Good Morning.  It’s Thursday, September 27, 2007 and this is your first early morning briefing. 

The Department of Justice will seek Supreme Court review of the Second Circuit court’s ruling in the FCC’s “fleeting profanity” indecency case.  The Solicitor General of the Department of Justice has asked for an extension until November 1 to file the appeal. The FCC had originally found the “fleeting profanities” spoken by Nicole Ritchie and Cher in two different Fox Billboard Awards shows were indecent.

~ MORE GOOD STUFF ~

NBC will unveil the live reality show Phenomenon October 24 at 8p. Mystifier Criss Angel and mentalist Uri Geller will search for the next great mentalist during the five-week run which also includes a special two-hour live episode on Halloween night at 8p. Ten chosen mentalists will compete against each other, demonstrating their unique powers in front of a panel of celebrity guests and the studio audience. Criss and Uri each will offer advice, but viewers will decide who wins the final grand prize of $250,000. The series is a co-production of Granada America/Keshet Broadcasting/Kuperman Productions in association with SevenOne International.

Let’s revisit the new Nielsen rule for multiple airings of the same show in one week where the program and commercial content are identical for both airings.  The rule applies to programs airing on broadcast and then a second airing on broadcast; as well as programs having an original broadcast airing followed by cable run.  What the rule does not apply to is a program that airs originally on cable.  In the worlds of Nielsen, “that is not the case with current systems & policies.”

“Give me a ‘C'” – CMT’s new makeover reality series, I Want to Look Like a High School Cheerleader Again, follows ten former cheerleaders as they regain their physiques through Army boot camp-style training. The eight-episode series debuts October 6 at 830p, and Dallas Cowboys Cheerleaders’ trainer Jay Johnson, along with his wife Lin and host Jenn Brown, work the contestants hard so they can fit into their old high school uniforms again for a $50,000 cash prize. The series is produced by Triage Entertainment.

Scripps Networks made a multi-year pact with Comcast to distribute HGTV HD and Food Network HD. Comcast has begun this task as both networks are now in Boston and parts of New Jersey. Comcast will launch the networks in other markets over the next year.

Comcast agreed to add TBS to its HD line-up, just in time for the first round of the MLB playoffs, which will be carried on the Turner network as part of a new seven-year deal. In more baseball news, MLB.com launched a slew of new mobile features providing fans with text alerts, gameday audio, video clips and a newly revamped mobile site.

Journal Broadcast Group, a division of Journal Communications, Inc. entered into a purchase agreement with Mirage Media, LLC to buy KPSE-LP/Palm Springs, the MyNetworkTV affiliate. Terms of the deal were not disclosed and the transaction is subject to regulatory approval and standard closing conditions. Journal Broadcast Group expects to begin a LMA with Mirage stating October 1, 2007.

IMHO:  Bionic Woman will get me back once more tho I admit I was looking for that bionic reverb sound from the original … Private Practice I’ll leave to the Grey’s fans … Dirty Sexy Money started well, but saw more of the inside of my eyelids than Peter Krause, ‘course that may be less his fault than my own.

~  PRODUCTION & DEVELOPMENT ~

TNT will shoot the pilot of its new project called Truth in Advertising, and signing up to join the cast is Eric McCormack.  The show is set in a Chicago ad agency and McCormack will play the Art Director at the agency.

Attention K.I.T.T. fans … Knight Rider may be back!  NBC is looking at a 2-hour pilot, which may first air as a made-for later on this season, and if well received could get the order for a series, says Variety. The project comes from Dutch Oven Prods and Universal Media Studios.

NBC has given a series order to The Philanthropist from Levinson/Fontana and Universal Media Studios.  The story is about an extraordinarily wealthy man who uses his money to help people, no matter what the consequences may be to himself.  Fontana will write the script … always a good thing.

ABC has also stepped up with a series order for Section 8 from BermanBraun, about a group of people who all have some sort of neurological quirks and special abilities that make them particularly appealing for work at a secret government agency.

