Yesterday, the Supreme Court sided with the FCC on the long-running and controversial “fleeting expletives” case. Effectively, the Supreme Court ruled in a close 5-4 vote the FCC could fine broadcast networks in situations when a single expletive is used on live television. Contrary to what broadcasters have argued, the Supreme Court did not find the FCC’s policy on the “fleeting expletives” either “arbitrary or capricious.” This case marks the first ruling on indecency standards in more than 30 years. Supreme Court Justice Antonin Scalia related the defining opinion of the court, saying “The FCC’s new policy and its order finding the broadcasts at issue actionably indecent were neither arbitrary nor capricious.”

~ MORE GOOD STUFF ~

Beginning next week, FOX is moving its newer animated comedy Sit Down, Shut Up out from under The Simpsons’ shadow on Sundays to 7p followed by reruns of American Dad at 730p. The final episodes of King of the Hill’s last season will fill the 830p time period following The Simpsons.

A&E Network combines tattoos with cross-country travel in a new 13-episode 30m series Tattoo Highway, premiering May 27 at 10p. The series journeys with tattoo artist and former star of A&E’s Inked series, Thomas Pendelton and his business partner and wife Monica in their deluxe 1970s tour bus which operates as a tattoo shop on wheels. Tattoo Highway is produced by Juma Entertainment, LLC.

Following a successful debut, Spike TV’s new original series Deadliest Warrior has spawned a digital series on Spike.com called Deadliest Warrior – The Aftermath. The online show features host Kieron Elliot and a round table of experts discussing battle details of the linear program and questions put forth by fans. Each episode of Deadliest Warrior – The Aftermath will be available following each on-air premiere of the Deadliest Warrior airing Tuesdays at 10p. Morningstar Entertainment produces Deadliest Warrior for Spike TV.

Football fans flocked to watch the 2009 NFL Draft, with the NFL Network, ESPN and ESPN2 gauging a record 39 million viewers, based on data from Nielsen. This year’s viewership number equates to approximately 2.5 million more tuning in from the previous year and also breaks the 2007 record of 38 million viewers.

2009 PROGRAMMING SLATE: MTV

MTV serves up a variety pack of new programming covering different genres such as reality, fashion, sports, comedy, animation as well as a live afternoon show. MTV continues to aim its programming to the millennial generation, those born between 1980-2000, with shows that are “aspirational, escapist and optimistic.” Nine new series join MTV’s lineup including:

  • The Alexa Chung Show (wt) – British television personality and model, Alexa Chung will host this daily one-hour live entertainment show which includes a large dose of viewer interaction. MTV will partner with Twitter offering viewers instantaneous input opportunities with Alexa, celebrity guests, or their own friends watching the show. The show will also feature a RockYou Live video sharing application, allowing viewers to submit their favorite viral videos and those they shoot themselves. From Reveille.
  • The Buried Life – Four guys on a quest to prove everyday people can do anything. After each one accomplishes a task on their list then they will help a stranger do something on theirs. Reveille produces.
  • DJ and the Fro – Animated series reminiscent of Beavis and Butthead for a new generation. The show centers on DJ and Fro, corporate workers who make observations about online video clips.
  • The Stylist (wt) – Reality series from Bunim-Murray where young junior assistants are challenged while on the job working for successful celebrity stylists. No eliminations will happen in this competition, though viewers will be able to tell which assistants are doing well and which ones are not. The final chosen assistant will get a contract with the Margaret Maldonado Agency.
  • Ultimate Parkour Challenge – Produced in association with the WFPF, World Freerunning and Parkour Federation. Parkour is an extreme sport where athletes run from point “A” to point “B” though it is performed on any surface and in any environment. Throughout this series, eight athletes compete with the final winner receiving $10,000 and title of Ultimate Parkour Champion. Produced by One Louder Productions and Transition Productions.
  • Pranked – 30m weekly series showing off the best pranks found online. From Cheri Sundae Productions.
  • Popzilla – Quick paced animated 30m sketch show featuring jibes at current pop culture.
  • Gone Too Far – One-hour series hosted by DJ AM with each episode focusing on a young adult 18-25 who suffers from a series addiction and needs help from an addiction expert. From ISH Entertainment and Gigantic.
  • Disaster Date – Hidden camera show that sets up unsuspecting daters who go on terrible blind dates with improv actors. The daters who stick with their date unknowingly rack up cash. From 495 Productions.

MTV also announced a handful of returning series to its lineup: The Hills, Rob Dyrdek’s Fantasy Factory, Nitro Circus, Randy Jackson Presents: America’s Best Dance Crew and Run’s House.

