Elon Musk has filed an antitrust lawsuit against advertising coalition Global Alliance for Responsible Media. The lawsuit accuses GARM of colluding with brands to boycott X and “collectively withhold billions of dollars in advertising revenue.” GARM encouraged advertisers to avoid X after Musk took over the company in 2022, concerned about racist content and misinformation. Eighteen GARM members stopped advertising on the platform and dozens of others reduced their spending by 70 percent or more, said the filing. X is asking for a jury trial, compensatory damages and injunctive relief. “We tried being nice for 2 years and got nothing but empty words,” posted Musk on X. “Now, it is war.”
Fox reported total sales of $3.09 billion for the three months that ended in June, up 2% from the year before and even with analysts’ estimates. Ad revenue was flat, with gains at Fox Sports and Tubi offset by lower ratings and pricing at the Fox Network. “Fiscal 2024 was another successful year for Fox with very clear achievements across our portfolio, including delivering strong total company affiliate revenue growth each quarter from our ongoing renewals, cementing Tubi’s position as the most watched free TV and movie streaming service in the United States, and generating reinvigorated ratings and share growth at Fox News,” said CEO Lachlan Murdoch.
Charles Barkley isn’t going anywhere. Despite Barkley’s announcement in June that he would retire after next season, which will likely be the NBA’s last on Warner Bros. Discovery, the Emmy-winning “Inside the NBA” co-host has had a change of heart and will continue to exclusively contribute to TNT Sports. Said Barkley, who signed a 10-year agreement with TNT Sports in 2022, “I love my TNT Sports family. My #1 priority has been and always will be our people and keeping everyone together for as long as possible. We have the most amazing people, and they are the best at what they do. I’m looking forward to continuing to work with them both on the shows we currently have and new ones we develop together in the future. This is the only place for me. I have to say … I’ve been impressed by the leadership team who is fighting hard and have been aggressive in adding new properties to TNT Sports, which I am very excited about. I appreciate them and all of my colleagues for their continued support, and most importantly our fans. I’m going to give my all as we keep them entertained for years to come.” Even without the NBA, WBD has plenty of sports programming to keep Barkley in action, including college basketball and football, the NHL, and more.
Warner Bros. Discovery is reportedly exploring the sale of smaller assets after considering the possibility of splitting its linear from its streaming and studio businesses. According to the Financial Times, it was determined a split would involve “very significant operational challenges.” FT pointed to WBD’s Polish broadcaster TVN or a stake in its video game division as potential sales targets.
CNET has been sold by Red Venture to Ziff Davis for over $100 million, reports the New York Times. Red Venture acquired the digital news site from ViacomCBS for $500 million in 2020.

The fourth and final season of HBO’s “My Brilliant Friend” premieres Monday, September 9 at 9p. The series is based on the novel by Elena Ferrante.
Tied to the debut of drama series “Rescue: Hi-Surf,” Fox Entertainment is partnering with the United States Lifesaving Association to support the “Lifeguards First” campaign. Prices for Disney streaming services will rise on October 17, with most price hikes either one or two dollars a month. Disney+ is also adding continuous playlists to its core subscription offering, giving viewers both a live and on-demand streaming experience. “Playlists are the latest example of how we’re providing the best value and experience for our subscribers every time they open Disney+,” said Disney+ President Alisa Bowen. “Whether its news, kids’ content, popular genres, hit TV shows or blockbuster films, there will be something for everyone in a lean-back viewing experience based on seasonality and interest.”

TikTok and parent company ByteDance asked a US appeals court to reject the Justice Department’s bid for court approval “to file more than 15% of its brief and 30% of its evidence in secret,” as the Justice Department seeks to force the divestiture of TikTok’s US assets by January 19 or face a ban. If they “are unable to review the government’s evidence,” said ByteDance, they “will be unable to rebut contentions that are factually incorrect – let alone explain to the court why the government’s arguments and evidence are legally insufficient.”
Department Stores’ streaming ads were 19% more effective than the category’s Convergent TV average, according to EDO’s annual Department Store Convergent TV Outcomes Report. Findings include:
· Walmart was the winner in the space, with an ad engagement rate 144% more effective than the category average. Target’s linear ads outperformed its Convergent TV average by 7.5%, while Marshalls’ streaming ads outperformed its Convergent average by 43%.
· The highest propensity to engage with convergent TV ads for men is among those ages 18-24 (+22%), while the highest propensity to engage with ads for women is 55-64 (+72%).
· The lowest propensity for both men and women were viewers in the 35-44 age range (-20% for men; -23% for women).
· Tuesday, Wednesday, and Thursday marked the days with the most engagement, while Morning Daytime, Afternoon Daytime, and Early Fringe all proved more effective than Primetime.
