Good morning, it’s Friday, October 24, 2009, and this is your first early morning digital briefing.

Like Martin Luther nailing his 95 Theses of reform to the door of the Wittenberg Cathedral, FCC Chairman Julius Genachowski introduced his proposed rules to impose net neutrality principles and “reasonable network management practices” on the broadband industry. (For the record, there are 186 items in the FCC document.) The rules included restrictions against throttling traffic, suggestions for reducing the effect of network congestion, guaranteeing customers a certain quality of service, and preventing illegal uses of the network, including unauthorized transmission of copyrighted works. There was also more attention paid to wireless internet networks, soliciting cautious agreement from industry officials such as Verizon CEO Lowell McAdam and Google CEO Eric Schmidt. Rather than strictly codified rules, the document was presented as more of a guideline, to be hashed out among the stakeholders. The deadline for comments on the proposal is January 14, 2010; reply comments are due by March 5, 2010.

~ MULTIPLATFORM CONTENT NEWS ~

 
In the wake of declining DVD sales, Disney is getting ready to roll out a new on demand viewing technology dubbed “Keychest” next month that would allow consumers pay a single price then view a movie or TV show across multiple devices, per the WSJ. When a movie is downloaded an access code or “key” is generated that the user must manually enter in each time they try to access the content via internet, mobile phone, VOD service, etc.
 
Hulu
may begin charging for its content as early as next year, according to comments made at B&C‘s OnScreen Summit this week.
 
MySpace launched its own music video site a week before the planned launch of Vevo. Build playlists, search for and browse curated, popular and recently added embeddable ad supported music videos. The Artist Dashboard interface provides access to charts, graphs, and snapshots of MySpace Music data for all global artists, documenting fan geography, song plays, profile views, friend count, and profile visitors. An integration with iLike also provides top-line data from iLike partner networks.
 

~ INNOVATORS & START-UPS ~

 
Video portal Babelgum has given two of the world’s most infamous pranksters their very own channel. The Yes Men, (Andy Bichlbaum and Mike Bonanno) are a unique comedy duo that infiltrates events, companies and even newsrooms to spread their doctrine of compassion and environmental consciousness. Their second (hilarious) feature film “The Yes Men Fix The World” premiers today. 
 
Comcast’s white label online video services company thePlatform is introducing a new “Feeds Service” to help developers with the cumbersome process of getting approved by the iPhone’s App Store. The company has developed a sample application and sample code to help on formatting and interface issues.
 
Paris-based Dailymotion clarified that is raised an additional $25 million (17 million euros) in its latest funding round, led by the government-funded French Sovereign Fund (FSI) and including original investors Advent Venture Partners, AGF Private Equity, Atlas Venture and Partech International.
 

~ DIGITAL ADVERTISING ~

 
NASCAR and cinema ad firm Screenvision have entered into an agreement that will bring original, made for cinema, NASCAR content to the big screen for the first time. Each month, NASCAR clips will be added to the preshow entertainment line-up in more than 15,000 theaters nationwide. The partnership will include NASCAR content being added to in lobby interactive kiosks and 3D ad displays.

The winners will be formally announced at the awards ceremony at the CTAM Summit on Sunday.

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
Swedish handset giant Nokia has filed a lawsuit against Apple in Delaware District Court claiming that every iPhone released since 2007 infringes upon technological patents covering wireless data transmission, speech coding, security and infringement. 
 
Clearwire outlined the next few market launches for its 4G WiMax service. The “Clear” service will launch in co-investor Comcast’s hometown of Philadelphia, Chicago and Seattle in the coming weeks with partners Sprint and Comcast. Meanwhile Clearwire and Sprint will also launch 4G service in Charlotte, Greensboro and Raleigh, North Carolina; Austin, Dallas/Fort Worth and San Antonio, Texas in November, followed by Honolulu and Maui, Hawaii in early December.
 
Plano, TX-based iTV vendor BIAP has changed its name to FourthWall Media, as in breaking down the “fourth wall” or invisible barrier that stands between programmers, advertisers and the audience. The company’s iTV products including its EBIF platform is currently installed in some 25 million set tops globally.
 

~ EXECUTIVE MOVES ~

 
Audience measurement firm Rocket Fuel hired Paul Wenz as VP/Business Development, to be based in the company’s Redwood Shores, CA headquarters. The news comes on the heels of the addition of Calton Chan to the senior executive team and the addition of its New York office.
 
Luke Fredberg has been named Director, International Corporate Communications, CBS Corp., reporting to Dana McClintock, SVP of the CBS Communications Group. He will begin Oct. 26 and will be based in the London offices of CBS Interactive.

Eager to erase the Vista era once and for all, Microsoft began shipping Windows 7 on Thursday, designed to load faster, reduce clutter and simplify navigation (correcting common knocks against the Vista OS.) One thing you’ll notice right away is a new “taskbar” ­- providing a shortcut to launching programs, switching windows and previewing web pages. Besides that, it’s decidedly more media savvy. Unlike Macs, Windows 7 comes bundled with the necessary codec to play Blu-ray discs.  You can organize “libraries” of media files by file type (photos, movies, music, etc.), then turn any folder into a separate library. Windows Live Movie Maker makes it simple to edit movies. Microsoft Soapbox will host the finished product on the web for sharing. The system builds in streaming media tools that enable you to use your computer as a streaming media device. There’s even an option to publish the finished product instantly to YouTube. This OS is a huge step forward not only for Redmond, but also for the struggling PC industry at large. Those who haven’t defected to Mac during the Vista years have simply held on to their old Windows machines; this OS is expected to stimulate massive sales. Judging from Steve Ballmer’s remarks at the Windows 7 launch event in New York, the company thinks it has finally built a platform that can adapt to many kinds of users’ needs and help, instead of hamper, creativity. “Everybody finds their own set of unique features to fall in love with,” said Ballmer of the beta testing phase.
