivery service Vuze, one of the biggest critics of Comcast’s P2P throttling practices chastised by the FCC, is now calling for an examination of Cox Cable’s traffic management practices. In a blog entry Vuze General Counsel Jay Monahan points to Cox’s recently published Congestion Management Policy, noting that users who engage in “low priority” activities including P2P streaming may now see their connection hampered. Vuze utilized P2P architecture to delivery HD video content for its clients.
The Electronic Frontier Foundation is pushing back at YouTube’s automated Content ID filtering system, which tags clips that utilize unauthorized protective content. The EFF complains that the system, now being utilized by major content providers such as Warner Music, is too primitive and that it is unable to distinguish copyright infringement from “transformative” usage of content protected under the fair use doctrine. The group wants to hear from disaffected artists like young Juliet Weybret whose work is being unfairly removed from the platform.
IAC/Interactive Group eked out a profit during Q4 but missed revenue projections due to the horrible decline in display advertising diminishing cost-per-click rates across many of its sites. For the full year, IAC reported a loss of $156.2 million compared with a loss of $144.1 million in 2007. The company’s revenue climbed 8%, totaling $1.45 billion in 2008.
Seattle-based RealNetworks released some preliminary revenue numbers and impairment charges for Q4, expecting $151-$153 million in revenue but also a write down of $185-$200 million, categorized as “impairment of goodwill and acquired intangible assets.”


The steady development of a “healthy IP connected ecosystem” has progressed to the point that it can support an equally healthy market for IP-connected devices, says MultiMedia Intelligence. The research firm projects that 244.5 million IP-connected devices including set-tops, DVD players and other AV equipment will be shipped by 2013, allowing users to, among other things, easily download, share and view web video.
User generated content consumption will continue to grow as US internet users plug into the world of blogs, social networking and UGC video, according to eMarketer. Blogs had the highest rate of engagement in 2008, with 54% of the US internet user base consuming this content. Social network users made up 41.2% of the base while user-generated video viewers represented 36% of users.

Clients include national and internationally-based television networks, sports networks, production companies and advertising concerns along with a host of writers, producers and others in the creative arts.


The Obama administration has gone on record several times promising to use the web to keep taxpayers in the loop about what the government is doing with your money. But lets face it – they’re kind of busy right now. It’s up to concerned citizen to build their own tools that mine the mountain of data that is already readily available to the public if you know where to look. launched this week as a crowdsourcing effort to highlight “shovel ready” projects across the country that are seeking federal grants. You can search for projects by keyword, location or program type, vote on what you think is worthwhile or add details to the wiki page dedicated to each entry. Integrations with Facebook and Digg help spread the word about what you’re advocating. Site founder Jerry Brito, senior research fellow at the Mercatus Center at George Mason University, fully expects a massive stimulus package to be signed into law this month but the bill won’t specify which projects get funded – only federal grant programs will be named. And when push comes to shove, only the squeakiest wheels will likely get the grease.
