Good morning, it’s Thursday, November 5, 2009, and this is your first early morning digital briefing.
New York Attorney General Andrew Cuomo filed a lawsuit against chip giant Intel for threatening computer manufactures, conspiring with rivals and making billions in illegal payment to pressure them into keeping “Intel Inside” of their PCs. Cuomo claims that Intel also threatened to and did in fact punish computer makers that they perceived to be working too closely with Intel’s competitors. Threats included cutting off payments the computer maker was receiving from Intel, directly funding a computer maker’s competitors, and ending joint development ventures. The company has vowed to fight the suit.

Warner Bros. Entertainment is launching a new general entertainment digital linear channel in Asia next year, dubbed WarnerTV. The channel, to be distributed exclusively by Singapore-based HBO Asia, will feature Warner series including The Mentalist, Fringe, Dark Blue and Southland.
In an extension of the video viewing party concept, ABC.com is introducing a new social commentary feature within its full episode video player, enabling viewers to share comments with friends using Facebook Connect. Beginning this Saturday, Nov. 7, users will be able to share fan commentary tracks, read expert commentary and follow along with the peanut gallery of their friends while viewing episodes of the new hit series. (The alien-themed remake premiered on Tuesday with a 5.0 rating in the 18-49 demo.)
PlanetGreen.com is whistling a new tune with the launch of a new web instrumental web site showcasing performances and artists who are dedicated to social change. New content including free MP3 downloads, video, original interviews and industry news will be introduced weekly from likely candidates including Bono, Jackson Browne, Moby and Jack Johnson.
New York public broadcaster WLIW21, a WNET.org station, is launching a new video portal this morning, making thousands of hours of full-length episodes available including locally produced programs such as New York War Stories, Going Green Long Island, and the Emmy Award-winning New York The Way It Was series. Search for shows by theme, episode, host and date.
Barry Diller’s IAC may fold its male comedy site CollegeHumor.com into Ben Silverman’s new branded entertainment start-up, Electus, per Ad Age. The entire Connected Ventures unit, the parent company of CollegeHumor and just-launched TV production arm Notional, would fall under the management of former NBC Entertainment chief Silverman if the deal goes through.
Social marketing start-up uSocial.net has a new money making scheme – charging a fee to boost views of videos on YouTube. Using “several of our methods,” uSocial CEO Leon Hill says he can deliver unknown videos to “potentially millions” of people. General audience boosts are cheaper than targeted YouTube views; the company is charging $941, for instance, to boost targeted views by 100,000.
Call for Content: Social network template provider Ning is launching an Appathon competition tomorrow to convince third-party developers to come up with new apps for the platform. Tonight’s event will include presentations from Ning executives, third-party developers that are already part of Ning Apps including Talkbox, Box.net and Cartfly as well as an update on OpenSocial from a Google representative. The panel of judges reviewing the app submissions include Ning Co-Founder Marc Andreessen, Robert Scoble and Wired‘s Chris Anderson.
Online video ad serving company Adapt.tv announced that its OneSource product has become the first dedicated video ad serving platform to earn ad measurement certification by the Interactive Advertising Bureau (IAB), joining display ad servers such as DoubleClick’s DART, Atlas AdManager, and Yahoo’s APT. Earning the IAB seal of approval meant undergoing an independent audit against audience measurement and ad campaign reporting guidelines, insuring that measurement standards are met.
Online advertising start-up Rocket Fuel says it is having success with Audience Booster progressive targeting platform. The system combines relevant demographic, lifestyle, purchase intent, and social data with its own suite of targeting algorithms, blended analytics and expert analysis. It also takes a novel approach to social data, identifying demographic and psychographic traits to boost response, engagement, word of mouth and collective behavior, as well as bring together social groups with common interests in brands and products.
Good old fashioned belt tightening, rather than the growth from digital platforms, seem to be getting the media giants through this tough patch. Despite lower earnings from MySpace and the Fox Interactive Media group, News Corp. saw net income rise 11% to $571 million. (Part of FIM’s shortfall was related to not meeting guaranteed contextual ad sales targets in a search deal with Google.) Time Warner‘s profits fell by 38% during Q3, amid the weak performance at AOL and the Time Inc. magazine division. Revenues were down 23% to $777 million at AOL, resulting from a 29% decline in subscription revenues and an 18% decrease in ad revenues. Overall, Time Warner posted a profit of $661 million, down from $1.1 billion from a year earlier.
Microsoft announced that it will cut 800 more jobs across the company, following the 5,000 cuts announced last January.
Although the economy is putting a damper on major purchase decision, consumers are still planning to splurge on high end products such as electronics, computers, video games and clothing during the holiday season, according to a new panel study being released by About.com today. Nearly half of shoppers say they will go online this year to compare prices before pulling the trigger, and many are starting the process earlier than usual. Also, 76% of respondents said they are not going to travel or are less likely to travel for the holidays this year.
Apple’s App Store tipped the scales this week offering its 100,000 app. More than 2 billion apps have been downloaded to date.
Sony Computer Entertainment America has filed a patent application for an interactive TV technology that would superimpose viewer-controlled avatars over a TV show or movie, reports ITVT.
Sister company Sony Creative Software announced the availability of 1,000 Ringtone DVD for $19.95 geared for iPhone users, containing ringtones grouped into three categories: music, sound effects, and spoken words and phrases. Users can select tones for use in incoming calls, emails and text messages.
Online content network Adconion Media Group has appointed Cliff Paulson as VP of North American Video, reporting to Keith Kaplan, Adconion’s President of North America. Cliff most recently served as VP of Sales for ScanScout. The company also added three new sales staffers: Michelle Perno was named Sales Manager for the Chicago office and both Kathleen Alix and Kelly de Castro have joined the New York office as Account Managers.
Those of you PC’s users who have never bothered to reset their homepages will be happy to hear that MSN is previewing a spiffy new redesign. Finally turning away from the idea that more is better, the new site finally features liberal use of white space. The new Bing “decision engine” takes center stage and is more deeply integrated across the site. Content is organized into categories (News, Entertainment, Sports, Money, Lifestyle, Local) and subcategories (Latest, MSNBC, Fox Sports, Celebs, Autos, Cooking, Games.) There are also a few customizable widgets, offering weather and access to hotmail, although it’s shocking how few customization features are offered. Netvibes and iGoogle continue to lead the way in this arena, but Microsoft seems to be making the judgment call that most users don’t want to have to bother to set up their own content widgets.
Correction: Travel Channel’s Halloween-themed programming event was called “Ghost Adventures Live,” a live paranormal investigation conducted directly from the Trans-Allegheny Lunatic Asylum. Also, Travel Channel, launched by Trans World Airlines in 1987, has been a Cox Communications subsidiary since May 2007, although Discovery still distributes the channel.