SUR Peru, a channel for Peruvians in the US will exclusively air the top-rated show in Peru, Al Fondo hay Sitio (There is Room in the Back). Al Fondo hay Sitio will be broadcast on SUR Peru the same day it airs in Peru. Additionally, SUR Peru acquired four other popular programs including Pataclaun, El Especialista (The Specialist), Torbellino (Whirlwind) and Por las Rutas del Pisco (The Pisco’s routes).

MGM Networks, a unit of MGM Studios Inc., is launching a Portuguese language version of MGM HD Channel on SKY Brazil. The standard-def version of MGM Channel has been available to Brazilians since December 1997. This is the fourth global launch of MGM HD Channel as the network launched in Poland in December 2006; followed by roll outs in the US in October 2007; and Israel in April 2008. 

~ ELSEWHERE IN CYNOPSIS ~

CYNOPSIS DIGITAL – TODAY’S TOP STORY:  An MSO of all entities fired a major volley in what could become a broadband pricing war. Cablevision announced plans to roll out a super-high-speed Docsis 3.0 cable modem service across its footprint from May 11, offering download speeds of 101 Mbps for $99/month. (That’s quite a value compared to rival Verizon, which sells its 50 Mbps up/20 Mbps down FiOS fiber service for $140/month, similar to the price point for Comcast’s 50 Mbps “wideband” service.) Cablevision also announced it is doubling the speed of its wireless internet access via Wi-Fi to 3 Mbps, offered for free to customers in selected service areas.   Full edition: CYN DIGITAL.

CYNOPSIS KIDS – TODAY’S TOP STORY:  The Australian federal government is granting money to the Australian Broadcasting Corporation (ABC) to create a new dedicated kid’s TV channel, which will be titled ABC3.  The new digital kid-targeted ABC3 channel will feature existing ABC Kids series, currently airing on ABC TV (Australia) as well as newly commissioned and acquired programming.  ABC3 will be available free of charge and without advertising to all Australian households.  The ABC is counting on ABC3 being another reason for Australians to convert to digital TV.  The ABC currently offers preschool and/or kid programming on its ABC1 and ABC2 channels.  No word yet about a specific launch date for ABC3.  Full edition: CYN KIDS .

Saturday – A18-49 Analysis: Cutting it close, FOX emerged the winner Saturday night with the A18-49 demo at 1.2/5, according to final national ratings from Nielsen Media Research. In fact, ABC was just a smidge behind FOX overall at 1.2/4 while a three-way tie for third place occurred among CBS, NBC and UNIV all at 0.8/3 At 8p, ABC’s Harry Potter movie and FOX’s double Cops episodes tied for #1 at 0.9/4. FOX edged into the winner’s seat at 9p with AMW: America Fights Back and a 1.4/5 with ABC directly behind with its movie at 1.3/4. ABC was the sole leader during 10p as the final hour of the movie did a 1.4/5, this time ahead of CBS’ 48 Hours Mystery at 1.3/4.

Tried and true America’s Funniest Home Videos on ABC was the early winner at 7p with 2.3/8 with CBS’ 60 Minutes next at 1.5/5. CBS had its only #1 at 8p with Amazing Race 14 delivering a 3.2/9 while ABC slipped to second place with Extreme Makeover: Home Edition at 2.7/8. ABC made a comeback at 9p with Desperate Housewives and a top-rated 4.7/12 with FOX following at 3.0/8, the average of Family Guy and American Dad. Sparks may have flared on NBC’s Apprentice 8 propelling the series to #1 during 10p at 3.4/9 which put ABC’s Brothers & Sisters in second place with 3.1/8.

Virgin Media Television snagged Sophie Wurzer to be Commissioning Editor of LIVING, joining this week after three years at Target TV as Head/Development. In her new position, Sophie will report directly to Mark Sammon, Head/Commissioning, Virgin Media Television.

Peter Haffenberg was named Group Account Director of North America with The Brand Union, a division of WPP. Peter comes to The Brand Union from Stockholm-based Grow where he served as Partner/Brand Director.

Disney Interactive Media Group (DIMG) added Courtney Simmons as VP/Communications where she will manage all communications for the unit responsible for the development and execution of Disney branded interactive entertainment content for multiple platforms globally on behalf of The Walt Disney Company. Based in North Hollywood, Courtney will report to Steve Wadsworth, President, DIMG and Zenia Mucha, EVP/Corporate Communications, The Walt Disney Company.