Fox has picked up a drama project called Invisible, about a criminal looking to change his life for the better who comes across a chemical making him invisible. I know that sounds like he could now be a super criminal, but he uses his invisibility to do good stuff. This project is from McG’s Wonderland Sound and Vision and Warner Bros. TV.

ABC has given a commitment with penalty to a one hour drama project called Limelight.  The storyline is similar to the series Fame – students and faculty at a NY based performing arts school, per Variety. The project comes from McG’s Wonderland Sound and Vision and Warner Bros. TV. 

Another project with something of the same theme, has been picked up by NBC and given a script commitment.  As yet untitled, it follows young performers, now out of school, and living together in NYC, trying to find their big break, with parts of the story being told via the performance art of the characters – song, dance, etc.

ABC‘s comedy project Literary Superstar has cast Jenna Elfman in the lead role of a book publicist.  The project is from Sony Pictures TV and ABC Studios.

The Ryan Murphy FX drama project 4 oz. (the title is now just Untitled), has cast Joseph Fiennes, Robert Wagner and Blythe Danner in the pilot episode.  Fiennes will play a character undergoing a s#x change operation; Danner and Wagner are his parents.  The pilot is scheduled to begin production next month.

~ EXECUTIVE MOVES ~

ABC News appointed Eric Horng as Correspondent based in Chicago. Eric will report for all of ABC News’ broadcasts and platforms. Before this position, Eric was a Chicago-based correspondent for NewsOne, ABC’s affiliate news service.

SignStorey, Inc. which announced it will be acquired by the CBS Corporation and renamed to CBS Outernet later this year, named Jeff Weidauer to VP/Marketing and Janet Metzger to Director/Retail Marketing. Jeff reports to Virginia Cargill, CEO, while Janet reports to Jeff. 

Jim Orr advanced to EVP/GSM, Domestic Theatrical Distribution with MGM. In his new role, Jim will manage distribution of all the studio’s theatrical films in North America which will encompass domestic sales planning and implementation. Jim will continue to be based at company headquarters in Century City.

MTV added Maira Suro as SVP/Series Development, West Coast. In this new position, Maira will be in charge of all new series development, both scripted and reality, coming from the West Coast, in addition to supervising the West Coast development staff. Based in Santa Monica, she will report to Liz Gateley, SVP/Series Development.

Doug McCormick joins ReelzChannel’s Executive Management Board as Vice Chairman. Doug currently is the Non-Executive Chairman of LIN TV and a venture partner with Rho Ventures, a division of Rho Capital Partners. 

Koch Vision tapped Steven Galloway as VP/Acquisitions where he will focus on acquiring North American home entertainment distribution rights for programming that includes movies, classic and newer television series, music specials and series, animation and other special interest programming. He will also establish relationships with independent studios, cable networks, producers and other content providers for the company’s distribution avenues. Steven will be based in Los Angeles and reports to Michael Rosenberg, President.

Tuesday – A18-49 Analysis:  FOX won Tuesday night with a 5.4/14 A18-49, according to fast affiliate ratings from Nielsen Media Research. ABC’s Dancing with the Stars led at 8p with 4.6/13, followed by FOX’s Bones season opener at 3.2/9; and CBS’ NCIS debut at 3.1/9. FOX’s House season premiere led during 9p at 7.7/19; ABC’s combo of Dancing/Stars and the fourth season arrival of Boston Legal averaged a second place 3.8/9; in third was NBC’s The Biggest Loser at 3.3/8; and ranking fourth was the opening of CBS’ The Unit at 2.8/7. Coming in sixth overall this hour was CW’s Reaper at 1.5/4, although the new show posted a 1.8/5 with its target demo of A18-34. At 10p, NBC’s long-time Law & Order: SVU was first at 4.8/13, with CBS’ new Cane next at 2.9/8 and ABC’s Boston Legal in third at 2.5/7.
