Google responded to Viacom's $1 billion lawsuit stating it was
protected under the 1998 Digital Millennium Copyright Act and arguing the suit
threatens entertainment, education and free speech on the internet. "By
seeking to make carriers and hosting providers liable for internet
communications, Viacom's complaint threatens the way hundreds of millions of
people legitimately exchange information, news, entertainment, and political
and artistic expression," read a PDF filed with a U.S. District Court in
New York. The two companies are scheduled to meet July 27 with the judge, who
will likely then set a courtroom date.
~ MULTIPLATFORM
CONTENT NEWS ~
Dow Jones & Co. was suddenly put into play with an unsolicited $5 billion
buyout bid from News Corp. The news sent shares of Wall Street
Journal publisher soaring yesterday, as the $60/share offer would be at a
65% premium over Monday's closing price. The stock price leveled off when it
was reported that Dow Jones' controlling shareholder, the Bancroft family,
plans to vote against the proposal. The announcement led to speculation that
the Bancrofts could be posturing to coax a higher bid
or allow other suitors to join the bidding. Dow Jones' digital assets include wsj.com, Wall
Street Journal Asia, Barrons.com, Far
Eastern Economic Review, Dow Jones Newswires, CareerJournal.com and MarketWatch.com. All of could work
nicely with News Corp.'s plans to launch a new financial news network.
The International Academy of Digital Arts and Sciences announced the
winners of the 11th Annual Webby Awards. Special Achievement Awards went
out to David Bowie and eBay for Lifetime Achievement, to YouTube founders Steve
Chen & Chad Hurley for Persons of the Year, to Ask A Ninja for Actor of the Year and to
Jessica Lee Rose (Lonelygirl15) for Actress of the Year. Current TV won for Best TV site, blip.tv for Best Broadband site and The Onion for Best Humor site. Winners will
be honored at an awards ceremony hosted by Rob Corddry

Not to be outdone, the National Academy of Television Arts and Sciences (NATAS)
announced the formation of its own digital group. But rather than add to the
new broadband Emmy category, the National Academy of Media Arts &
Sciences was formed to court new media members and promote new media
education. Outgoing NBC Universal chairman Bob Wright was appointed by
the NATAS board to run the new peer group.
TBS will add a free ad-supported version to its subscription-based
online gaming platform GameTap from May 31. The company found that
"several million" users visited the site monthly, but that many do
not return after their free trial subscription expires. The free service will
feature action/adventure, racing, sports and fighting titles. GameTap will continue to offer a premium "gold"
service of more complex games free of ads.
Turner Sports' PGATour.com will
offer live coverage of this week's Wachovia Championship from Quail
Hollow. Live video coverage of the signature par 3 -17th hole will be sponsored
by Buick during all four rounds, from 9 am-6 pm ET Thursday and Friday and from
11 am-6 pm ET Saturday and Sunday.
TVGuide is planning a series of cross platform
content initiatives to commemorate the "Finale Fever" of May sweeps,
centered around a mini site on TVGuide.com.
The site features previews of major finales, video scoops and links to blogs,
message boards and user groups for each show.
Discovery.com launched TLCs Family Guide
featuring tips on raising kids and a Family Forum for users to share war
stories. The Travel Channel site also introduced a broadband feature
documenting wildlife from the National
Parks.
AZN.com is inviting viewers to vote
for their favorite Asian reality TV star and their choice for Outstanding Asian
Independent Film. Winners will be announced during the AZN Asian Excellence
Awards on May 29.
~ INNOVATORS & START-UPS ~
Joost announced the next step of its
launch, inviting existing beta testers to invite anyone they wish to join via
an "Invite Friends" widget in the "My Joost" area of the
downloadable player. Meanwhile Turner Broadcasting joined Joost roost
offering content from Adult Swim (Aqua Teen Hunger Force and Robot
Chicken) and CNN (Anderson Cooper 360 and Larry King Live). Hasbro, the
NHL, Sports Illustrated and Sony Pictures Television video will also be added
later this month. The service should be available to everyone by the end of
May.
Jeff Jarvis and Peter Hauck's election video blog PrezVid.com signed a deal with washingtonpost.com to contribute
content to a new blog featured in its "Politics" section throughout
the duration of election season.
Consumer networking site ExpoTV
added several new social networking features allowing users to share
video-based opinions, reviews and ideas on new products. Users can choose to
place their profiles in defined categories including "bargain
hunter," "gear head," and "greenie," for environmentally
conscious buyers.
Music industry social networking site AbovetheLine.TV
launched an online contest in conjunction with its multiplatform reality show
"Above The Line: The Search for America's Next Music Video Director".
The director with the highest-rated music video wins a trip to the 16th Annual Music Video Production Association Awards.
~ TECHNOLOGY DEALS, MERGERS AND SKIRMISHES ~
U.K. broadcaster ITV unveiled a free broadband TV service scheduled to
launch in the coming weeks. ITV.com will be predominately ad supported,
and feature streaming full-length versions of such popular shows as X Factor
and Coronation Street. The broadcaster also plans to include opportunities for
users to submit their own content.
Sling Media unveiled the SlingPlayer for Mac. Slingbox owners can now view TV, DVR and DVD content
on Macintosh screens remotely. SlingPlayer also now
supports playback from the Apple TV, Front Row and iPods. Go to the Sling Media

