12/05/05 Good morning. It’s Monday, December 5, 2005, and this is your first early morning Kids! briefing. The First Amendment reigned supreme again on Friday when Judge Matthew S. Kennelly, US District Judge of the Northern District of Illinois, handed down his decision in regard to the new state law preventing the sale of violent and sexually explicit video games to minors. The decision ruled the law as unconstitutional, and instituted a permanent injunction against it. The judge also said in his decision that the state was unable to persuasively prove that violent and sexually explicit video games have an ill effect on minors, causing them to behave more aggressively or violently. In fact, he said, it could be quite the opposite – that violent or aggressive children are drawn to these games. The Safe Games Illinois Act, which included monetary fines and possibly jail-time for retailers who did not comply, was signed in July 2005 by the state’s Gov. Rod. R. Blagojevich. That legislation was followed by a lawsuit filed by the Entertainment Software Association and the Video Software Dealers Association in tandem with the Illinois Retail Merchants Association. Similar legislation is pending in two other states – Michigan and California – and recently Senators Joe Lieberman and Hilary Clinton introduced the Family Entertainment Protect Act which would look to make it a federal law. Just about every video game related website and blog on the web is reporting there is more to Nintendo’s upcoming Revolution next generation game console than we currently know. Specifically, gamers are quoting Nintendo game designer Shigeru Miyamoto who, while speaking at the Digital Interactive Entertainment Conference in Japan, last week said in reference to the Revolution , “There’s another secret.” Of course, following in Nintendo’s tradition of both secrecy and cryptic hints, he refused to elaborate further, which keeps fans and possibly even industry folks hanging on with questions that won’t likely be answered until the big reveal that is expected to come at the E3 2006 (Electronics Entertainment Expo). In the event that you are already setting up appointments for E3, Nintendo has sent out a save-the-date email about its E3 media briefing (Tuesday, May 9, 9:30a), where they say all will divulged. MORE KIDS STUFF The My Little Pony holiday mini-film My Little Pony: A Very Minty Christmas (44 min) makes its TV debut today on Disney Channel at 11a and on December 10 on Toon Disney. This past October the movie was released in theaters for a limited time, screening as a weekend matinee nationwide. The mini-movie theatrical release was part of an agreement between Hasbro Properties Group and Kidtoon Films, and the film made its way to theaters via Screenvision digital network. The Hasbro and Paramount Home Entertainment movie is also be available on DVD and a sound track on CD, the latter of which is part of a licensing deal with the Hasbro Properties Group and Genius Products. Related toys include a Singing Minty plush from Hasbro and a bath set from Cosrich. On the publishing side, HarperCollins is slated to release A Very Minty Christmas reusable sticker book, Bendon Publishing will release coloring and activity books and Tokyopop will publish A Very Minty Christmas story as part of its Jr. Cine-Manga imprint. The recently formed Hasbro Properties Group is the intellectual property development unit of Hasbro. A new Hispanic teen-focused magazine titled Quince Girl will hit newsstands in key Hispanic markets in March 2006. The publication will center on the girls’ quinceanera – that is when they hit their 15th birthday and the years following – and the magazine will have mainly English-language content. It will center on fashion, beauty, planning and past quinceaneras profiles according to Portada. Additional internet content at www.quincegirl.com will support the magazine. Quince Girl‘s rate base will be 300,000. Amber Matassa was named to head up the editorial staff. MARKETING/LICENSING Unique Product Designs plans to launch its new IM:IT, an instant messaging brand that features common IM icons and shorthand on products, at selected Toys “R” Us stores in the US on a test basis in January 2006. Unique Product Designs has signed two licensing agreements with JC Kids (apparel/sleepwear) and Accessory Partners (stationery/bags/fashion jewelry). One of the Boys, a division of JC Kids, has introduced an IM:IT apparel line including girls/boys outerwear and sleepwear at retailers including Sears, Wal-Mart and Zellers’ in Canada. STONE SOUP Weekend Box Office Estimates for kids/tweens/teens rated G, PG or PG-13; December 2-4, 2005: Toy Industry Association, Inc. has announced the nominees for the Sixth Annual Toy of the Year Awards. The nominated products fall into eleven best T.O.T.Y. categories including:

Regular TIA members are invited to place their votes beginning today through January 9, 2005. The T.O.T.Y. Winners will be awarded at a ceremony on Toy Fair eve, Saturday, February 11, 2006, in NYC as a kick off for the American International Toy Fair, which officially opens its doors the following day February 12-15, 2006. EXECUTIVE MOVES Tripp H. Thornton, a 22-yr consumer products veteran, has joined The Brainy Baby Company as its EVP. Previously Thornton worked for companies including M&M Mars, Rubbermaid and Keebler and 13 yrs with the Wal-Mart Division. Additionally, Thornton worked on licenses including Veggie Tales, Hermie, Miffy, Thomas the Tank Engine and Disney products. RATINGS Cartoon Network‘s play of Foster’s Home for Imaginary Friends’ Christmas Special, A Lost Claus on Thursday, December 1, 7:30p rang in as the top program in its time period on cable in delivery with 1.017 million K6-11 and 690,000 Boys 6-11. Compared to the previous 4 weeks time period average, the Fosters holiday special was up for K6-11 by +51% in delivery.
