Good morning, it’s Monday, April 20, 2009, and this is your first early morning digital briefing. 

The Screen Actors Guild and the AMPTP reached tentative agreement on Friday on a shorter two-year TV/theatrical contract – potentially averting a strike and ending a ten-month stalemate over digital content rights that had halted production of most studio movies. The deal, which grants 3.5% annual pay increases and establishes a fee structure for shows streamed on the internet, includes no real changes regarding new media revenue sharing from the studios’ offer posed in February, according to Digital Media Law – essentially mirroring the same provisions agreed to this time around by the DGA, WGA and AFTRA. In a separate agreement, the SAG and AFTRA boards approved the commercial contracts reached on April 1 that establishes a first-ever payment structure in commercials for the internet and other new media platforms.

~ MULTIPLATFORM CONTENT NEWS ~

 
The next step in a gradual effort to incorporate premium content on to the portal, YouTube launched a pair of new destinations late Thursday featuring movies and full episode TV shows from existing content partners including Crackle/Sony Pictures, CBS, MGM, Lionsgate and Starz. (Hulu shouldn’t be nervous just yet but the basic structure is there.) As a way to bolster its ad revenue, YouTube also unveiled an online version of the Google TV Ads platform to help advertisers target viewers of online content with video ads placed on a CPM basis. Formats include pre-roll and post-roll; spots purchased in featured shows will also show up on sites that syndicate these videos.
 
The NHL launched a new ad supported mobile site powered by Quattro Wireless just in time for the hockey playoffs featuring statistics, photos, standings, schedules, scores and personalization features. Quattro will manage ad sales for the site. Charter advertisers include DirecTV, Papa John’s, FX Rescue Me and Universal Studios.

~ DIGITAL ADVERTISING ~

 
Lead generation advertising is a significant money maker online but it has suffered from a lack of tools that help advertisers place more precise buys. IndustryBrains founder Erik Matlick is unveiling a new online ad firm today called Madison Logic, offering a full service lead generation ad serving platform. The proprietary ad and lead generation delivery platform provides a suite of tools, including ad serving via contextual and behavioral targeting, inventory management, reporting, analytics and lead delivery/management for publishers and advertisers. It deploys algorithms to place the right advertiser in front of the right buyer in real-time. “There’s been no standards in place for how leads are generated or priced,” said Mr. Matlick. “In our system advertisers can bid on placements, which should effectively drive the price and yields up.”
 
Cox Media and Cox Communications subsidiary AutoTrader is launching a vertical ad network powered by Adify to deliver reach to advertisers looking to get in front of the site’s 15 million monthly uniques. More than 40 local media sites will be included in the network of publishers including AskPatty.com, NADAGuides.com, AutoMart.com, TopGear.com, Care2.com, and Greencar.com.
 

~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~

 
Content owners won a victory in what industry groups hope will serve as important toehold in the legal war to challenge online piracy. The operators of P2P file sharing site The Pirate Bay were found guilty of copyright infringement in a Swedish court on Friday, sentenced to one year in jail and ordered to pay about $3.7 million in damages to offended parties including Warner Bros., Columbia, 20th Century Fox, Sony BMG and EMI. The MPAA applauded the ruling but insiders warned that the decision would do little to immediately stem the flow of online piracy. Meanwhile The Pirate Bay remains operational as its four founders, defiant to the end, prepare for an appeal.
 
WPP filed a lawsuit against the LA-based create-your-own spot ad service Spot Runner it invested in back in 2006, reports Ad Age, accusing the company of failing to disclose a stock sale to other shareholders. WPP also alleges that Spot Runner touted the ad holding company’s investment in it to gain new investors, only to turn around and sell the stock in violation of federal and state securities law. WPP is seeking $13 million in damages in addition to attorney’s fees.
 
WorldNow
inked a syndication partnership with web video clipping service Redlasso allowing WorldNow’s local media clients to syndicate video through blogs and other third party sites as well as offer rights-cleared content from Redlasso’s library. Redlasso, which was forced to shut down its popular service last year after Fox and NBC Universal threatened legal action, struck a similar deal with Fox owned-and-operated stations last month.
 
Time Warner took the hint and announced it was shelving its plan to roll out consumption-based internet plans that would ramp up to as much as $150/month for heavy users. 

eBay confirmed it will make a cash tender offer of up to $1.2 billion to acquire a controlling stake in Gmarket, South Korea’s leading e-commerce site. The per share price is set at $24 for over 67% of the Gmarket shares, including a 10% stake originally owned by Yahoo.
 
NAB Show organizers have expanded online video program offerings to include daily coverage of the NAB Show this week in Las Vegas. The program will present four segments comprising a daily highlight video, feature stories hosted by on-air talent, a series of interviews with industry leaders as well as footage shot from the show floor. Highwinds Network Group, Inc., a content distribution provider and NAB Show partner, will deliver the video content to online audiences over its content delivery network. Digital Rapids will provide encoding services.

The digital divide between the general population and U.S. Hispanics appears to be eroding. The Hispanic online population reached a record 20.3 million visitors in Feb. 2009 according to comScore, representing 11% of the total U.S. online market. During the past year, the growth of the U.S Hispanic internet audience outpaced that of the total U.S. online population in terms of number of visitors, time spent and pages consumed. The total amount of time spent online by Hispanics increased 6.9% in 2009 (3.9 times faster than the total U.S. online population), while total pages consumed grew 6% (3.6 times faster than the total U.S. population).

Webby-nominated audio news app Stitcher struck a series of new partnerships this month to add to its already extensive podcast offerings. The application added streamed podcasts from Newsweek, The Wall Street Journal Radio Network, Fox News Radio, Air America Media, POLITICO, IGN.com, TechCrunch, Quick and Dirty Tips and AOL Weblogs including Engadget, Switched, The Unofficial Apple Weblog and Joystiq. Stitcher is also working on a BlackBerry version of the app, expected to be released in the next few weeks.

NY-based Post Production Firm Merge Creative Media is hosting a free summit sponsored by Panavision at the Tribeca Film Festival on Wednesday, April 29 to debut its original Digital Workflow solution ­- geared toward repurposing content over multiple platforms.

Call it the Hulufication of online video. Metacafe is flicking the switch on a major new redesign this morning unveiling a new rotating leaderboard and reorganizing its video content into key entertainment categories: Movie Trailers, Music Videos and Sports Highlights. Metacafe has steadily grown over the past couple of years – fast approaching 50 million worldwide uniques – but like everyone else in the space is struggling to make its advertisers as happy as its users. The redesign adds more polish and thematic focus for brand advertisers, providing brand extension opportunities for hub sponsors such as Universal Pictures, which signed a deal to promote 4 features within the Movie Trailers hub.  Additional content partners will be integrated into these hubs in the coming weeks and months, and additional hubs including TV Clips and Video Game Trailers will be launching over the course of 2009. “We’re seeing brands coming to us saying they plan to shift tens of millions of dollars to online – in today’s climate they want to do more with less,” said Erick Hachenburg, CEO of Metacafe. “The problem for us is that the scale of revenue is different that what we’re used to; we’ve had to get creative to try and accommodate them.” Sounds like a nice problem to have. Now let’s see if a broader range of advertisers can be brought on board.
