Good morning, it’s Monday, September 21, 2009, and this is your first early morning digital briefing.
The FCC will no longer remain neutral on the controversial net neutrality issue, according to published reports. FCC Chairman Julius Genachowski is expected to give speech on Monday to transform existing net neutrality principles into codified rules that specify how internet service providers are allowed to manage the flow of traffic on their networks. The rules, which will be extended to include both broadband and wireless networks according to the WSJ, will make it impossible for the Comcasts and AT&Ts of the U.S. to block or throttle services based on what kind of content is being delivered or how much bandwidth is being consumed. The new rules, long advocated by content providers like Google, could open up the net to new data-intensive services.

Variety joined the pay for play push, announcing that beginning next year much of its web content would again be available only to paid subscribers. Variety dropped its pay wall in early 2007 when it launched a new digital edition, helping to increase its unique user base to over 2.5 million.
MSNBC.om unveiled a new web home for Meet The Press with David Gregory, featuring on demand embeddable video interview excerpts and transcripts, along with new interactive features that allow users to follow David’s Twitter feed and connect to his Facebook page.

Popular Adobe Air-based Twitter desktop interface Seesmic Desktop has released a new version of its software that allows users and marketers integrate posts on both Twitter and Facebook - a useful shortcut for brand promotion. New features include a reply-to-all option that allows users to reply to all of the usernames listed in a given message – handy when re-tweeting because it will Retweet the exact text of the message. Also a new partnership with Twitter photo sharing tool YFrog allows you to click on the camera icon in either client to instantly post photos to Twitter.

The latest effort to rejuvenate the flagging display ad market is Google‘s DoubleClick Ad Exchange, an open exchange that enables advertisers to bid on space across a network of sites. The technology is built upon DoubleClick’s proprietary Dynamic Allocation system, acquired with Google’s $3.1 purchase of the company in 2007. The system provides publishers with a real-time reading of what buyers are willing to pay, giving sellers the opportunity to maximize returns on their inventory, while maintaining more control than so-called remnant ad solutions.
The U.S. Dept. of Justice weighed in on Google’s proposed book search settlement with authors and publishers, saying it should be rejected in its current form but that the parties involved should continue ongoing discussions. “Because a properly structured settlement agreement in this case offers the potential for important societal benefits, the United States does not want the opportunity or momentum to be lost,” the DOJ stated.
Joltid and Joost , both owned by Skype founders Niklas Zennstrong and Janus Friis, have filed another lawsuit targeting former Joost CEO Mike Volpi. The suit claims that Volpi breached his fiduciary duty as CEO by using confidential information to broker the tentative deal to acquire a majority stake in Skype. Volpi left Joost after two years at the post this past July to take a position as a partner at the venture capital firm Index Ventures. Index was part of the group that struck a deal to acquire a 65% share of Skype from eBay during the summer.
Google made the letter it wrote to the FCC public, revealing its interactions between Apple over the rejection of the Google Voice application for the iPhone. (When originally submitted on Aug. 21, Google had redacted portions of the letter retaining to negotiations between the two companies.) Google says that the Google Voice app was rejected because it duplicated certain core functionalities provided by the iPhone. The Google Latitude app was rejected for the same reason – it duplicates functionality of the main mapping app, which was also developed by Google. Apple has maintained that Google Voice was never formally rejected and that discussions regarding its acceptance are still ongoing.
The American Society of Composers, Authors and Publishers (ASCAP), Broadcast Music Inc. (BMI), and other performing-rights groups are seeking to collect performance fees from digital retailers such as Apple for music contained in TV shows and films as well as from single tracks, reports CNET. Trade group the Digital Media Association, representing groups like Apple, RealNetworks and Pandora, say such fees would constitute “double-dipping” as producers already pay synchronization fees for the right to include music in entertainment properties.
Following Yahoo and ESPN’s lead, CBS Sports Mobile released its CBS Sports Mobile Football app for iPhone and iPod touch, giving players access to fantasy scoring updates from their specific team and league, breaking player news, and fantasy advice from CBSSports.com Fantasy gurus. The app also includes lots of general NFL coverage, including live scoreboards, stats, and video on demand highlights.
Here are a couple of cutesy solutions to a practical problem: the Pogo Stylus and Pogo Sketch gizmos from Ten One Design are pens designed to allow women with long nails to manipulate the touch screens of the devices like the iPhone and the Palm Pre. Both are available for $14.95 each and come in multiple colors, (including hot pink.)
iTV provider Ensequence announced that it has secured $20 million in funding and that it has named former MTV and BET distribution executive Peter Low to President & CEO. Dalen Harrison, the company’s former CEO, will remain with the company, joining its board of directors.
Soon-to-be relaunched entertainment and celebrity site HollywoodLife.com has hired Will Lee as Executive Editor. The former TMZ New York bureau chief will be based in New York and report to HollywoodLife.com President and Editor-in-Chief Bonnie Fuller.

The Emmys are like the Super Bowl for folks in the TV business and this year proved to be a more interactive experience for users who sat and watched the show with their laptops. Mobile video service Kyte powered live streaming coverage from the Red Carpet with full Facebook and Twitter integration. Comcast’s EOnline.com provided similar functionality, aggregating celebrity Facebook and Twitter posts leading up to and through the evening’s festivities. CBS, which had the Emmy telecast rights this year, joined the fun with a live Emmy Blog on TV.com, allowing users to send in comments or vote in polling questions. Entertainment websites are the testing ground for interactive activities at the moment, and they should help incubate some cool on-screen apps that cable providers could have up and running in time for the Emmys next year.
