Good Morning. It’s Friday, February 22, 2008, and this is your first early morning briefing. Yesterday, ABC filed an appeal in the U.S. Court of Appeals for the Second Circuit against the FCC. The point of contention is a 2003 NYPD Blue episode that the FCC declared indecent and on Tuesday fined ABC a total of $1,237,500 for the 45 affiliates that aired the program. Despite being opposed to the fines, ABC paid them in full yesterday, making the FCC decision appealable. ABC filed court papers yesterday 2nd Circuit U.S. Court of Appeals saying the FCC order is “arbitrary and capricious, contrary to the Commission’s own standards and past decisions, and in violation of the indecency statute and the First Amendment.” Tonight’s Premieres:

ABC’s Grey’s Anatomy will move back to its Thursday 9p time period which bumps Lost to the 10p slot starting April 24. Resuming production post-writer’s strike, Grey’s and Lost will each have five new original episodes. The verdict is still out though on when additional episodes of Eli Stone will air and when Men In Trees and Women’s Murder Club will return. TBS ordered eight new episodes of its late-night comedy series Frank TV, starring impressionist Frank Caliendo as he “channels” celebrities and pop culture icons such as Jack Nicholson, Al Pacino and President George W. Bush. The series, produced by TBS Productions, will return to TBS’ line-up later this year. CBS Interactive is dusting off some classic TV shows from the CBS Library and initially offering full-length episodes of Star Trek (seasons 1, 2 and 3), The Twilight Zone (seasons 1 and 2), and season one each of MacGyver, Hawaii Five-O and Melrose Place. Distribution will occur across the CBS Audience Network which is comprised of more than 300 websites and partners including AOL, Microsoft, CNET Networks, Comcast, and Joost, plus social application partners including Automattic, Brightcove, Clearspring and more, as well as websites from CBS’ owned television, radio and affiliated stations. The classic TV shows will be ad-supported, free to the user and available immediately. Later, more programs and clips will be offered in the coming months. Reed Elsevier is selling its Reed Business Information magazine unit that includes media and entertainment industry titles Variety, Broadcasting & Cable, Multichannel News and Publisher’s Weekly. The company indicated the move is about “reducing exposure to advertising markets and cyclicality” and it will now focus more on subscription-based information and offerings. Recently the company sold off its education division. Crown Media Holdings, Inc., owner and operator of Hallmark Channel and Hallmark Movie Channel, renewed its distribution alliance for Hallmark Channel with Time Warner Cable over a multi-year period. With this new agreement, Time Warner, which brings the Hallmark Channel to 12 million homes, will have the right to continue its distribution of Hallmark Channel in addition to the opportunity for distribution of the Hallmark Movie Channel and its hi-def version. The Sportsman Channel recently launched on Comcast’s digital basic systems in Hattiesburg and Meridian, MS, Shreveport, LA and in Little Rock, AR. Other system launches include Comcast of Carolina, Comcast of New Jersey and several NCTC systems. Steve Levin, a veteran Hispanic TV professional, lost his battle with cancer on February 20 at the age of 59. He lent his expertise to companies such as Telemundo Network Group, WNJU in New York, and KVEA in Los Angeles. Most recently, Steve was Si TV’s SVP/Advertising Sales, preceded by his position as EVP of Telemundo Network Group. He is survived by his wife of 20 years, Katheryne, and his three children: David, Rachel and Andrew. A memorial service for Steve Levin will take place on Sunday, February 24 at 230p at the Stephen S. Wise Temple in LA. CYNOPSIS DIGITAL – TODAY’S TOP STORY: Microsoft made more noise about transitioning to an open-source environment to make its products more interoperable. According to Ray Ozzie, Microsoft’s chief software architect, the company realizes it must deliver software and services any developer can use to integrate with other applications, insure maximum innovation and value for the end user. That doesn’t mean Vista or Office will be written in open source, but it will mean the release of APIs for these products to allow developers to create plug-ins and widgets for them. CYNOPSIS KIDS – TODAY’S TOP STORY: Kids in China are not going to be watching some of the most popular cartoons from around the world under a new government ban of imported animated series during primetime (5-9p) there. The ban, which begins May 1, 2008, is furthers a previous move by the government that prevented animated programming to air between 5-8p.