~ DIGITAL ADVERTISING ~
Comcast and Yahoo agreed to a multiyear partnership allowing
Yahoo to supply display and video ads to Comcast.net, a top-ten portal with
some 15 million unique visitors a month. The deal is a big win for Yahoo, as
Google had been in negotiations with Comcast on a wide-ranging deal that
included access to its cable inventory. Yahoo's services will be integrated
into the upcoming Fancast.com as well as a major redesign planned for
Comcast.net later this year. Comcast Spotlight will continue to bundle
Comcast.net ads in cross-platform, locally-targeted packages.
Microsoft is considering offering around $1 billion for online ad firm 24/7
Real Media, according to The New York Post. Google's acquisition of
ad server DoubleClick has focused increased attention on the space. Ad Agency
conglomerate WPP is also interested in the company.
Reuters launched a "virtual brand channel" for Hyundai
Motor America, placing the automaker's branding adjacent to relevant
"smart thinking" stories that scroll within a box on the left side of
Reuters.com. Reuters programmers
developed an algorithm based on keywords and attributes that appeal to the
desired demo targeted for Hyundai's Veracruz SUV, identified by Hyundai and ad
agency Carat Fusion/Los Angels. The campaign
is the first to take advantage of a new platform on the site developed by
Unisys and Savvis.
Contextual advertising company ContextWeb
Inc. unveiled the online ad exchange ADSDAQ.
The exchange allows publishers and advertisers to place a firm bid or "ask"
price, accommodating large and small players.
Ad Age released its annual "Interactive Report Cards,"
grading the ten leading digital ad agencies for their work in 2006. The profs
were strict; the highest grade given was a B+. Agency.com: D+, Akqa: B, Avenue A/Razorfish: B,

Search engines such as Google
are responsible for driving users to news sites more than ever before,
according to Hitwise. Print news sites
received 29.7% more traffic from Google during the last year while Broadcast
Media sites received 35.9% boost. Market share of visits to the top 10 news and
media sites declined 3.8% from March 2006 to March 2007, indicating
fragmentation as users spend more time on blogs and other non-traditional news
sites such as Digg.
Major household brands continue to be high-jacked online with domain names that
use trademarked words and similar spellings, according to a new study by MarkMonitor. A survey of the top 25 companies on the
Interbrand 100 list of most valuable brands found
more than 286,000 instances of cybersquatting, an
average of 11,400 for each company.
Circulations continued to fall at many of the large metro newspapers across the
country, according to the latest figures from the Audit Bureau of
Circulations. Circulation at The New York Times fell by 1.93%, at
Tribune's Newsday by 6.9% and at Belo's Dallas Morning News by
14%. National dailies fared slightly better, remaining flat compared to last
year.
The market for mobile advertising in the U.S. grew to $421 million in 2006,
according to eMarketer. The number of mobile
video subscribers reached 6.2 million as of Dec. 2006, up from 2.5 million from
the previous year.

Accel Partners
announced Andrew Braccia will join its Palo
Alto office as a general partner. A former Vice President of Consumer Web Search
for Yahoo, Andrew will identify investment opportunities in consumer internet,
search, digital media and online advertising for the venture capital firm.
~ WEBSITE OF THE DAY ~
No Good TV launched yesterday, one of the
more star-powered broadband video sites to come along so far. (Look for promo
clips by Eva Longoria and Johnny Depp if you don't
believe me.) The site is more than a little irreverent, rejoicing in the absence
of FCC oversight with lots of cuss words and innuendo. One of its signature
shows is Up Close, featuring what are basically long-form movie trailers
where the stars of comedies such as Blades of Glory and Reno 911
get to tell you how they really feel about the #%!$ing
movie. Original content with Will Ferrell is never a bad thing.
