Good morning. It’s Monday, November 24, 2008, and this is your first early morning briefing. 

Apparently confident after its oral arguments in the FOX profanity appeal case, the FCC, with support from the Department of Justice, filed a petition for a writ of certiorari last Wednesday, asking the Supreme Court to overturn the CBS Janet Jackson Super Bowl halftime show decision. The FCC contends last July’s ruling from the Third Circuit Court of Appeals was flimsy. Ruling against the FCC, the lower court took away the FCC’s $550,000 fine to CBS stations saying it was “arbitrary and capricious.” The FCC also asked the Supreme Court to hold this new petition until after a decision is reached in the FOX case.

~ MORE GOOD STUFF ~

Shake-ups are happening with ABC’s primetime schedule. Last week, ABC announced to the producers of Pushing Daisies, Dirty Sexy Money and Eli Stone it will not order additional episodes of any of the three series. ABC says it might order episodes in the future yet that is considered unlikely, though the network has not officially cancelled any of the three one-hour programs. ABC did order more episodes of Life on Mars and beginning December 11, the series will go into hiatus and Private Practice will move into its time period. Life on Mars will resume January 28 at 10p following Lost which premieres the previous week. In addition, ABC will debut Scrubs on January 6, with two 30m episodes airing back-to-back the first two weeks then falling into the 930p slot. Although, per TV Week, ABC is also toying with the idea of scheduling Scrubs on Tuesdays at 9p, followed by the new Better Off Ted at 930p.

Over on NBC, a couple of shows will change places as Crusoe moves to Saturdays starting December 6 and Lipstick Jungle slides into the 9p Friday slot vacated by Crusoe beginning December 5, cites Variety. Lately, Lipstick Jungle has aired at 10p Fridays and since it has done better than expected in this time period, NBC opted to schedule its four remaining episodes airing them December 5 and 12 and January 2 and 9. On Fridays, Lipstick Jungle will be flanked by Deal or No Deal at 8p and Dateline NBC at 10p.

Members of the Screen Actors Guild may bring Hollywood to its knees a second time this year, as strike talks are looming. Two days of discussions, monitored by federal mediator Juan Carlos Gonzalez, did not produce an agreement between SAG and the Alliance of Motion Pictures and Television Producers. When the two entities parted, SAG offered this statement: “As previously authorized by the National Board of Directors, we will now launch a full-scale education campaign in support of a strike authorization referendum. We will further inform our members about the core, critical issues unique to actors that remain in dispute.” Even though SAG is alluding to a possible strike no actual ballot distribution timeline has been issued and 75% of its 120,000 voting members would have to agree a strike is necessary, which is something SAG leaders in the past have doubted would happen.

Fans of NBC’s The Office can view a larger dose or “producer’s cut” of the November 20 episode via NBC.com. The online-only episode, containing added scenes and extra footage, will be available tomorrow.

Fox is ditching its Saturday morning kids block altogether and will replace it with infomercials come January 2009, according to a report in Variety.  This comes on the heels of news earlier this month that Fox settled its lawsuit with 4Kids Entertainment, which will effectively end the 4KidsTV four-hour Saturday morning kids programming block (8a-12p), currently airing on Fox, at the end of December 2008.  Fox’s new two-hour infomercial block, entitled Weekend Marketplace, will air 10a-12 noon and has been cleared on 95% of Fox affiliates.  The remaining two hours previously included in the 4KidsTV block are being returned to the affiliates.  The 4KidsTV block had provide affiliates with 30 minutes of the FCC mandated three hours a week of kid-targeted educational programming.

~ DISTRIBUTION, CLEARANCE & CARRIAGE ~

Tyra Banks will have a second show on The CW  the first being America’s Next Top Model, and now also moving to the network in September ’09 is her first-run syndicated The Tyra Banks Show. It will be the start of the show’s fifth season.  Distributed by Warner Bros. Domestic Television Distribution and produced by Bankable Productions in association with Telepictures Productions, the one-hour talk show will air in double runs Monday-Friday from 3-4p and 4-5p. The deal allows new episodes of The Tyra Banks Show to air in syndication on its affiliates through the 2008-09 season. Switching places, WBDTD will take Telepictures Productions’ court show Judge Jeanine Pirro into first-run syndication, serving it to stations for fall 2009. The court show is currently airing on The CW in a weekday two-hour programming block from WBDTD at 3-4p followed by The Wayans Bros. and The Jamie Foxx Show at 4-5p.

MTV pulls double duty as a new season of A Shot at Love – aka A Double Shot at Love – comes back December 9 at 10p with twin sisters Rikki and Vikki looking for love among a group of straight guys and lesbians. 495 Productions produces the reality-competition series.

~ ELSEWHERE IN CYNOPSIS ~

CYNOPSIS DIGITAL – TODAY’S TOP STORY: Musicians and web celebrities gathered en masse for YouTube‘s first-ever live webcast on Saturday including Michael Buckley, will.i.am and of course Obama Girl. The concert attracted a less-than stellar 700,000 concurrent viewers at its peak according to a TechCrunch analysis of streaming partner Akamai’s active stream data. (MSN’s Live Earth concert reached more than 10 million during its last event, by comparison.) Incidentally Black Eyed Peas front man will.i.am will also appear in the next Live Earth concert on Dec. 7 at Andheri Sports Complex in Mumbai India, along with Bon Jovi, Roger Waters and a variety of Indian stars.  Full edition: CYN DIGITAL.

CYNOPSIS KIDS – TODAY’S TOP STORY:  Summit Entertainment‘s movie Twilight opened this weekend in 3,419 theaters earning an estimated $70.5 million, according to Box Office Mojo, making it the fourth largest opening ever for November.  Of the total weekend take, the movie grossed $35.8 million on Friday alone to become the second biggest opening day for a non-summer movie, behind Harry Potter and the Goblet of Fire, which rang in at $40.4 million on its opening Friday, November 18, 2005 in 3,858 theaters, per Variety.  The latter also notes that $7 million of Friday’s take came from the Thursday night midnight showings of the movie.  Summit had initially planned to release Twilight on December 12, 2008, but swooped in on the November 21 date when Warner Bros. announced in late summer its plans to shift its release of Harry Potter and the Half-Blood Prince from this weekend until July 17, 2009. CYNOPSIS INTERNATIONAL – TODAY’S TOP STORY:  Germany’s Interior Ministry has banned Hezbollah’s Al-Manar from the country as of November 11.  The government agency stated that the Beirut-based TV station’s programming was not allowed under the German constitution’s Article 9, part of which states that organizations cannot be run with the intention of violating “international understanding.”  As such, all satellite companies in the country cannot air the station.  Al-Manar, which has been banned in the U.S. since 2004, airs via satellite and locally but does not have a German physical presence.  This past weekend, the network’s director stated that the German ban violates global laws in place to protect media freedom.  Full edition: CYN INTERNATIONAL.

Thursday – A18-49 Analysis: CBS held sway over Thursday night with 3.9/10 A18-49, according to fast affiliate ratings from Nielsen Media Research. CBS thrived at 8p with Survivor at 4.0/11 with ABC’s Ugly Betty and the average of NBC’s sitcoms My Name Is Earl/Kath & Kim sharing second place at 2.5/7 each. ABC took top honors during 9p as Grey’s Anatomy finished first with 6.1/15 followed by CBS’ CSI at 4.9/12. NBC continued to reign during the 10p time period with ER at 3.5/9 with CBS’ Eleventh Hour at #2 with 2.8/8.
