The French Constitutional Council has overturned the French government’s controversial “three strikes” law that permits ISPs to disconnect repeat internet file sharers from the internet. The council categorized access to online communications as a “human right” that only a judge should have the power to take away from an individual. The law, the strictest measure yet drawn up to try and prevent online piracy, passed the French parliament on its second attempt in May with staunch support from the international music and film industries.

Qualcomm’s linear mobile Flo TV service will expand from 68 to 84 markets next week following the digital transition and hopes to be in 100 market by year end, reaching several large markets including Boston and Miami for the first time. The service, offered through AT&T and Verizon, delivers about 20 national broadcast and cable programming services, costing consumers about $15/month in extra fees. The next step for Flo TV will be to launch new products such as a DVR-like recording feature and social networking component and to work on reducing the cost of tuner chips for phone manufacturers, according to Flo TV VP/Programming Mike Bailey.
Comcast will launch its first set of walled garden TV shows on the web to a test group of subscribers in the coming weeks, reports Bloomberg. Negotiations with Time Warner and other programmers are still underway regarding which channels will participate in the “OnDemand Online” experiment.
Time Warner’s Turner Classic Movies is launching its own online social network for cinefiles. The TCM Classic Film Union utilizes rare film photos and video clips to spur discussions about old movies and stars and allows members to trick out their profiles by adding thumbnail images and video clips. Univision.com has redesigned its Hispanic market-leading homepage simplifying navigation, adding more white space and improving integration with social networking features. The site averages more than 39 million monthly uniques and 13 million monthly video streams according to Univision Interactive Media.
AMC is making the first two seasons of the addictive Mad Men available On Demand in both standard and high-def starting Monday, leading up to the premiere of season 3 on Aug. 16.
Facebook announced that it will release new vanity usernames this Friday night, allowing users to swap out the number-laden URL of their profile with their real names or an assumed one-word handle (at least 5 characters in length.) Needless to say, only one user can pick each name so there’s going to be a mad rush. Make sure you’re ready to go at exactly 12:01 AM ET – here’s the link.
Video sharing site Metacafe is launching a new premium short video section featuring clips from popular broadcast and cable shows, per the WSJ. Metacafe’s TV clips channels features shows, extras and behind-the-scenes footage from networks such as CBS, NBC, Showtime, the CW, TBS and TNT.
Anime/manga publisher and licensing agent VIZ Media is launching a channel in the new Anime category on the PlayStation Networks video delivery service, accessible via the PS3 and the PlayStation Portable. Standard def, English-dubbed episodes of Naruto, Bleach, and Death Note will be available for download for $1.99 each.

The U.S. Government is stepping up it’s multi-pronged probe of Google as the company moves to launch its own free domain online book service, per the WSJ. The Justice Dept.’s new antitrust team, led by attorney Christine Varney, is leading the books search inquiry and is also looking into charges that Google has agreed with other tech firms not to “poach” each others’ executives. Meanwhile, the FTC continues to examine Google CEO Eric Schmidt’s role as an Apple board member as well as current industry standards on behavioral advertising.
The ad supported internet contributes some $300 billion and 1.2 million jobs to the national economy (making up 2.1% of the total U.S. GDP) so lawmakers should twice about upsetting the apple cart in the name of privacy control, according to a new IAB-commissioned study released yesterday by two Harvard professors. The IAB released the study at a meeting of small publishers who convened to urge Congress to avoid legislation that would adversely affect their business models. “The internet of today exists largely because firms pay its costs in exchange for the benefits of an advertising, marketing, and transaction medium, much as television has thrived because firms valued it as an advertising medium,” reads the Hamilton Consultants report. “But the internet is more than a medium of commerce. It has produced large social consequences, very different in scope and scale from those of television. It is an infrastructure and a platform, and, consequently, its benefits are broad and open-ended.”

Friday’s digital transition is finally upon us and 2.5% of U.S. homes or 2.8 households are still unready to receive signals, according to Nielsen. Among the 56 local markets that Nielsen measures with electronic meters, the one that is least ready is Albuquerque-Santa Fe, with 7.6% of the households completely unready. The markets with the most unready households tend to be in the Western United States, where cable penetration is lower. The most prepared markets are in the Eastern U.S.
Now the bad news for existing iPhone users: AT&T is going to charge you an arm and leg to upgrade your phone to the new video-capable 3G S if you’re still under contract. (We always knew the $199 price was a carrot for new subscribers only.) The 16-GB model is going to cost $399 and the top-of-the-line 32 GB model will set you back $499. Needless, to say the outrage is mounting; more than 4,200 have signed on online “twitition” to lobby AT&T to be reasonable. The issue calls attention to a longtime problem for carriers – how to balance the need to attract new subs by subsidizing the cost of cool handsets with the desire to keep loyal customers happy.
Following Apple’s developers conference this week, buzz is building fast about a new app from GPS device maker TomTom that will turn the iPhone into a full-fledged navigation device. It will offer turn-by-turn visuals and voice-guided directions, just like the TomTom devices made for the car. It will even come with a special car harness/charging dock that mounts the iPhone to the windshield or dash.
Virgin Mobile USA announced the launch of Broadband2Go, a 3G nationwide wireless internet service without an annual contract, monthly subscription or activation fee. “Top-up” cards can be purchased for data usage at the rate of $20 for 250MB, good for 30 days after purchase. The service is activated using a small portable PC, Linux or Mac-compatible modem, available exclusively at BestBuy for $150.
Cable industry interactive joint venture Canoe Ventures appointed Kathy Timko as COO, effective June 1. Kathy most recently served as COO of Carrier Services at telco company IDT. She will report to David Verklin, CEO of the venture.
Erin Gray, star of Buck Rogers in the 25th Century and Silver Spoons, has signed on as Casting Director for Hayden Black’s new Sci Fi spoof The Cabonauts via her booking agency, Heroes for Hire. The show launches on Dailymotion later this year.
One of the more interesting economic applications to be developed on the web is the idea of microlending – extending very small loans to entrepreneurs in developing countries who have no access to traditional credit. (This isn’t cyberbegging, as illustrated in this season of AMC’s Breaking Bad – these loans are paid back.) San Francisco-based Kiva.org has been facilitating bets on small businessmen in more than 185 countries since 2005 and the site just announced it is opening up its services to benefit cash strapped idea people right here at home. Loans can be placed in increments as small as $25, usually extended for a period from 6-12 months. What’s cool about the site is that it allows you track the progress of the venture you’re funding through the site’s social networking features. Kiva will send updates to your email, Facebook page or mobile account. The Kiva World app allows you to track loans across entire regions. The site has been a huge success in developing countries – attracting $75 billion in loans to date with a repayment rate of 98.35%, according to co-founder an CEO Matt Flannery.
