The Supreme Court sided with TV networks against Aereo on Wednesday, ruling in a 6-3 decision that the streaming service violated copyright laws by using antennas to transmit broadcast networks over the Internet for a fee. “Blocking this technology is a big loss for consumers,” said Aereo backer Barry Diller, who told CNBC the company “is over.” The National Association of Broadcasters maintained the ruling “sends an unmistakable message that businesses built on the theft of copyrighted material will not be tolerated.”
CBS CEO and President Les Moonves, who has been vocal throughout the court hearings leading up to the SCOTUS case, told Bloomberg TV yesterday: “What Aereo was doing was not about technology: it was about theft. Yes, it was a new technology and there’ll be others, but right now because of the Supreme Court ruling, people will have to pay for our content.”
NBC’s statement from Paul Clement, the attorney for the petitioners (CBS, Disney/ABC, Fox and NBCU), said “Today’s decision is a victory for consumers. The Court has sent a clear message that it will uphold the letter and spirit of the law just as Congress intended.”
The Walt Disney Company (owner of ABC) told Cynopsis, “We’re gratified the Court upheld important copyright principles that help ensure that the high-quality creative content consumers expect and demand is protected and incentivized.”
Omnivision Entertainment and MyDamnChannel CEO and Founder Rob Barnett, who said in April that he thinks Aereo’s technology will eventually be acquired by one of the major broadcasters, today told Cynopsis: “The best innovations will continue to come from entrepreneurs and visionary new companies who move with speed, smarts and passion to deliver the best content to fans at a fair price. The new explosion of mergers and acquisitions in digital media proves that Goliath is hard at work, figuring out how to best deal with David.”

DEFY Media launched the Creators Program yesterday, to help YouTube creators leverage new distribution channels and additional revenue opportunities. Partners to debut with the program include digital talents such as Greg Benson (“Prank it FWD” with 25 million views to date), Kingsley (three million YT subs), Marie Digby (DEFY Media musician) and Matthew Patrick’s Game Theorists (2.2 million subs).
Time Inc. and short-form video programmer Net2TV have teamed up to kick off new shows for its Portico TV service. Short-form series People This Week, The Week in Time, Cooking Light, Inside Golf Magazine and Cooking Light will now be free to the Net2TV’s 25 million viewers on Smart TVs and connected devices.

The CW Network, Yahoo and Clear Channel Radio station will air and stream the third annual iHeartRadio “Ultimate Pool Party.” The two-day musical weekend on June 27-28 is hosted by Nick Cannon and will feature performances from Jennifer Lopez, Iggy Azalea, Tiesto and more. The event will stream live on Yahoo and Clear Channel at 9p ET on June 29, and on the CW Network on July 9 at 8p ET.
ABC Family is celebrating Christmas in June with a “half-mas merry-thon” featuring the network’s holiday movies on the WATCH ABC Family App. The red and green marathon will bring ten of the most popular holiday movies like A Very Brady Christmas, Christmas Cupid, Snowglobe and more. Yahoo introduced a new display advertising campaign platform with 100 percent viewability rate on its properties, called Yahoo Prime View. “Now advertisers can get more exposure for their ads without changes to workflow, reporting or creative,” Yahoo’s SVP of Display Advertising and Advertising Tech Scott Burke said. The viewability measurement uses methodology accredited by the MRC.
Programmatic marketing and data management platform [x+1] announced the extension of its Data Management Platform (DMP), called Origin KeyChain. “Origin KeyChain arms marketers with the precision of CRM and power of a DMP to engage users in progressively relevant dialogues across a complete range of channels, screens, and devices…online and offline,” CEO John Nardone said.
Cross-screen ad and TV ad tracking company wywy acquired Second Screen Networks. As part of the deal, wywy is expanding into the U.S. market and opening a new office in New York.
With the World Cup now halfway through, Unruly updated The Brazilliant Brands Tracker that features 11 brands to represent the number of players on a team. The results showed that brands not affiliated with the sporting event drove 71.2 percent (8.9 million) of the total 12.5 million shares so far. The top player was non-sponsor Activia with 3.9 million shares, and also the sixth most shared ad of all time. Nike beat out rival and official tournament sponsor Adidas with 2.4 million shares. Those in the top 11 by most shared soccer ads are as follows: Activia, Nike, Samsung, Castrol, Adidas, Coca-Cola, Beats by Dre, ESPN, Emirates, Nissin Group and Banco de Chile.
Binge-viewing’s nothing to be embarrassed about, according to a study from Tivo. While 53 percent of respondents surveyed in April 2013 felt the habit had negative connotations, that number dropped to one third in the current report. Three quarters of those surveyed reported they’d “super-binged” three or more episodes of a series in a day, and 29 percent admitted to putting off watching a season of a show until they could watch it all at once.
