The US District Court, Eastern District of Texas ordered Dish Network and its sister company, EchoStar Corporation to pay damages to TiVo Inc. totaling approximately $200 million. The pay-out is the result of a contempt of court ruling where EchoStar was ordered to stop offering its DVR service following a patent-infringement ruling. Originally, TiVo was asking for nearly $1 billion for the contempt of court after the court gave out a permanent injunction in the 5+ year case. Total damages and sanctions in the case total around $400 million.

Tonight, Discovery’s Planet Green debuts its new weekly programming block Shifting Gears showcasing four programs about autos and innovations. The block begins with new episodes of Invention Nation at 8p followed by Mean Green Machines at 830p and two new one-hour series Planet Mechanics at 9p and Coolfuel at 10p. In addition, Planet Green opens the weekly documentary series, Reel Impact this Saturday beginning with the world television premiere of The Last Beekeeper at 8p. Other film titles in the series include A Sea Change, Black Wave: The Legacy of the Exxon Valdez and classic films like The 11th Hour and An Inconvenient Truth.

Nielsen said Hispanic TV homes are growing at a faster rate (+2.3%) compared to total US TV homes (+0.3%) for the 2009-2010 season. For the new season, African American TV homes will increase by +0.3% and Asian homes at +0.8%. Total US TV households will now equal 114.9 million; African American TV homes are at 14.0 million; Hispanic TV homes at 12.95 million; and Asian TV homes at 4.78 million.

FUEL TV brings back new seasons of two series later this month:

  • Firsthand – Season 11 introduces viewers to such action sports athletes as BMX-er Dave Mirra, FMX pro/X Games Gold Medalist, Travis Pastrana, snowboarder/Olympic Silver Medalist Danny Kass and more. The series, premiering at 8p on September 27 profiles each athlete and how they lead their daily lives.
  • The Adventures of Danny & The Dingo – Season two goes inside the lives of pro snowboarders, Danny Kass and snow personality The Dingo and the other members of the Grenade team as they travel three months on the road. Series premieres September 27 at 830p.

Clarification: ION Television broke the Guinness World Records for the Largest Moving Box during an event last week held at New York’s Times Square to promote the network’s new original series Durham County. The 42 ft. x 16 ft. x 8 ft. box was constructed by ION which beat current record holder Denmark-based Aarhus Business College. ION also used the giant box for a contest where 20 participants searched through thousands of biodegradable packing peanuts to find a winning key to a door containing $100,000. The winner, Stephanie Kelly of Kearny, NJ, is a single mom with two teenagers who plans on using the money to refinance and keep her home.

~ DISTRIBUTION, CLEARANCE & CARRIAGE ~

Hallmark Channel acquired the cable rights to Jack Hanna’s Animal Adventures from distributor Litton Entertainment. The show will begin on Hallmark Channel October 3 and air from 6-9a on Saturdays as well as on Sunday mornings from 8-10a. Hallmark Channel also holds the show’s digital rights in order to distribute the series under the Hallmark umbrella on such sites as iTunes.

~  PRODUCTION & DEVELOPMENT  ~

Food Network approved a second season of Ten Dollar Dinners, starring Melissa d’Arabian, winner of the network’s The Next Food Network Star: Season 5. The daytime series airs on Sundays at 1230p and production on 13 new episodes will begin this December to air early 2010. In each episode, d’Arabian shows viewers how to make a delicious meal for four people with a ten dollar budget.

Casting Notes:

  • Shirley Jones will appear on ABC Family’s series Ruby and the Rockets playing mom to David Cassidy’s character, roles they both played in the classic TV show The Partridge Family. In real life, Jones is also Cassidy’s stepmom.
  • Following the news NBC’s Saturday Night Live added two new cast members for its 35th season opening on September 26, the show also cut two of its cast. Michaela Watkins, who made her debut on the show last season, did not have her contract renewed. Watkins did impersonations of Arianna Huffington and Today’s co-host Hoda Kotb. Also let go was Casey Wilson, who impersonated Jennifer Aniston, Rachael Ray and others since she joined in 2008.
  • Bella Thorne, last seen on NBC’s My Own Worst Enemy and ABC’s Dirty Sexy Money, will play a recurring role during the fourth season of HBO’s drama Big Love, cites THR. Thorne will portray Barb’s (Jeanne Tripplehorn) daughter Tancy, replacing Jolean Wejbe.

CYNOPSIS DIGITAL – TODAY’S TOP STORY:  Google is making concessions to European publishers, authors, booksellers and copyright holders who have voiced concerns about Google’s plans to create a digital clearing house for out-of-print titles. Books which are out of print in the U.S. but still available for sale elsewhere will not be added to the Google Books compendium; instead the company has agreed to negotiate digital rights for these titles with individual European publishers and authors. Google reached a settlement with authors and publishers in the U.S. plan to digitize and sell books online, currently under review in U.S. District Court in New York. Meanwhile, Google also issued a privacy policy for the book project late last week to assuage privacy concerns regarding the project’s data collection practices.    Full edition: CYN DIGITAL.

CYNOPSIS KIDS – TODAY’S TOP STORY: CBS and Cookie Jar Entertainment will launch Cookie Jar TV, a three-hour Saturday morning kids block, on Saturday, September 19 on CBS.  The newly named Educational/Informational compliant block for the 2009-10 season will include episodes of Busytown Mysteries and Noonbory & the Super 7 as well as episodes of Sabrina: The Animated Series.  The Cookie Jar TV schedule will generally look as it does below, though its day and times may differ market-to-market and in some markets CBS News’ The Saturday Early Show will air 9-11a.  Cookie Jar TV takes over for the Kewlopolis (2007-9) Saturday morning block that had been originally programmed by DIC Entertainment, which was subsequently acquired by Cookie Jar Entertainment.  Kewlopolis replaced KOL Secret Slumber Party on CBS (2006-7), also programmed by DIC, which in turn took over for the Nickelodeon programmed Nick Jr. on CBS (2000-6) and which became Nick on CBS in 2002.  Prior to fall 2000 CBS programmed its own kid-targeted Saturday morning block.
