Literally minutes before a court-imposed deadline, Google, the Authors Guild and the Association of American Publishers have returned with a revised settlement agreement that establishes a framework to allow Google to distribute millions of out-of-print book online. The changes address concerns from rights holders and authors – scaling back the number of countries covered by the pact to include only books either registered with the U.S. Copyright Office or published in the U.K., Australia, or Canada - while establishing new protections for potential rights-holders and authors. Google has also now written in a revenue split into the agreement. Book retailers such as Amazon, Barnes & Noble or local bookstores will be able to sell consumers online access to the out-of-print books with rightsholders receiving 63% of the split and retailers keeping the majority of the remaining 37% – equal to the share that Google retains. The DOJ is expected to comment on the modifications in the coming weeks.
TV may be made available Everywhere in the coming months, but don’t expect it to be available for free, according to comments made Disney CEO Robert Iger during the company’s conference call last week. The company, which recently named Rich Ross to head its movie studio, has had a tough year at the box office but has been buoyed by the performance of its TV networks including ABC, ESPN and Disney Channel.
CNN.com is doing away with its live digital anchor-hosted newscasts from today, instead shifting its focus to streaming live events and producing original video packages, per WebNewser. The move will result in the elimination of some jobs including anchors Reggie Aqui, Nicole Lapin, Naamua Delaney and Melissa Long.
History has launched History International HD, a new 24-hour high definition television simulcast network, joining the existing AETN HD lineup that currently includes History HD, A&E HD, Bio HD, CI HD, Lifetime HD and LMN HD. HI HD launches this month in Time Warner’s New York City and Los Angeles markets, Brighthouse’s Tampa and Orlando markets and Cox’s Kansas and Arkansas systems.
Media center software provider Boxee has signed a deal with a consumer electronics firm to produce the first “Boxee Inside” set top box, according to a company blog post. The start-up will show mockups of the box at the upcoming Boxee Beta Unveiling event in Brooklyn, NY on Dec 7.
Hollywood’s most prolific comedy director/producer Judd Apatow (The 40 Year-Old Virgin, Knocked Up) will drop by the Funny or Die writers’ room to answer fan-submitted questions on his latest film “Funny People,” coming out on DVD and Blu-ray on Nov. 24. The live chat will be held at funnyordie.com on Wednesday, Nov 18 from 12:30-1:00 pm PT.

Video platform providers Ooyala is announcing an extensive partnership with video ad delivery specialist YuMe this morning to help publishers monetize live online video streams. Ooyala’s Backlot dashboard interface will now include an option to specify ad insertion points for YuMe overlays when publishing a live video stream. Ooyala premium content customers will be able to receive overlay ads from major brands within their live video streams, providing a new way to monetize events that attract huge numbers but have failed to be adequately monetized. YuMe, which added the ability to support dynamic ad insertion back in 2007, claims it serves over 15 million in-stream video ads daily for more than 500 publishers.
Auto advertising may finally pull out of its tailspin in next couple of years as online plays an increasingly important role, according to a new report from Borrell Associates. Digital spending accounted for 5.2% of all ad dollars spent in 2009 but that share is expected to grow to 11.4% or $4.3 billion next year. In-cinema auto advertising will grow at an even faster clip, up 18% to $77.3 million.
Rupert Murdoch’s promise to remove News Corp.’s articles from Google’s search service will come to fruition sooner rather than later - in a matter of “months,” according to comments made by News Corp. Chief Digital Officer Jonathan Miller at a conference in Monaco covered by the UK Telegraph.
Publishers must act fact to change their business models and take advantage of new opportunities offered by advances in digital distribution, according to new white paper by research firm StrategyEye. Publishers should take note that:
- Google, aggregators (and now Twitter) increasingly ‘decide’ which sources audiences are directed towards – and will take a growing slice of available advertising pie
- New blogs, aggregators, micro-sites and Twitter subscribers are all crowding out mainstream sources – and in many cases breaking or, at least, virally spreading news
- Future value of traditional brands to next generation of audiences is highly uncertain
- Large editorial journalist bases are expensive and out of tune with new world – a shift to a blend of ‘investigative’ writers and ‘curator’ writers is needed to save costs and deliver as modern users want
- Users demanding personalization and centralized access to relevant content
- By leveraging the iTunes billing account, Apple has proved it can convince consumers to buy apps with micropayments through its tied iPhone applications store

Netbook market leader Acer has released a model that runs on either Windows XP or Google’s Android mobile operating system, now available on Amazon.com. The Acer AOD250-1613 features a 10.1-inch screen, 1GB of RAM and retails for only $350.
Dell confirmed plans to sell a smartphone designed to serve Brazil and the burgeoning Chinese market. The Mini 3 handset, also running on Android, will be available through China Mobile and Claro.
Lion Television Inc. has upped production executive Allison Corn to the newly created position of VP/Production and Development.
Apple caught flack last week when it rejected the clever Bobble Rep iPhone app from Mad Magazine’s Ray Griggs, which provides large-headed caricatures and contact info for all 540 U.S. Senators and Representatives. Shake the phone and the oversized heads weave and bob. (The reason given was that it was “defamatory” to the poor politicians – really? Political cartoons have been around as long as the printing press!) The negative publicity might have something to do with it reversing course, as the 99 cent app has now been approved. The App store’s seemingly draconian standards for approving applications have come under fire for being random, and at times, anti-competitive. But now that the Justice department is watching, it would seem that a sufficient blast of negative publicity can get spurned developers a second shot.
